Adventure Outdoors vs Michael Bloomberg and NYC

I'm sure you've thought of this already, but if not, be sure to contact the National Shooting Sports Foundation. This is your trade association and they have given your case a lot of space on their bulletins
 
Jay Wallace is a class act. His business, Adventure Outdoors, is a good gun shop and have been railroaded by the monied Mayor Bloomberg. Fortunately a lot of folks have stepped in to help him fight back.

Keep in mind that a lot (most?) of the other gun stores being sued by Bloomberg have either gone under or agreed to his terms. Wallace has held the line at great personal cost.

It is up to you if you wish to financially support his defense. However, his fight is exceptionally important to anyone who believes in the right of people to keep and bear arms.

I support AO

I've supported Jay and his fight with Bloomberg. I've posted in several forums about the store and it's plight. And I've made it a point to purchase all my guns and ammo at AO. I've recommended to others that they purchase from AO as well.

It really is an easy decision. AO has the largest inventory and the greatest prices, in North Georgia.

Bloomberg and his employees need to prosecuted for lying of federal forms AND for conspiracy. Maybe even the RICO act could be drawn out against them.
 
I too have bought several firearms at adventure outdoors and i can't see how they got a "straw purchase" by the employees there .i was checked no less than 3 times when i filled out the 4473 and had my id checked also 3 times.Bloomberg is a rich man and wants to have things his way or no way .I recently had to travel to NYC (not by choice) and I couldn't wait to get out of there,there was signs prohibiting just about anything a person would do.Also there were Police armed with MP5'S and M16'S on the streets standing around.It is like a police state up there Bloomberg beleives there is no need to have a gun by private citizens.
 
I support their cause 100%! I'm going to help spread the word, as well as donate some $$$ when I have it to spare.

This is...BIG. Very big. I just look at it this way - if AO goes under and surrenders like all the other stores that the "Tin God of NYC" has targeted? Since the authorities aren't gonna touch him, despite the laws HE'S broken...

What's to stop Bloomberg from going after YOUR local store next??????

What's to stop ANOTHER anti-gunner with money and "connections" from pulling the same crap????

I just found out about this. I was going to buy a gun from AO this Memorial Day, but they're closed May 25th to June 2nd. They're in NYC, and have closed the store to go! I'll wait until they get back to make my purchase.
 
Bump this one back to the top. Mods I vote for a pin on this. I'm gonna link this thread on my own gun forums. Bloomberg is guitly of treazon anyway and at the minimum should be REMOVED from office by force. In addition more appropriately he should probably be hung.
 
I vote that this be pinned AFTER it is thoroughly checked out by an Administrator FIRST.

There ought to be a way to get a hold of Adventure Outdoors and find out if there truly is someone using our board for help.
 
Folks, I am a customer of Adventure Outoors. These folks are legit and are fighting the good fight, and on our behalf. It is a matter of principle. They could have settled out and availed themselves to a special master a thousand miles away as the other shops did, but decided to hold their ground and draw a line in the sand. Their fight will cost them hundreds of thousands of dollars. The precedent that Bloomberg is trying to set would allow any politician with an ax to grind, or looking to make a name for himself, to send his agents into another state and entrap law abidding citizens. While the NRA may be offering vocal support they are being shortsighted in only offering $1000 to help. They are greatly underestimating what this battle is about. This truly is a David and Goliath battle, and you or your gun shop may be the next David.

Every time I go into Adventure Outdoors I donate anywhere from $5 to $20 in the can at the cash register, and it has added up. I'll be there tomorrow (if they are back from NY and open again) and I'll put my money where my mouth is.

This isn't just about some gun shop in Georgia. It is a grave threat to your Second Amendment rights and about the persecution of a law abiding business who has followed the law verbatim but fallen prey to individuals with warped values and morals. They have stood their ground and I will not let them do so without my continued support.
 
I'm certainly no lawyer but isn't it entrapment to send someone in to try and break the law and see if anyone will bite?
 
According to a spokesman for one of GA's U.S. Senators, bloombergs actions were brought before the authorities and, it would appear, that they could not prosecute because the final (illegal) transfer was not completed by his goons.

But just because you did not complete a criminal act, does not mean you are not guilty for trying it. IMHO.
 
So if he isn't being prosecuted because the final illegal transfer was not completed, why is the gun shop? I hate these legal things, they get me all worked up and confused!
 
This thread is worthy of my first post on this forum.

As an Adventure Outdoors customer, I can say that each time I bought a firearm from them, they followed the law to the letter, maybe even going above and beyond.

As a supporter of the Constitution and the Second Amendment, I can say that what Bloomburg is doing is like rust in the barrel of your favorite firearm. If you don't stop it now, its destruction will spread beyond repair.

I don't know if the web site is legit or not, but I do know that the Wallace family is spending a lot of time and money to fight this menace that could affect us all.
 
