The murder tally in Philadelphia is at 106 or so for 2007. Last year topped 500.

According to the 22-year-old male resident, minutes after 11 p.m., two men confronted him outside his home in the 1900 block of Elston Street and forced him inside at gunpoint, demanding money, police said.

Inside, the resident produced a handgun of his own and exchanged gunfire, Lt. Philip Riehl said.

One alleged home invader, 22, died after being taken to Albert Einstein Medical Center.

As the other man fled, the resident apparently kept firing from an upstairs window, Riehl said.

The wounded resident was treated and released at Einstein, but remained in police custody this morning pending further investigation and possible charges.

What?

The murder tally in Philadelphia is at 106 or so for 2007. Last year topped 500.

Maybe I missed something, but a criminal killed while commiting a crime is not a "murder victim".

I am going to get a bucket and put it beside my computer... I have had to buy 5 new keyboards because in reading some of these kind of threads, I just started vomiting...

How can the poor guy get charged? The police did nothing to stop these criminals. This citizen did. One of them, at least, will never hurt anyone again. He should get a medal.
 
+1 jerkface, I'm a big fan of felony murder laws. Don't associate with criminals, especially those who are violent - it's great disincentive for the less serious crooks to link up.

There are several possibilities here. Maybe everything happen the way the 22-year-old resident said it did. Or maybe nothing happen the way he said. It is fairly common for the police to show up at a shooting with a body and the survivor claims self defense, that the dead guy is a stranger who attached him. The police sometimes find out the shooter and the dead guy knew each other, were drug dealing partners, or any other possibilities. So the police have learned to hold the shooter until they can check out his story (the “…remained in police custody this morning pending further investigation and possible charges.” Statement from the original story.)

That's going to get/keep him in hot water.
+1. If this last part is true and the shooter DOESN’T get charged for it, it will be a hell of a win for self defense rights and the RKBA.
 
It's very unfortunate that he kept shooting from the window. It's understandable, but bad judgement on his part.

He messed up a perfect shoot and now he will probably be charged with a felony and lose his guns forever.

Shots ripped through the West Oak Lane section of the city late Wednesday night, claiming the life of another Philadelphia man during what one of the shooter's called a home invasion.

Police did not release the deceased victim's name but said the 23-year-old was pronounced dead after a shootout inside a home on the 1900 block of Elston Street.

A resident there told police he was on the street when two people forced him into his house by gunpoint, according to police. The resident, who police did not identify, said he grabbed his own gun and started shooting back, fatally hitting on person before the second alleged home invader ran off.

The 23-year-old resident was shot in the arm and the leg and treated and released from a local hospital, but was being held by police pending possible charges, an officer said. The resident could face gun and drug charges, authorities added.
