Missing Car, Stolen Rifle, What Next?

Gun and Ammo has been located!

OK folks, good update:

I called up the police for my freind(he's a lazy poor-dumb bastard, I swear), and we located his gun... the Mechanics had opened the trunk of his car (for some unknown reason) and really did believe the ammo case was a bomb, partially thanks to my freind's radio clock we bought from a yard sale three weeks ago (talk about coincidence). The mechanics called the police and the police came and took the odd device (a case of 7.62x54R and an alarm clock sitting on it) and saw the rifle case underneath... the rifle was found and also taken. After some lawsuit threats, the police decided to waver the bull-honkey fees (looking roughly $80) for the rifle, alarm clock, and ammo and allow my freind to pick up his rifle on monday.

Next on the list, I intend on threatening lawsuits to the mechanics for opening the trunk for no good reason.
 
You initially said the car was missing. So I assume the cops must have towed your friend's car from his house?? If so, did the cops have a search warrant to go on the property and get the car?

Did the cops think the box was a bomb? If so, why didn't they call the bomb squad?
 
Mechanics

I have been in the auto service industry for years and have found that whatever is in a vehicle isn't worth a job to any mechanic. With so many different cars out there, it is not uncommon to pull a trunk release instead of a hood release.
I'm in SE NC and I guess most shade-tree mechanics are more ignorant than shifty.
You can't jump start a car with a bad alternator.
You gonna sue garage for opening the trunk??!!

The alarm clock is ontop of a case of ammo? Even after being jolted during the tow?
Father left lights on overnight? Didn't he hear the chimes? Or see the lights?
Friend just leaves a rifle in a trunk? I'm betting the trunk was crammed with crap.
The Accord trunk release is where/near traditional hood release and easy to mistake.
You can threaten a lawsuit until your face turns blue, but it's not your car, not your rifle, not your business. You weren't put upon.
Seems like an over-abundance of stupid people in your area.
 
Due to many problems with firearm returns in CA (most never were apparently) a new law was passed a year or so ago.
To have YOUR firearm returned to you, you must go thru an eligiblilty check as if you were buying it. Jurisdictions may, by law, charge for this.
LA County, I hear, is $54 per firearm. You might also have to pay a state fee of $25 like DROS.

this is why I keep an M38 and ammo in my truck.
If it gets stolen or confiscated I'm not out much.

If there is an injustice, it should be fought on principle. It doesn't matter how little money is involved.

car was with the mechanics when my freind's dad picked it up and drove it home... without knowing that there was a rifle in the truck, and now it's missing.


Currently he's fighting his parentals about the missing gun and not doing what I tell him to go and pick up the damn thing.
 
Want the truth? Someone broke the law. You are only allowed to have a gun in your car in PRK if you are going to or from a place that allows gun possession. ie. Home to the range, home to 2nd home, home to gun smith, etc. Home to the range to the store is not allowed. Allowing the gun to go with the mechanic when it was towed means the law was broken.

Tell your friend to invest in a copy of "How to own a gun and stay out of jail" Ca version.

Your restrictions only apply to CA defined assault weapons and handguns.
Though many espouse the more conservative approach, driving around with the typical unloaded longgun is fine.
 
see you are lucky my rifle was stolen out of my truck well they caught the guy but now i have to wait 30-60 more days with it already being over a month for the police to get a dissposal order sense they have had it for more than 15 days. so what it boils down to is my gun is spending 80 days is police lock up and ten out on the street and i havent seen her in over 30 god the law sucks i jsut want my gun back now all the cops kept saying is "you will get you gun back just be patient with us"
