Would a semi auto version of a Mac10 or something in similar size be NFA?

I am thinking about getting a Bellator Arms H&K MP5 clone or something about that size just for fun and tinkering. However, I am not 100% positive whether this would be an NFA item or not. I mean it's not full auto and technically is not exactly a rifle more of a pistol etc. So I am a little confused as to what category, if any, this would fall under. I mean I know full auto versions require a stamp but what about the semi auto counterparts?
 
if it isnt full auto or fall into sbr territory no need for a tax stamp
 
Semi-auto, no stock, and under 26" overall, and firing from the closed bolt, it should just be a handgun.

If it's over 26" it is technically just an "Other Firearm."

The only ways you'd be into NFA territory would be if it had a stock (and less than 16" barrel), full auto (of course), or if it fires from an open bolt, which the ATF says is too close to full auto for comfort.

MP5s are closed bolt guns anyway, so you should be fine.

The Bellator offering IS a pistol, plain and simple. If you add a stock or foregrip (like the K-grip) you are now illegally NFA unless you do the necessary paperwork first. Same is true of the MAC clones now being offered. They are SA pistols until you start adding stocks and some forends. There is no way for a private citizen to legally modify the MACs to full auto, but there are HK sears that can be legally transferred and used in some of the HK clones.

MP5 and SP89 'pistols' are just that; pistols. In the configuration the manufacturer ships them to the dealer, they are Tile 1 items. No different from, say, a Glock.
