I am moving to South Dakota this week, (finally) and was wondering what the gun laws were like. Can someone who is under 21 but over 18 years old buy a handgun in a private transfer? What exactly is a private transfer? Here in CA, a private transfer is when you and the buyer go down to the LGS and pay to have the LGS hold the gun for ten days, and do paperwork. In a private transfer in South Dakota, is there any paperwork? A form 4473? A background check? A waiting time? Do I need to do it through an FFL?

Can you get a concealed carry permit if you are over eighteen, but under twenty-one?

This much freedom is so foreign to me, I don't know what to expect, my cost in ammunition is going to go way up, just because I can take the same number of loaded magazines with me, and shoot three times as much...

Soooo.... the NRA one said that you couldn't be in possession of a handgun if you were under 21, but both the other ones said that you could apply for a concealed carry permit at 18... I didn't see anything about private transfers of handguns to someone that was over 18, but under 21, and it didn't really describe a private transfer...

AAAHHHHH!!!!! Conflicting reports!!!

It does?

The NRA-ILA page said:
A person under 18 may not possess a pistol. This prohibition does not apply when a minor has the consent of his parent or guardian and the minor:

;)

And regarding carrying:

The permit shall be issued if the applicant is:

•at least 18 years of age; ...

I remember walking out of the school and across the street to the courthouse to talk to the County Sheriff the day of my 18th birthday. I walked out of the courthouse in possession of my first concealed carry permit. I'm a lifelong SD resident, and find the laws regarding firearms quite agreeable here, as are the prevalent attitudes both politically and socially.

A private transfer of a firearm in South Dakota consists of the buyer meeting the seller somewhere, the buyer gives the money to the seller and the seller gives the gun to the buyer. That's it.

Federal law requires that both the buyer and the seller be residents of the same state (South Dakota, in this case) and that the seller have no knowledge or reason to believe the buyer is prohibited from possessing firearms.

Oops, I mis-remembered that.

Thanks for that description of a private transfer.... so different than here...

That answered all of my questions except one; can someone that is under 21 but over 18 buy a handgun in a private transfer (after the buyer -and seller- is a resident of SD for a month)? What about at as FFL?

I got the idea... I knew that you meant handgun, because even here in PRC (People's Republic of California) you can buy a rifle from an FFL at 18 :D

When you get a CCW, in SD, do you need to tell them what firearm that you will be carrying? Or can you just carry whatever you want?

Here, you have to put two guns; make, model and serial, on the paperwork; and if you want to carry something else, you have to do all of the paperwork again...

no, you don't need to list/register your carry piece in any capacity....carry what you want

Mouser Lover. When you leave California...Leave it all behind and forget that you were ever there.

SD is a totally different state, with totally different laws...you need to flush and start again.

Sam gave you the links to three good sites, those sites have links to specific laws...read them, remember them...and thank the Good Lord you no longer live in California.
