So I saw this on site in part because of the 4th amendment issues around the case. The title to this thread, is in part at about 5:05-5:30, a cop has him at gunpoint orders him out to him. He stops, reaches for his cell phone on his belt. Can someone explain to me WHY you would reach for your cell phone while at gunpoint in front of an officer?

i cannot for the life of me think of a good reason. You are not making a call, you are not answering it, the cop does not want to see it. Unless you are dumb or screwing with the cop WHY would you do that?
 
wow, i would never think to reach for anything but the sky...... this guy is not the sharpest tool in the shed.... but he is a tool none the less..........
 
He may have been:

1. Calling a lawyer.
2. Trying to record the encounter. Where lawful to do so, it's an EXCEPTIONALLY wise thing to record all law enforcement encounters. It's also EXCEPTIONALLY UNwise to do so in ways that put you in danger. You need to start your voice recording device, either before an encounter, or in such a way that it's not reasonably perceived as potentially threatening.

I carry a combined mp3 player and voice recorder EVERY time I leave the house armed. I carry it away from my firearm and in a way which allows me to activate it without appearing to reach for a weapon. When I'm out walking for exercise, I typically just start it and leave it on, recording.

In addition, I'm planning to purchase a digital wristwatch with a built-in voice recorder. That way I have both a surreptitious and nonthreatening way of recording police and other encounters, and a backup for my other more obvious voice recorder.
 
I watched a video about this in another thread. The cops stepped way over their authority and when you have officers pointing AR's at you when you have done nothing illegal (unless he was shooting in an unsafe direction, but he probably wasn't from the circumstances discussed in the other video) wanting evidence of what is going on is perfectly logical. However, I wouldn't be reaching for my phone...

In his defense though, he did yell "cell phone" loudly multiple times.
 
It is insane...

Not the Cell Phone faux pas...but, the manner in which the Police insisted to make a legal harmless situation into absurd interpolations and abuse.

What has happened to the minds of those Police to be doing things like that?
 
Cops were WAY over the line. But, he was probably stupid for reaching for his cell phone. Having said that I can't imagine what can be done to help him. It is a sad day in America when target shooting on your property can be turned into 3 felonies, but that appears to be where we are now. May be it is time for some more aggressive tactics in dealing with government officials who are clearly over the line.

No, I'm not talking about violence, but maybe it is time for some passive resistance and civil actions for EVERYTHING related to this.

I don't know it just seems like we as citizens have fewer and fewer recourse against a government seemingly gone insane with power and paying zero attention to our rights.
 
yeah, I think the 4th amendment things here are evident to anyone on this board but what blew my mind was the only thing he did wrong in the encounter. Grab for his waste. I mean at that time he has no idea why the cops are there. He knows there is at least 1 officer with an AR pointed at him, and he reaches for his waist. I do not know any cop who would take an alleged criminals word when he yells "cell phone" while pulling a dark colored object out of his waistband. i would bet there are more than a few officers who would have opened fire as he grabbed his waist band.

Yeah, the guy was stupid as a post for reaching
for his cell phone ... lucky he didn't get shot and
killed. Still, the honest mistake of him getting
shot might have been the only explainable and

First off, let's point out that half of this footage is either stock footage, or something filmed in his house after wards.

Also notice that when they say "he asked me for my keys" they don't play the audio? At all?

We don't see half of the video or audio from the dash cams.

Who reaches for their cell phone when police have trained AR's on you?!

YOU IDIOT.

Furthermore, what uniform they are wearing is moot. ANYONE that has a gun trained on you like that, and says NO MOVEMENT, you go reaching into pockets, they're going to freak out.

If I were just me, holding some bad guy at gunpoint, and he did that? 99% certain I would have shot him dead.

I swear, there needs to be high school classes on "Doctored Videos 101."

EDIT= Because I know someone's going to complain: Yes, there were most likely rights violated. But I want to see all of the footage, not just what some guy picked and chose for his viewpoint. I hate it when liberals AND conservatives do that.

Don't say it until you've been there. You never know what you'll do until you're in the situation. Not picking on you, just speaking out of experience. I have been in situations where if you'd asked me in advance I'd have said I'd shoot, but then after I was hugely happy I hadn't.
 
As much as I find many aspects of this disturbing and worth discussing, I cannot see how this thread centers around guns and/or the RKBA.
