You need to take some classes and talk to an attorney.

I'll say it, and the cops in here will back me up, the last person you should ask about legal distinctions is a cop. If you ask four cops, you will get four different answers. If you are a lawyer, and you need advice about this subject, and it's not your area of specialty, you need to talk to another lawyer who DOES have specific knowledge. You being a.....security officer impresses me even less. You are trained to protect your company's assets, not enforce the law.

And yes, I have consulted an attorney whom I will immediately call if something bad happens.

I'll repeat this because you obviously don't get it. If the D.A. doesn't buy your story, or is trying to make a name for himself, and he presents the case to a judge who has a grudge for any reason you can imagine, it will be in front of a jury anyway. Stand your ground law, castle doctrine, whatever. Even if it's a B.S. charge, even if chance of conviction is low and success of appeal is certain, your life is changed forever. Do YOU want to be the test case? I don't.

That cop is giving you CRIMINAL advice.

like i said used to be a security guard,but it wasnt for company assets,it was to protect people in bad neighborhoods,i was who they notified ,along with the police when panic systems where activated,i was on the "ghetto projects",and was a protective service for the residents and was a state subcontract because most of the time what happened there was well over with before the local police could get there,every familly dwelling had built in panic system that notified police of the address,and notify the protective officers at the same time to a digital paging notifier.so dont assume what i did with out asking

and yes i do get it,have gotten it for years.


and i bet my house and my gun collection that you havnt contacted a attorney,and told them i want you on standby incase i have this kind of situation happens.

any d a or prosecuter can change the outcome of any shooting or self defense shooting,but if you know you did it because there was a threat then you have nothing to worry about.but when there is someone at your domain and you have your children and wife there and there is some one in your bushes and they are not responding to your request to leave or identify and its 3 o clock in the morning and there is common home invasions,raping,and driveway shootings in your neighborhood,and you feel scared ,threatened,are you going to get down close to those bushes and ask him to plaese leave,or are you going to go outside to a unknown person waving a gun threatening him with it,are you going to be thinking about the d a or prosecuter,and you can see him hiding something that he just pulled out of his pocket.i hope not because if he is there to commit a crime and brought a weapon he probably intends to use it to help commit the crime,or use it to keep from being identified by you when the police get there.hell he could shoot you and your family and be 10 miles away before the police get there,and especially shoot you if you come out there with a gun or say you have a gun,because to him hes there to commit a crime.

so now you get it?or better yet maybe you dont get it.you do what you feel you need to do in a defense situation,and will will probably be the right thing.and i will do what i feel i need to do,and it will be the right thing.


you cant make assumptions and you cant predict the outcome of anydecision that comes from some one else.and if i shoot someone defending myself and my familiy because they were in fear of there life or me mine and i go to jail because a da or prosecuter was trying to make a name for them selfs or at random chose my case to make a example,then so be it i go to jail.as long as i know and my family knows it was right and without my decision they could have been hurt .then whatever happens to me because of it is water under the bridge.at least my family is safe i did my job.

are you man enough to risk cosequences to yourself like jail time to protect your family?or when your family is in danger are you the kind of person who more worried about going to jail for killing a crackhead who was creeping around the outside of your house peeking in windows and hiding in bushes?
from what i can tell you are the kind more worried about making a sacrifice or a mans decision to defend your children and wife and all that you have.

im not a idiot i know when something is a threat and when something is not.ive seen it happen to many times right in front of my eyes and and had it happen to me to releize when im in danger and when im not and also seen things flip from tranquil to chaos.hell ive even been shot at inside a apartmant almost at pointblank range by a crackhead heroin junky with a 12 guage,when we were called to a apartment building over arguing,the guy was standing there calm as could be and then when he found out the we were staying there and going to detain till police got there he reached behind a dresser pulled out a 12 guage ,i lunged forward grabbed barrel and he stated shoting ,the end of the barrel got caught on my shirt as i was pushing away and the 12 guage slug went through my shirt missing me by 3 in,he squeezed off 2 rounds before i got it away and ko him with it

so leave your personal assumptions about people you dont know to yourself and recite them while you are sitting on your toilet reading through your newspaper
 
It depends on your local laws. In WA, I think it's allowed, if you reasonably think you're in danger (i.e. they're shooting from the outside, or they're breaking your door, etc).
 
As stated in the previous posts, Florida has laws in place (castle doctrine) to protect homeowners/car owners in life threating situations where they can use force to protect themselves. Shooting from a window into your yard would probably depend on the situation (Perp has a gun aiming it at you inside the house) at hand.

Not too long ago a local radio station in Florida played a 911 call of a houshold resident who had an intruder banging on his sliding glass door in the middle of the night(probably on drugs). All of this was recorded by the wife who was on the phone with the police dispatcher. You can hear the husband clearly yell at the BG stating he has a gun and will shoot him if he enters the house while all along hearing the banging on the glass. Next thing you know you hear glass shattering, the wife screaming "he's breaking in he's breaking in, he's inside our house he's inside our house,and a gun blast. Needless to say the homeowner covered his butt in this situation.

You never know what type of situation you might be.It's good to know your statel laws and how to protect your family/yourself from the badguy's and afterward from the lawyers.

You're not a cop or a lawyer. You are ok with going to jail as long as you are alive. I'm not. I have no need to measure genitalia with imaginary people on the internet. I don't understand why you think it's so unlikely that I, or anyone else in here has consulted with an attorney in advance. I not only have done so, I have insured that my umbrella insurance coverage will cover his fee, and I'm making plans to intern with him while I am in law school.

You are in Texas, which is unique in the nation for its laws in using deadly force to defend property. Joe Horn didn't get indicted, 50% because he said exactly the correct things in the 911 call, and 50% because of luck. It barely worked for him, and if you really think you are that smart, try it and see what happens.
