Good to hear this got cleared up but still sorry that a bureaucrat simply did the bureaucratic thing and moved on without bothering to do some legwork.

Usually misdemeanors don't go on for 10 years as active cases... usually in this case means about 99.9964%. You'd figure a judge would know that.

As for sealing juvenile records? That's a fallacy as well as sealing your adult records, or expunging records. It's always there, just depends on who can see it. Any governmental background will disclose its existence in CA. It only means you don't have to talk about it with private employers or on regular background forms.

State of GA just did the same thing to my little brother. He is 31yrs old now...

His permit got disapproved. I told him not to worry it was just a clerical error somewhere and he needed to file an appeal. I also told him he needed to call the clerk of court and ask what the problem was with his application.... They were happy to help him.

Basically he had some relitivley minor (typical kid stuff) charges from over 10yrs ago when he still lived in NC. The state of NC didn't file the disposition of those cases properly, so they appeared to still be unresolved to the state of GA...

He had to do a little leg work for the clerk of court by calling his old lawyer from NC and getting some paperwork faxed up. Once he arrived for his appeal date with the judge, everything got cleared up in a matter of seconds and he left the court house with his permit.

Stuff happens. Files get misplaced or mis filed ect. States don't talk to each other very well sometimes... Most of the time if you act like an adult and use your head you can clear things up easily enough.

this is a good example of those records being incomplete. as annoying as it was in this case they are just as inaccurate with leaving stuff out that should be on there. in some ways that can be worse. if you run a check and don't find out about some important transgression in someones past.often the folks are inputing tons of data and some are less than concientous.

In PA the judges have at their discression the ability to convict first time DUIs with up to 24 months in prison as a maximum (yes I have seen several first hand working in law enforcement over the years). Keep in mind that this doesnt happen very often at all, but it still does none the less.
A background check for law enforcement goes back to your birth, with no gaps with references for all of it, if you have periods of time unemployed, not taking school, or whatever they ask for references in addition. In the case of a CCL the gaps are not important, but they go back to birth. I dont know the exact policies they use in each county for determining your ability to get a CCL, but they usually dont use DUI against them unless it was convicted as a felony with 2 years in prison as a maximum. I think domestic violence of any type is used as a determining factor, its specifically listed.
Worse yet, this friend of mine had to appear in court for a guy who tried to hire a hitman to kill him, none the less this guy is in state prison for the next 18 years now and this was the period of time my friend found out he couldnt get the CCL.

if they are doing a check on you to see if they are going to give it to you. if the see any thing there first reaction is to deny you and see where you take it . is your state a can issue or a shall issue state. if i was you even thou you have worked this out i would go and have the threat charge removed at least the aresset. it is a pain in the butt but at the end of it you can say you have never been arrested . we had to do it for my friend to get his permit.

Only federal judges can seal records

your juvi record is not automatically sealed; nor is it erased. EVER. Common misconception

Terroristic threats charge is your problem

2 DUIs in GA = felony. 1 is not.

Your job is not a factor when the judge decides whether to give you a permit or not.

NICS does not take into account local charges/arrests. Only major convictions.

Glad you got it worked out

Several years ago I applied for mine at the same time a friend (who owns a gun shop) applied for his.
Got mine in less than a month. His was delayed for whatever reason although his paper work, FFL and such was already on the books.
Maybe just the fact your in the books can slow things down.
Remember we are talking about government.
