Cop hears you in bathroom?

What if the call of nature came and you needed to rush to to the nearest bathroom in the movie theatre. You walk into the bathroom and you take off your concealed weapon and hang it. Once you are done you realize that your line of defense doesn't have a bullet in the chamber, so you proceed to pull the slide back making a bullet go into the chamer. While you were doing this there was a Police Officer washing his hands. He heard this and wonders what is going on. You walk out, already concealing your weapon, to be interrogated by the officer. "What were you doing in there?!?" etc.

Is it right or wrong what you did? Do you need to answer to the officer? Will you get arrested?

Though you made "noise"(slide going back), you never displayed this.
 
Explain that you have a CCW and what you were doing.

Seems like some cops often go trying to get people fines for whatever they can, especially people who exercise their 2nd amendment rights.

But, if your legally carrying, he cant do anything, right?
 
I personally think that this fails the "reasonable person" test. If I (as a gun owner w/CHL) heard a slide being racked in a public rest room, alarm bells would immediately be going off in my head, and I think an officer _should_ ask some follow up questions of the individual.

The dangerous thing is that an officer may feel like the slide rack is for HIM/HER, so you might find yourself looking down the barrel of a gun when you come out of your stall.

If you discover that you've left a round unchambered (and that is not your normal condition), find a much more discreet place to fix that problem.

As for being arrested-- I think I'd have a hard time trying to justify someone who found themselves in that situation.

Is uh, this the voice of experience? If you...uh, had a friend that this happened to, it sounds like "he" was really lucky. ;)
 
You've already made two errors- first, you didn't have one in the chamber in the first place. Second, you weren't even aware enough to know someone was in the rest room when you racked the slide.
 
I would never chamber a round if I thought there was anyone else in the bathroom. That is going to to put anyone's alarm off.
 
Never mind a cop - if I, as a lawful CCW carrier, hear a slide being racked in a stall in a restroom, my constipation will be a thing of the past! :eek:
 
improbable or not, i still enjoyed reading it! Very creative situation, i agree with the "don't worry about it until you get home or in the car" idea.

Unless you are in a 1 man restroom at 9:30 on a friday night in the west end of detroit, i'd hold off on that round :)
 
all these 'what if' scenarios......

a better 'what if' for this particular topic would be "you are using the facilities at a public bathroom and decide to do some dryfire practice. although you checked the stalls quickly you didnt notice that someone was still in one of them. you are racking your slide, pulling the trgger, then you hear 'baaaawhooosh!' and someone stumbling out of hte stall at the end. do you try to explain yourself before they run outside and call the police?'
 
This is a perfect example why all legally armed people should carry a CCW Badge. Just flash your CCW badge to the officer, give a wink and a nod and you'll be on your way.







Just kidding.

Really, there should be no reason to take your handgun out of it's holster while you are in a public restroom. And there should be no reason to put your handgun in your holster not in the correct condition with a round chambered before you leave the house.

This did not happen to me, it just occured to me to post the question to see what all of you had to say. I am not as experienced as some of you here are, so therefore I decided to bring the question here.
 
Gee, not really familiar with this overall situation. Usually, long before this point, everyone has hurriedly exited muttering something about "courtesy flush". What is that anyway?

That is a major error in my opinion. I assume by "hang it" you are talking about hanging it on the hook on the door? Thieves have been known to reach over the door and steal things that were hanging.

I think losing physical control of your weapon is a really bad idea.

I also think leaving the house without a round chambered is dumb. Why would you ever do that? I mean its not that hard to remember to chamber a round is it? If it is, maybe you need to consider the bigger issue of whether you should even carry a gun.

Finally, chambering a round in a public place is a really really bad idea. You pretty much are going to scare the hell out of anyone else in the bathroom, and if anyone else in the bathroom has a gun on them, you may find them pointed at you when you open the door.

I don't mean to be harsh, but I think this situation involves making three major errors. If this has ever happened to you, I think you need to revisit the idea of carrying a weapon in the first place.
