GRNC Update 08-28-03:
Reciprocity with South Carolina Now Effective!

GRNC has worked tirelessly for this day and we are proud to have been the lead group in securing the current reciprocity law.

In addition to the 14 states listed previously, reciprocity is now in force with South Carolina. The following Teletype message was issued to all SC law enforcement agencies,

“EFFECTIVE AT 1308 HRS. 08/25/03 SOUTH CAROLINA AND NORTH CAROLINA ESTABLISHED RECIPROCITY FOR HOLDERS OF CONCEALABLE WEAPONS PERMITS (CWP). PURSUANT TO SOUTH CAROLINA CODE SECTION 23-31-215 (N), RESIDENTS OF NORTH CAROLINA WHO POSSESS NORTH CAROLINA CWP ARE NOW ENTITLED TO CARRY A FIREARM CONCEALED WHILE IN SOUTH CAROLINA. NORTH CAROLINA PERMITTEES ARE SUBJECT TO ALL RESTRICTIONS IN SOUTH CAROLINA LAW, INCLUDING PROHIBITED CARRY LOCATIONS, USE OF DEADLY FORCE, SELF DEFENSE AND ALL OTHER REQUIREMENTS OF SOUTH CAROLINA FIREARMS LAWS. INFORMATION CONCERNING SOUTH CAROLINA LAW GOVERNING USE OF DEADLY FORCE, SELF DEFENSE AND OTHER RELEVANT FIREARMS LAWS WILL BE POSTED ON THE SLED INTERNET SITE AT WWW.SLED.STATE.SC.US FOR OUT-OF-STATE RESIDENTS TO REVIEW.

The process for attaining this goal was more complicated than with other states due to an “equal or greater†clause in SC’s reciprocity law. To quote SC Attorney General Henry McMaster in a letter to Representative William Sandifer, “Accordingly the issue raised by your letter is whether South Carolina would grant ‘the same right’ regarding the right to carry a concealable weapon to North Carolina residents by honoring their North Carolina gun permit. This, of course, would depend upon whether South Carolina determines that North Carolina's concealed weapons law imposes standards ‘equal to or greater’ than those of this State.â€

Thanks to the prompting by members of GRNC and GRSC, Rep. Sandifer contacted AG McMaster. Mr. McMaster in turn, while noting that SC State Law Enforcement Division (SLED) had the final say, issued a letter detailing the similarities of the laws in the two states and stating that, “It is our opinion, based upon an examination of North Carolina law and applying the foregoing standard, that a court would likely conclude that North Carolina's concealed weapons law is substantially similar to the South Carolina statute.†This doubtlessly carried some weight in SLED’s decision-making process. Thanks go to Rep. Sandifer and AG McMaster in this matter.

This is the kind of language GRNC worked hard to avoid in our reciprocity law. Had this been the case, such delays could have been expected with every state as the NC attorney general’s office compared that state’s law with ours. Thanks to the hard work of our membership a much better law was passed and now your permit is valid in 15 states outside of NC!

Thanks to the prompting by members of GRNC and GRSC, Rep. Sandifer contacted AG McMaster.
I hate to beat a dead horse, but this simply is not the case.

The truth is NRA and its SC state affiliate Gun Owners of South Carolina contacted Rep. Sandifer personally and he agreed to request an opinion. Prior to our contact he was unaware of the issue. Anyone who doubts this is free to call him and ask.
