I am 18 and bought a handgun FTF (its legal in florida) its having some problems and i need to ship it back to S&W is there any problems with me shipping it to them and them shipping it back to me being only 18

I doubt it there's any issue...

I've shipped guns back to manufacturers for years and I've not yet been asked my age or sign anything validating that I'm over 18.

S&W will cover shipping both ways, theres nothing to worry about there but as I recall they do put an "adult signature required" sticker on the box and I think UPS policy has that as 21. I believe its the same with fedex. I'd ask the rep at s&w first to be sure.
 
You have to get a pre-paid sticker from S&W! I you don't, they won't let you mail a firearm, without the consent of a licensed gun dealer! Or at least that's the rules, according to 4 shipping places I tried to mail a gun through!
 
I plan on calling S&W first to get the shipping voucher If the shiiper requires a 21 signature i can make sure someon 21 is at home. also does S&W usually repair for free and how quick is their turnaround
 
I've been shipping handguns through FedEx, since they changed their next day air policy, and let you ship ground. No FFL required to ship, but must ship to a FFL holder. The gun must be in a plain box, not a FedEx box, and usually only cost $9-$10 dollars, depending on insurance and weight. Not sure on age required to ship, but willing to guess 21:)
 
S&W usually has your gun back to you in about a week. I believe they usually close down for a while for christmas though so if you're in a rush I wouldn't wait long.

They haven't changed their policy. The only possibility is that the FedEx location, where the poster has been sending firearms via ground, has the policy wrong. This is common. I have been flat out told that FedEx policy doesn't allow non-FFLs to send firearms, by a FedEx counter jockey. None of the half dozen employees knew for sure. I had a printout of their policy in my possession that cleared things up for them.

If you call FedEx corporate, they are very poignant about how they have to keep their policy current on the web. And it hasn't changed.

I have to agree with American Pit Bull. FedEx's regulations are very specific about shipping handguns. They have to be shipped Overnight and to an FFL holder. Btw, I think you will find those are also BATFE rules. Handguns can only be shipped by an individual to an FFL and must be shipped overnight delivery. Generally I think that pretty much means either FedEx or UPS, though it is possible you might be able to ship with either BAX Global or DHL because they both have overnight service, just not to everyplace like FedEx and UPS do.

I recently sent my XD to Canyon Creek to have some work done on it and I made sure I had a copy of the reqs with me. As it was I didn't need them because the person at the counter immediately pulled them up to refresh her memory. Btw, firearms can only be shipped from a FedEx office, not a Kinko's/FedEx and not dropped in a pickup box.

BATF has no rule or regulation stating that handguns must be shipped overnight. This is carrier policy, not law. There are also exceptions to the shipping to an FFL law - shipping to yourself is one.

This very well might be the case. The two counter persons at my local FedEx, both claim the policy has changed. As far as the web page & 1-800# are concerned, it goes against what the branch is doing. I will continue to do my bussiness there, as its nice to be able to ship for $10, without bothering my FFL Dealer.

Only going on the verbal policy, of my local branch.
My Dealer, I buy through, gave me the heads up on FedEx ground.

Interesting, I never thought about this one.

Not related to the OP but, Fed law does not prohibit shipping to someone else in your own state. They don't have the authority as it isn't interstate commerce. They would if they could. :mad:

I can't figure out what Fed law actually applies to this.

BTW: The ATF has no rules. They enforce Federal law. That's it (in theory).

I don't believe there is any problem with you shipping it to them, as long as you use a common carrier, such as FedEx or UPS. There may be a problem with them shipping it back to you, since you are under 21:

(b) It shall be unlawful for any licensed importer, licensed manufacturer, licensed dealer, or licensed collector to sell or deliver
(1) any firearm or ammunition to any individual who the licensee knows or has reasonable cause to believe is less than eighteen years of age, and, if the firearm, or ammunition is other than a shotgun or rifle, or ammunition for a shotgun or rifle, to any individual who the licensee knows or has reasonable cause to believe is less than twenty-one years of age;

18 USC 922

Better check with S&W first.
 
Since you legally own the gun (18 to possess) there should be no problem. If the gun isn't returned to you it is theft. It is your gun.

There should be no problem. Get S&W to give you the sticker and send it on its way. If the person delivering the gun wants a 21 year old signature, and asks for ID, tell him you're the addressee, the property inside is yours and being returned to you, and show him your ID.

But odds are there won't be a problem at all.
