I Have A Rent Legal Question

I thank you for the link. But that page doesnt say anything about a landlord NOT giving you a lease to sign.
What's the real story? Twice prior to this post you wrote that you didn't sign the lease because you knew you would be leaving. Now you say he never gave you a lease to sign. You can't have it both ways.
 
Hey I wouldn't mind paying the man what I owe him. But when I come home and find my guns loaded or mags in them that I DIDN'T PUT there and the damn TV on that I always turn off when I leave (sounds like he heard me coming and got out f the apt quick!) I could give a damn what he deserves. I know it sounds really bad. But it makes me sick and feeling utter violated to have a stranger in your place doing God knows what.

Im moving out tomorrow and not telling him. I also tried for him to fix the deadbolt but he never did. I was left with a flimsy door knob lock. Its a shame because this apartment was really really nice.

Oh well. If he wants to pay 1-2,000 for a lawyer to get $300 let him. I'll pay it then. But he deserves to learn a lesson not to go into peoples home (even if he does own the place) w/o notice.

Also, the reason I never signed a lease becuase he kept telling me "My printer is broke, just give me a while" So i didnt press the issue anymore becuas ei knew I was going to leave after I knew what he was doing in my house.

but I am a landlord in Kansas. Here if you took "possession" of the property by accepting a key or moving in your stuff in the absence of a written lease you have just created a month to month lease or are in whats called adverse possession. Also note, here because you have not paid rent and have no written lease he can evict you with only three days notice to move. After that you create a whole different set of problems that can cost you a lot of money in court in an eviction proceeding. Also in Kansas, if you get evicted or move out and leave something behind the landlord can hold your stuff that you left until you pay what you owe AND charge you storage fees for storing your property safely. If you move take it all at once.

yeah this is all true here also, but once the landlord enters illegally etc, he gives up his right.
the thing i have also seen here is the landlord keeps the stuff, or throws it away. i knew an idiot who wanted to pay the 15/day to the landlord, but stuff was already gone, lost cause trying to get $$ from landlord for throwing stuff out.

ALSO= worst possibility you get evicted, atay, and FIGHT it . for the way landlord is acting, you'd probably win, or at least get him to settle.

i had friends who couldnt get landlord to fix anything. they stop paying rent. he tries to evict. 10 MOnths later, i help them move out , they settled with landlord= they moved, owed him zero. rent was 1800. heheh.

it's best to avoid the whole procedure, but what im saying is don't just accept it, if you get slapped with an eviction paper, fight it.

landlord here has to give 24 hr written notice to enter.

MAN the advantage of a good rent board. 4 times a year they send us all the info s oeveryone is aware of laws, landlords don't play games. (much)
 
In real estate law, oral contracts aren't binding if it involves the SALE of property. People rent apartments with oral agreements all the time, and they are classified as month-to-month occupancy. An oral offer to buy or sell property is not binding however, if I recollect properly, the deal must be sealed in writing.

M4A3, I urge you to call the police the next time you suspect the landlord enters your apartment without proper authorization. It could possibly help to establish a pattern of illegal behavior by your landlord who may be naive enough to actually admit to it if questioned by the police. If he doesn't, it will at least put him on notice to stop entering without a valid reason while you're still living there.
