VT h.422, CONFISCATION bill without judicial oversight

Hi all, here in VT we have the latest bit of 'literal' gun grabbing legislation, seeking to obfuscate Constitutional rights. As what happens in a "frontier" state such as VT is likely to be visited on less gun friendly states such as yours, I think a open and broad dialogue on the tenets of our constitution as it relates to Constitutional infringement, without judicial oversight, is a compelling discussion to have. Do you think that the argument "if even one life is saved it will be worth it" is a argument superseding constitutionality?

Under H.422 all someone has to do is accuse you of domestic assault and even if there is no arrest, any officer responding can, on whim, decide the parameters and scope to which he interprets your rights to your property.

What do y'all think about our 4th, 5th, 14th rights being superseded without judicial oversight?

MONTPELIER, Vt. (AP) - A Vermont legislative committee has advanced a bill that would allow police to temporarily seize firearms from the scene of a domestic violence incident.

Vermont Public Radio reports the proposal says the seizure could occur if someone is cited or arrested on a domestic assault charge. It would allow police to remove the weapons for five days without a court order, even if the guns are legal and weren't used in the alleged crime.

Existing law allows police to confiscate guns if they're used, or threatened to be used, or if they're considered evidence of a crime. Otherwise, it takes a court order.

Department of Safety Commissioner Thomas Anderson says there may be some constitutional concerns with respect to the holding period. John Treadwell, chief of the criminal division at the Office of the Attorney General, believes it's constitutionally permissible.

- The liberal press doesn't include the fact that the citation can be as innocuous as an accusation without provocation, eliciting police response, leading to confiscation at the officer's 'omniscient' and 'infallible' discretion.
