Ohio residents: Armslist/Gunlistings alert

It seems as though [strike]mayor[/strike]weasel Bloomberg is at it again. There have been several postings about minors calling from NY attempting to get private individuals to transfer handguns to them in PA. If anyone hasn't seen it yet, the "mayorbloomberg" channel on youtube is chock full of them entrapping Ohio residents.

I don't get it. Wouldn't an interstate gun deal need to transfer through a FFL? If I sold a gun out of state and sent it to an FFL, what would be illegal? The buyer would fail the paperwork and the gun would come back, and I'd be out some shipping $$.
 
Yeah well the seller should have a bit dang sense. Would anyone using their head proceed with a sale if the buyer told you on the phone they probably could not pass a background check?
 
Unfortunately, it's not entrapment. When I sell to a private party, I always check the ID to make sure they aren't from out of state. "Eric" isn't shown doing that, but I doubt he would have anyway after being told about not passing the background check. That should have been a huge red flag!:banghead:
 
Are purchase permits/registration required in Ohio ? Maybe both parties were Bloombergs "helpers".

Ya know, if it was the feds fishing and enforcing I would be ok with that... activists fishing for media fodder really pisses me off.

Not unless it's an FFL....Resident of the state and (I believe) belief that they are not a prohibited person for private party sale.

Federal law for possession (sale from private party) is 18.

So now it is a bad thing to warn the ignorant about NYC private investigators attempting to create crime where none exists for the sole purpose of giving gun owners a black eye? THR is not immune, I had a guy in Michigan get irate with me a few years ago when I wouldn't sell a Russian Mak to him without going through an FFL.

The OP was directed towards Ohio, where it is against state law to furnish a handgun to anyone under 21 years old, even your own kids.
 
abide by the law and check IDs and there will be no problems.
I get tired of people not knowing the law and proper procedures.

A bit of stupidity mixed with desperation I would guess. Odd that the next Columbus show is February 4th. Might be time to have a little fun with the "investigators."

If there are any "investigators" there attempting to make illegal purchases, be sure and report them to local LEO/ATF. These guys need to be in handcuffs.

Ignorance is not a competent legal defense.

There clearly IS a crime, no one "creates it" for the seller. Did you even watch the video link?

-Buyer admits to not being able to pass a background check
-Seller ACKNOWLEDGES the comment on the phone [with a chuckle]
-Seller has TON'S of time to think about it after hanging up....and still meets and sells the gun

Why would I defend this seller or even be angry at the sting that caught them?

No one should need to be warned, this shouldn't even be a discussion. Follow the law and you don't need to read any of these "warning posts" pretending someone's going to entrap a poor innocent seller doing nothing wrong.

I will not defend idiotic and irresponsible people who don't follow the law. It's embarrassing to be part of a community that repetitively tries to. These "warning posts" are the "black eye" to our community. The implication is we can't follow the law...so be on the lookout so no one gets caught.

If you follow the law, every time, you have nothing to worry about. If you can't follow the law, deal with the consequences. It's really that simple.

Knowledge is the key, law abiding gun owners should not be the focus of these scam investigations.

i used to live in dayton ohio but now i live in good ol kentucky are these people trying to buy guns from out of state on line? i mean if you send a firearm to a ffl dealer like most people who buy guns from out of state they would still have to pass the nics check in order to pick up the gun, also the ffl transfer fee usualy about 25bucks would prove that you were doing your part to be legal so maybe i missed something but as long as they are using a ffl to transfer ownership of said gun ohio cant do much

In Ohio PRIVATE sales are alowed as long as both partys are residents of Ohio.
At most gunshows you find farmer john selling his collection off and all he asks for is your id to prove you are from Ohio.unless they are dealers then you have to do a form 4473 and face a nics check. olnine you can request a ftf or face to face transaction sometimes done to avoid the .gov from knowing what you have. It is perfectly legal in ohio as long as both are residents. as for prohibited persons buying guns to be found guilty of this law you must KNOWINGLY sell or buy knowing the other person is prohibited. otherwise its not a problem <this is why mr bloombergs minions say they cant pass a background check up front > it gets you found guilty right away of a FEDERAL CRIME if you sell to them.

i buy alot of guns from privte sellers because i dont trust my .gov to be honest in dealing with me. sorry just personal belife.

Beware the goverment that fears your guns. :scrutiny:
