There is currently a 60-day countdown that began 6/28/2010. At the end of this period both sides will have an opportunity to file motions for summary judgement with Judge England.

Sacramento County tried to muddy the waters be demanding proof of standing (i.e., are the plaintiffs legally allowed to file this lawsuit). Since the plaintiffs are all U.S. citizens and residents of California, this was only a delaying action, since the judge will almost assuredly accept plaintiffs' standing.

In a slightly different case, the 9th Circuit en banc remanded Nordyke back to the same 3 judge panel which originally ruled in favor of incorporation (following that decision, the 9th Circuit vacated the holding and ordered the matter heard en banc... the en banc panel heard oral argument prior to McDonald but decided not to decide, putting the case on hold, pending a decision in McDonald.)
