Clarification to "Traveling" Law Passed in 2005 by Sen. Juan Hinojosa (D-McAllen)/ Rep. Carl Isett (R-Lubbock)

In 2005, the Texas Legislature passed a bill establishing that a person was presumed to be traveling if he or she were in a private vehicle, the handgun was not in view, the person was not prohibited by law from possessing a firearm, they were not engaged in criminal activity, and they were not a member of a street gang as defined by law. The intent was clear and stated in the House Journal that law abiding citizens had the right to have a handgun in their car or truck without a concealed handgun license. However, some District Attorneys thumbed their nose at the Legislature and have gone so far as to issue public statements that they will arrest anyone found within their jurisdiction with a handgun in their vehicle without a CHL and let the "courts sort it out". Further changes are being drafted.

In 2006, I was talking to a Euless Cop who came out with the unbelievable statement of "That can't be the law! If it was, anyone could just carry a gun in their car!" And he was seriously acting as if he was in disbelief. This really annoys me to no end. I hope there's some sort of criminal proceedings available for cops who willfully refuse to uphold this law.
 
This is full of it.

TX LEOA and the criminal punishment system there are built to make money. Protect it'self and insulate the commissioned officer from the population.

Nothing will change the minds of those LEOs who would jack someone over possession as a sole cause for action.

The best would be a career and RKBA ending criminal penalty for LEO and DA actors. I would not call them peace officers.

2nd amendment does not seem to be protected by penalty from anyone in position.

This is really the key part of it. When I moved here and first heard of the 'travelling' clause, I didn't really have any intention of getting my CHL as soon as I did. But upon further investigation and reading some horror stories, getting the CHL seemed like the best way to go to negate the situation. But at the very least, it getting some eyes on the situation. Gotta start somewhere.

In the meantime, go get that CHL and carry free!
