Alabama judiciary panel scolds judge who jailed man over yard signs

SKYLINE, Ala. — A man jailed for contempt for displaying yard signs critical of a Jackson County judge eventually got the signs back and was able to give the judge some advice — from a panel that investigates judges.

Circuit Judge Wallace Haralson said on March 17 that he received a letter from the state Judicial Inquiry Commission asking him "to be more judicious in the future toward arresting powers."

The letter stemmed from Haralson's order for Sheriff Mike Wells to arrest Phillip Dean of Skyline last August for yard signs criticizing the judge in a custody battle over Dean's two daughters.

One sign said: "Our court system is a joke," while others were critical of the judge for returning Dean's children to his ex-wife.

"I don't understand how the system can lock me up for a sign on my own private property," Dean told The Huntsville Times in a story yesterday.

The sign saying the "court system is a joke" remains in the yard, but several more were still put away yesterday. Dean said he planned to put the signs back in his front yard.

Dean said deputies took the signs from his property without a warrant and that he was jailed for about 12 hours after being arrested on Haralson's contempt order.

Dean said he was released and the signs were returned after his attorney told Haralson that the judge had violated Dean's free-speech rights. Dean said Haralson apologized soon after, although the judge said his comment was more like "I'm sorry I had to lock you up."

The attorney did not immediately return a phone message for comment yesterday.

Dean complained to the state Judicial Inquiry Commission about Haralson in December. Haralson said he received the letter from the JIC in February asking him to be more judicious about ordering arrests.

Haralson said the commission took no other action and exonerated him.

Dean said JIC Chairman Randall L. Cole, a DeKalb County circuit judge, informed him in a Feb. 3 letter that his complaint had received "serious attention and has resulted in appropriate action."

Cole said state law prevented the commission from disclosing its findings but that Dean's complaint "served a useful purpose."

Whats more: Some people(sheeple) really, truely want the BoR "modified" for err...the good of the people. After all the government is by the people, for the people and of the people so if the majority want to "redistribute" food and supplies then why not? So some jackass judge decided to go nuts. Apparently he was disciplined and the guy suffered no long term badness from it. And this adds up to America going down the drain?
 
This should not have happened in the first place and the judge should be off the bench for violation of someones rights. This was a clear abuse of power and should be remedied now with a major law suit incurring millions to the judge. I would also sue evryone else involved and file charges on the Federal level for violation of civil rights. Folks, this is not some itsy-bitsy incident. This is a flagrant abuse of power! It must be addressed more forcefully!

This is definitely not enough of a response. I agree that he needs to be dealt with more forcefully.
 
Yea I guess its not realy that bad but after reading lots of survivalist fiction over at FS forum I got sort of jumpy :D This one incedent realy is not that bad and may help "shed some light" on First Amendment rights and wake people up in that town.

His ‘punishment' is a joke. He violates the rights of an American protected under the First Amendment, throws him in jail for saying something he didn't like, orders confiscation of his private, legal property on his private land without a warrant, and all he basically gets is a letter saying "umm, you shouldn't have done that", and continues to be a judge? That's hardly a shrug it off issue, IMHO. His complete expulsion from every gov't position should be the first minimum step. Instead he gets a letter, and exoneration... :scrutiny:

The punishment isn't harsh enough! For such a heinous abuse of power, we should most certainly hang him immediately! :rolleyes:

Issue is over...Judge was put back in his place by the commission. Done and done...Lighten up people. :p

I'll tell you what Duce, lets "barrow" you for 12 hours against your will for something that wasen't illegal and see how you like it.

People take this type of thing far too lightly.

There's a lot of info missing from this story.

Was he jailed for having the signs up in the first place, or did he put new ones up after the judge ordered him not to?

The charge was contempt of court. Usually that means defying an order from a judge.

Sounds to me like he put new signs up after the deputies took the original signs, and if true, was basically making a stand on his freedom of speech, and good for him. But it also means he was defying a court order, and he should have expected to encounter some problems (i.e. 12 hours against his will).

Just my opinion...I could be wrong. :p
 
That judge...

should have been disbarred. They take an oath like every other public servant, and it doesn't contain the words 'tin dictator' anywhere in it.

The recent judicial shenanigans here in MO involving CCW stand as testimony that judges generally see themselves as 'untouchable'. That is something that definitely needs to change.
 
Not only should the judge be disciplined much more severely, the deputy should be reprimanded as well. Oh wait... I guess he was "just following orders". :rolleyes:

What difference does it make? The judge overstepped his authority either way.

Taken in conjunction with people's houses being searched because of high utility bills, eminent domain being used to further private commercial enterprises, presidents who lie under oath, and Americans who just don't seem to give a damn about any of it, YES.

So a local magistrate judge in podunk Jackson County can issue a court order contrary to the 1A and you're okay with that?

Up to his ears in legal documents, Phillip Dean is fed up with the judicial system.

"That's the kind of court system we've got in Jackson County, Alabama and I want everybody to know," Dean says.

So he put a sign in his front lawn saying "Our Court System Is a Joke."

A message landing him behind bars.

"I was in a cell about four foot wide and six foot long and nothing in it but a toilet," he explains.

Arrest orders signed by Judge Haralson claim Dean to be in direct contempt of court, even though the sign is on County Road 107, not in the county courthouse.

"The signs were so derogatory to the court they could not be ignored," Haralson responds in a local paper.

With Dean locked up, the signs were removed.

"Before they would let me go in front of Judge Haralson," Dean says. "They put leg shackles, they put handcuffs, they put chains from my legs up to my waist. they put a chain around my waist. they put chains from my waist up here and had my hands pulled up like this."

With an apology, Haralson released Dean after a day in jail,but the experience leaves Dean with unanswered questions.

"When it gets to where a man hadn't got any free speech in this world, what has he got?" he asks.

Answers he hopes to find with a message already back in place.

Considering the response of one member here, this is why the country is going down the tubes!!

Il Duce, they don't have to take away your guns in order to make this a police state. They only have to make it against the law for you to speak out against their taking your guns away!

Way to completely take it out of context. Good job! You get a sticker my friend. :p

I'm not saying it's ok for a judge to order contrary to the 1A. My comment related to him being arrested for contempt. There are more ways to fight the decision of one, as you say, "podunk" judge, than defying a court order. There's appeals, public pressure, etc. blah, blah, blah.

The judge made a decision, a decision that many people (myself included) and the Judiciary Commission did not agree with. It doesn't necessarily mean he should be disbarred. If the people down there don't like what he's doing, then they'll deal with it how they choose. If they can't vote him out, vote out the person that put him there. Done and done. Judges hear a lot of cases, not all of them deal with constitutional issues. He might be bad on the 1A, that doesn't mean he's wrong on everything else.

So again...lighten up. :D

Thanks...that's the "more info" part I was looking for. Now that I have it, I agree, the judge should receive a greater punishment than he got. To arrest someone for direct contempt of court, without any court order, no attorney, etc. boggles the mind.

I would like to get more info, though. That's his side. I'd like to hear the other. But if what he says is true, then that judge should be disbarred.

Il Duce, sorry, I can't do it. That judge is a menace. I can't believe you think it would be OK for him to arrest someone for violating an order to take down signs in his own front yard. IT DOESN'T MATTER if he ordered him not to put up more signs!

In the courtroom, the judge is God. He can order you to stand on your head, if he wants, and you have no recourse until afterward with the judicial review panels mentioned above. But OUTSIDE the courtroom, on your OWN property? That's outrageous!

The man should have been removed from the bench. A mildly-worded warning in a letter doesn't cut it.
