Did alot of research can't get clear answers. Just two simple questions:

Are there any restrictions to a resident purchasing a shotgun in NY state?

It there any restriction to a non resident flying into an airport with a shotgun. For the purpose of competition.

I'd greatly prefer a handgun, and my license is honored at my destination. But, I understand that NY state will arrest any travelers despite a federal law protecting that traveler.

What say you..??
 
I lived in upstate NY for a couple years. Flying into an airport with a long gun is not a big deal. The big thing to remember is that NY still has the AWB laws on the book. If your shotgun is semi auto then you may not have a detachable magazine, or a pistol grip, or collapsible stock.

Pump action is fine. No restrictions.
 
NYS residents can purchase shotguns/rifles with a driver's license and NICS check. Out of state handguns are prohibited unless you are going to a bonafide NRA or college shoot and can prove it. So essentially, my buddy from Pennsylvania cannot drive out to my farm in NYS and bring his handgun for an afternoon of plinking, despite the fact that he is licensed in PA; in fact, he cannot even borrow my handgun. Public ranges usually ask for ID prior to admitting you to their range. As I understand it, an unloaded and cased handgun can be carried in the locked trunk of your car if you're transiting the state.
 
Actually thats not quite right Joe. For a shotgun to be an "assault weapon" it has to meet the following criteria:

22. "Assault weapon" means (a) a semiautomatic rifle that has an
ability to accept a detachable magazine and has at least two of the
following characteristics:
(i) a folding or telescoping stock;
(ii) a pistol grip that protrudes conspicuously beneath the action of
the weapon;
(iii) a bayonet mount;
(iv) a flash suppressor or threaded barrel designed to accommodate a
flash suppressor;
(v) a grenade launcher; or
(b) a semiautomatic shotgun that has at least two of the following
characteristics:
(i) a folding or telescoping stock;
(ii) a pistol grip that protrudes conspicuously beneath the action of
the weapon;
(iii) a fixed magazine capacity in excess of five rounds;
(iv) an ability to accept a detachable magazine; or
(c) a semiautomatic pistol that has an ability to accept a detachable
magazine and has at least two of the following characteristics:
(i) an ammunition magazine that attaches to the pistol outside of the
pistol grip;
(ii) a threaded barrel capable of accepting a barrel extender, flash
suppressor, forward handgrip, or silencer;
(iii) a shroud that is attached to, or partially or completely
encircles, the barrel and that permits the shooter to hold the firearm
with the nontrigger hand without being burned;
(iv) a manufactured weight of fifty ounces or more when the pistol is
unloaded;
(v) a semiautomatic version of an automatic rifle, shotgun or firearm;
or

Thats New York State Penal Law 265.00.22 where assault weapon is defined.
You'll notice that to be classified as an "assaut weapon" a shotgun needs two or more of the criteria. Meaning if I have a 12 guage that is semi automatic and accepts a detachable magazine it isnt an assault weapon, not until i put a pistol grip or a telescoping stock on it. The fixed capacity wouldnt serve against it because obviously the capacity isnt fixed.

What Im trying to drive home here, is that the Saiga 12 and the like can be legal in New York. SemiAuto, detachable magazine, but not pistol grip and no telescoping stock. Its not just all semi autos cant have these.

As far as airports I have no idea. I would think an FFL transfer would be the safest route.
 
Lots of New Yorkers put thumbhole stocks on their Saiga 12s.

At any rate, check the city you're traveling to. The actual city of Rochester, for instance has a ban on pistol grip only shotguns.
 
Upstate, you are GTG, as noted above.

DO bear in mind that JFK & LaGuardia are both in NYC, which is a whole nuther ball of wax.
 
I find it's best just to avoid NY and Cali. By the way I've seen people spell Cali and California Kali and California why is that?
 
I'm from upstate Ny near Syracuse ( scary place ) a little town called Canastota. I wish I could help but, Idk much about the gun laws. I never saw a gun that fired anything other than bb's until I moved to Florida.
 
FWIW, I'm LEO and flew into Buffalo with a handgun. Wore it concealed the whole time I was there. When I flew out, I obviously had to check it with the airlines. I didn't hear a word about it.

I can't imagine a shotgun being any worse, especially if you are not going to NYC.
 
Don't forget, Sobel, Canastota is the home of the Boxing Hall of Fame. If ya can't shoot 'em, you can pound the crap out of 'em.
 
OK. Got it. Long gun ok, handgun not ok. Even if I'm just passing through the state with no overnight stops.

So to sum it up, I am traveling from a place where it is legal to possess, transiting through the state of NY, to a place where it is legal to possess. This is legal IAW federal law but I will be arrested anyway and be forced to defend myself to the point of bankruptcy using existing, established federal law as a defence. :what:

Easy to see who's behind that. NY State defence attorneys. I wonder how much of those fees get kicked back to the elected officials? :neener:

I'm starting to believe that any elected official that votes for, or introduces a bill that is in direct opposition to the constitution should be charged with, and tried for treason. Furthermore, any LEO that enforces any blantantly unconstitutional law should be charged and tried for the same. Just my opinion folks.

I realize that folks are just trying to make a living, and 90% of LEO are good people trying to do a job. But "I was doing my job" wasn't an acceptable defence at Nurembourg either. And yes, I do understand what a tough choice that is. I had a family too, so yes, I know how hard it is to make a stand, and sometimes you have to pick your battles. But, you have to look at yourself in the mirror too.

Jeez New Yorkers, the 2nd is incorporated into your states own constitution, Vote the SOB's out. You gotta do this, the rest of the country cant do it for you.
