You need to take some classes and talk to an attorney.
I'll say it, and the cops in here will back me up, the last person you should ask about legal distinctions is a cop. If you ask four cops, you will get four different answers. If you are a lawyer, and you need advice about this subject, and it's not your area of specialty, you need to talk to another lawyer who DOES have specific knowledge. You being a.....security officer impresses me even less. You are trained to protect your company's assets, not enforce the law.
And yes, I have consulted an attorney whom I will immediately call if something bad happens.
I'll repeat this because you obviously don't get it. If the D.A. doesn't buy your story, or is trying to make a name for himself, and he presents the case to a judge who has a grudge for any reason you can imagine, it will be in front of a jury anyway. Stand your ground law, castle doctrine, whatever. Even if it's a B.S. charge, even if chance of conviction is low and success of appeal is certain, your life is changed forever. Do YOU want to be the test case? I don't.
