Silencers (suppresors), Allowed/banned

Hi all,

I was just wondering which states in the U. S. of A. in which it is legal to own/use Silencers on handguns and/or rifles.

I live in Colorado, where it is illegal to have suppressed weapons, but I have always wanted a gun with a silencer.

I don't think it's illegal to own or use suppressed weapons in Colorado - PTK (a member here) has at least two suppressed weapons (a 10/22 and a Nagant revolver) that he's posted videos of, and he lives in Colorado. Might want to re-check your laws.

Oh really? do you need a special permit? because I have always thought they were illegal.

then again, i have been wrong many a time before
 
They can be utilized in the Gunshine State of Florida, provided you go through the Bureau of Alcohol, Firearms, Tobacco and Explosives for permission first.

They are not illegal in Florida but expensive to obtain. You either need to have a trust or you need to have an inc. buisness. once you have those you will need to sign the silencer over to one of the accounts. Also, there is a $200 state tax on them that you need to pay in order to recieve your stamp that you have to have with you when you have your silencer. It is a pain in the ass but you can do it.

AL, AR, AK, AZ, CO, CT, FL, GA, ID, IN, KY, LA, ME, MD, MS, MT, NE, ND, NV, NH, NM, NC, OH, OK, OR, PA, SC, SD, TN, TX, UT, VA, WA, WV, WI, and WY allow unlicensed civilians to own silencers. You are required to have ATF authorization to own one and pay the $200 tax, but it is a simple matter and approval is routinely given in 1-2 months. There is no license or permit required by the ATF to buy, sell, make or own a silencer. Just fill out the tax form, pay the tax and wait for the form to be returned to you. The ATF forms are just proof (and the ONLY proof) that you paid the tax and own the silencer legally. Only those businesses who import, manufacture or deal in silencers and other title 2 weapons need a license from the Feds.

The local sheriff or other chief law enforcement is required to sign the back of the ATF form 4 (buy) or form 1 (make). If he or she will not sign, then you can form a Corp or trust to own the silencer for you. Check out http://www.subguns.com and http://www.silencertests.com for more info.

I make my own using metal tubing and bar stock, very easy to do if you have a decent lathe. No rocket science here, they are just mufflers for guns. Good luck

This is THR member PTK at our place in Southern Colorado earlier this month. He had six suppressed weapons with him, all legal ($200 tax stamp on each). You might want to PM him for details.

Do you have a link to the Florida statute that says you need a trust or corp to own a silencer? The only place I could find the word silencer in the Florida laws was the definitions section. A trust is free even in FL right?

You only need to use a trust or a corp if the CLEO refuses to sign your Form 3. Thats for all states where they are legal. Using a trust bypasses the CLEO signoff, the photo, and the fingerprint cards.
I have one silencer in my name and a machinegun and silencer in a trust. For me the trust was a bit cheaper as our CLEO requires a no wants/no warrents before he will sign, also he charges for fingerprinting, and I dont have to buy a passport photo. YMMV.

Add Missouri to that list. As of 8/28/2008, suppressors can be owned by citizens in MO. :)

Yep. Missouri laws just keep getting more and more gun friendly. A year ago they abolished the County permit and 5-day wait for handguns, too.

The Pinellas County sheriff signed mine. No trust needed. They didn't even ask why. Just fill out the form, drop off, pay fee to BATFE, wait, go get supressor. The $200 is the federal tax. Once you find a Class III dealer, they can useally walk you through the process.

Since July of this year, Kansas has allowed silencers & Class III items - if you meet the ATF requirements. So add KS to the list also.
 
Where do you live in CO, friend? Perhaps we should go shooting so you can test my silenced guns. :)
