I am building an AR and I was wondering if I bought a Preban Upper configuration that had the flasher hider and bayonet lug for my Post Ban Lower.

Now before I would attach this to the lower I replaced the Flasher Hider with a Muzzle Brake and cut the bayonet lug off. Since removing the two characteristic that would make this a preban upper would it in turn become legal as a post ban configuration.

The reason that I ask is that I have had to pass up several opportunities to purchase a Preban uppers for really good prices.
 
It would be legal as the final, assembled configuration doesn't meet the definition of an assault weapon. But you said you were finding preban uppers that were better deals than postbans? I've never seen that before. Most NIB uppers are available in either configuration but for the same price.
 
I suppose using LocTite on a threaded Muzzle brake would not count. Damn stupid law.

Buzz, the uppers I saw where LNIB complete for $225.00. They where used but you could not tell at all. This is about $120.00 less then a complete new upper.