FYI, I exchanged emails with AO yesterday and their doors open back up this morning, June 2nd. Last week I went there to buy a rifle and found a sign out front saying they would be back open today. I delayed my purchase and will make it today or tomorrow.

BTW, this is truly a great shop. It is the most professional staff (folks) that I have run across in nearly thirty years of shooting. They run a tight ship. I deal with some other gun shops in North Georgia, but AO will always have my business first.
 
Since I don't live in Georgia and can't give them any firearms or ammo purchase business, I made a donation yesterday online to what is a worthy cause. I hope everyone else who feels the same way can vote with their wallet one way or another to support AO.
 
Boomberg and Toronto's Miller

Interesting that Bloombergs name comes up everytime there is an attempt to thwart individuals and firearms possession. Miller in Toronto mentions him along with the Brady Coalition. Just a wild guess, does Billionaire George Soros who funds OSI which funds the Million Mothers March and The Coalition for Gun Control, have dealings ie holdings ,business with any of Bloombergs businesses. Things do go full circle. The woman that was part of the Australian demise re controls is now a director for OSI. Here in Ontario the coalition for gun controls director Wendy Cukier gave funds for Millers election campain. Some how she got standing as a representative for Mexico at the United Nations re small arms control. Her name, Cukier seems always around when there is an insult thrown at the NRA.
 
That reminds me: I thought the firearms manufacturers were supposed to get involved in anti-gun battles. If they're actually doing so, IMO this would be the perfect time for them to step up to the plate.
 
Until I quit the rep business a few years ago, I was a rep that called on AO. Jay Wallace and Company are legit. (Even if Jay is one of those damned Bama fans. Being from Ga., go figure) They are good folks and I appreciate the stand they are taking. Having said that, ( and maybe I missed it in an earlier post) what have you guys done insofar as asking some of the factories for help? I can think of at least one handgun factory and one safe company that ought to step up to the plate for you.

New York -- Smyrna gun shop owner Jay Wallace ended his current courtroom fight against a New York City lawsuit on Monday, saying that the trial was unfair and he accepted a judgment against him so he could appeal to a higher court.

"I wasn't getting a fair shake here in this court, so why should I continue?" Wallace said after the morning's legal action.

New York Mayor Michael Bloomberg called the judgment a victory, but Wallace said his defense against accusations that he mishandled gun sales is far from over.

"David is still fighting Goliath," he said.

Wallace's Adventure Outdoors in Smyrna was one of more than two dozen gun shops named in federal lawsuits brought by New York City in 2006. The city accused dealers of sales practices leading to illegal guns being used in Big Apple crimes.

Most of the shops settled, agreeing to have their businesses monitored, but Wallace chose to go to trial and filed a $400 million countersuit accusing Bloomberg of libel.

On Monday, Bloomberg called the default judgment "as good as a win at trial."

"Today's decision by Mr. Wallace to surrender his opportunity to defend his case at trial paves the way for the court to appoint a monitor of Adventure Outdoors," Bloomberg said in a statement. "We have always said that we have no interest in bankrupting gun dealers, only in ensuring that they follow federal laws."

Jury selection in Wallace's trial began last week. Opening arguments in the Brooklyn court had been planned for Tuesday. Wallace's attorneys said they sought the default judgment and a move to an appeals court because U.S. District Judge Jack Weinstein decided to appoint an "advisory jury" that would leave the verdict up to the judge.

"The court has already made some rulings in this case that clearly indicate its opinion," attorney John Renzulli said.

Wallace's attorneys said they want an appeals court to consider jurisdictional issues about why a Georgia gun shop owner is being tried in New York.

Wallace said that it would have cost hundreds of thousands of dollars to "go through with this trial and end up with the same result that we made here today."

He also said the trial was unfair because the judge had ruled that Bloomberg would not be allowed to testify.

"I'm not allowed to face my accuser," he said.

Weinstein had said the mayor's appearance would have been an unneeded distraction, turning the trial into a "media show."

An excellent question. If there were a crime in the actual sale of the firearms that ended up in NYC, it would have been committed in GA, necessitating a trial there. Thats IF it were to remain something other than a federal case. But illegal sale of guns in this manner is a Federal Crime, and therefore a criminal case to be tried in Federal court. This would be held in whatever District court GA is in.

The whole thing should have been flagged down by the Justice Department the moment it went into NYC court. Where the hell is the AG's office?!!?

Maybe I just don't have the understanding of the legal system that is required to CYA as NYC mayor.

Bloomberg relied on a civil nuisance action instead of going with a criminal action. I would imagine this was in an attempt to get around jurisdictional issues. I think that AO's move here was actually quite wise. They've done the discovery and have been able to acertain their risk and have now bypassed the expense of a full trial and can bring the main issue, jurisdiction, to the Court of Appeals and beyond. If they win on the issue of jurisdiction then there will be no remand to the trial court, and except for further appeal it's "game over". AO has just "danced a little sidestep".
