A federal grand jury indicted two men in connection with the wounding last month of state Trooper Chris Cutrone, the U.S. Department of Justice said in a news release. One of those indicted, the release said, was the alleged shooter, Brent David Derrick, 26, of Texas, who was charged with transporting a stolen 1996 Buick Le Sabre across state lines and possessing and discharging a Ruger .45 caliber semi-automatic handgun during the commission of a crime of violence. Derrick, who is being held in Montezuma County Jail, also faces separate state charges for the shooting itself.

The grand jury also indicted Gabriel D. Peabody, 32, of Towaoc, the release said. Peabody is accused of making a false statement to investigators during the manhunt for Cutrone's shooter, the news release said. The release said Peabody, who officials say has no apparent connection to the shooter, was arrested on Wednesday without incident at his home.
