TIMES SQUARE (WABC) -- Police pursuing a suspect shot and killed a man who they say fired on them in the Times Square area.

New York Police Department spokesman Paul Browne says the suspect was killed in a passenger dropoff area at the Marriott Marquis hotel.

The shooting happened in a very busy area, filled with shoppers and tourists, near West 46th Street and Broadway just before 11:30 a.m.

According to officials, an undercover officer was dealing with illegal peddlers in Times Square.

When the officer approached two peddlers, one of them took off running and a chase ensued.

The sergeant pursued, and the man turned and fired with a Mac-10 machine pistol that held 30 rounds; he got off two shots before it jammed, Browne said, shattering the glass window at a Broadway gift shop.

The officer returned fire, police said, hitting the suspect several times.

The suspect was rushed to Roosevelt Hospital where he was later pronounced dead.

He was later identified as Raymond Martinez, 25, of the Bronx.

Martinez had been wanted for assault in the Bronx, but the officer approached him because he was recognized as an aggressive panhandler, authorities said. There were 27 live rounds left in his gun recovered at the scene, authorities said.

The officer was apparently not wounded, but was being treated for trauma. He was assigned to an Operation Impact zone in the Midtown South Precinct.

A Marriott spokeswoman said that the shooting did not involve any hotel employees or guests. She said police were on site conducting their investigation.

Mac-10 machine pistol that held 30 rounds
he got off two shots before it jammed

I think someone has a Math issue :)

That's why posting these news stories doesn't do much good. They have so much BS and inaccurate info in them it's not even funny.

30 rounds, 2 bangs, 1 still in the pipe and 27 in the mag

no kidding, every knows yoo're not supposed to own a mac10 in NY

"My baby diin't do nuthin'!"

Sounds like someone tried to modify that MAC, and it didn't work "as advertised." Isn't that supposed to be what happens if you try to mod a semi-auto into a FA?

If it was one of the old open bolt models, it would have modified easily enough, which is why they were all retroactively NFA'd, IIRC.
Glad he didn't kill anyone, but one question...how and why would a panhandler have a room broom? I haven't heard of beggars packing machineguns before, that's kinda new to me.

Nowhere does it say the gun was actually *loaded* with 30 rounds, only that it *held* 30 rounds. He could have loaded it with 29. That last round can be a real pain on high-cap doublestack mags you know.

Nowhere does it say the gun was actually *loaded* with 30 rounds, only that it *held* 30 rounds.

Then that would be "the gun was CAPABLE of holding 30 rounds" or "had a capacity of 30 rounds"

"the man turned and fired with a Mac-10 machine pistol that held 30 rounds" is a statement of fact.

Guess they don't teach math OR grammar to reporters. :)

And, even if that's what the writer meant, what's the point? If a Corvette is in a fender bender in a parking lot you don't say anything about it going 150mph :)

This happened a few blocks from me. He was a peddler not a panhandler, these guys sell fake Rolexes, Gucci bags, etc. The cops around here have recently been cracking down on counterfeit merch.

Deadly Gun Battle Wows Appreciative Tourists
The NYPD shot and killed a CD vendor in Times Square this morning who was not only scamming tourists, but also packing a Mac-10, for chrissake. The reaction of tourists: Awesome!

The 25 year-old victim was hanging around Times Square, who "would approach the tourists, ask them their names, write their names on the CDs and then demand payment of $10." (Tourists: "**** are you ****ing kidding me? **** away from me with that" is the proper response in this situation). Cops chased the guy, and whoa, he whipped out a god damn Mac-10 and started shooting, and then got shot to death.

Emer Rooney, 33, a visitor from Ireland on the last day of a trip to New York, walked with a friend from a nearby hotel to take pictures of the scene...She cited the shooting, in fact, as one of the more exciting moments of her trip, including recovering lost luggage at the Port Authority Bus Terminal and getting tickets to the musical "Wicked."

So all things considered here, most people in New York City still favor robbing tourists. Give em the memory of a lifetime!

"held" can mean the same thing.
We say a revolver "holds" 6 rounds or things similar all the time. It's ambiguous, yes.

No, they just made them illegal to manufacture any longer because of the ease of conversion. Open bolt semi's are still Title 1 firearms, but they can't be made any more. They command a pretty good premium price over closed bolt models of the same thing.

Great, more ammo for Bloomberg. Even though the guy already was breaking a few dozen laws I'm sure he'll use this as another example of why the subjects of NY can't be trusted with the second amendment.

Investigators said the Mac 10 was reported stolen in Richmond, Virginia back in October.

In case anyone is wondering how he got it. Which is of course how must guns are sourced for crimes.

Police found a business card for a gun dealer on the victim, Browne said. On the back of the card was a handwritten note saying, "I feel sorry for a cop who thinks I'm getting into his paddy wagon."
CNN added this nice little nugget of info at the end of the story.
