Shotgun blast stops robber's truck

A would-be burglar who tried to strike the same home twice in as many
days received a rude welcome Friday from a far West Side homeowner.

Police said the homeowner, who lives in the 3500 block of Sunnydell
Drive, had his house broken into Thursday and suspected the robber might
strike again Friday. So he stayed home from work.

When an unidentified man tried to open the side door of the home just
after noon Friday, the homeowner surprised the intruder and held him at
bay with a shotgun, police said.

The owner, however, was distracted as he waited for police, and the man
jumped back in his vehicle and drove away, police said.

As the man was fleeing, the homeowner fired one shot at the vehicle, an
older model GMC truck, and apparently hit its radiator, police said.
After making it to Loop 410 and Texas 151, the vehicle broke down, and
witnesses told police the man ran toward a nearby shopping center.

Police searched the area Friday afternoon with a helicopter and police
dogs, but no arrest was reported.

So does this suggest that a 12 guage is not enough for GMC's? Dang, I'd better see about getting that LeGendre modified Garand in .338 Win Mag.

Good for the homeowner. D'ya figure they can run the plates/ VIN on that truck and see what comes up?

Is it legal to shoot after fleeing intruders if they are off of your property in Texas?
 
Not on your property and not fleeing with your property and not at night, my guess is that it is not legal to use deadly force by non-leos.

For after dark events, deadly force can be used in such a situation where the person is still on your property during the commission of a crime or while fleeing with your property if you feel that recovery of said property is not likely if the guy escapes or that you don't have another reasonable way to preclude the guy's escape with your property.

You know, you have to wonder how they were so certain the same guy did both jobs.

As an observation, this is a nifty example of how easy it is for a person held at gunpoint can manage to escape. Basically, few of us outside of the LEO profession have any real training of how to go about detaining such a person until the law arrives. Given the homeowner was distracted and it was the distraction that made flight possible, the homeowner should probably consider himself lucky that the guy chose not to charge him during that time. Basically, the longer you remain in proximity to a bad guy, the greater the chances are that something negative will happen to you.
