TROY | A 20-year-old man burglarizing an apartment pried open a tackle box and found nude photos of young girls, including his little sister.

The man turned himself and the pictures into police, who later arrested the apartment's tenant, a registered sex offender now facing a possible life sentence after being charged with rape of a child under the age of 13 and illegal use of a minor in nudity-oriented material.

Police said the rape charge against Richard Yearsley, 51, involved sexual touching in March of a child who was just under 4.

The 20-year-old man told police he watched Yearsley, whom he knew, leave the apartment and broke in once he left. Police said he then became enraged when he saw his 4-year-old sister's picture among "numerous" Polaroid photos of nude or partially nude young girls inside the tackle box.

He showed some of the photos to the building maintenance man, who convinced him to go to the police.

Police then searched the apartment late Friday and found photos of other young children in various states of dress.

The man said he knew what he had done was wrong, but "he knew that Yearsley was involved in something much worse and had to be stopped," according to the police report.

Police said that Yearsley admitted to taking photos of four other children during the past couple of years, and sexually touching some of them.

Wayne Willcox, deputy Piqua police chief, said the 20-year-old's case was referred to the city prosecutor to determine what charges will be filed.

Yearsley was registered as a sexually oriented offender with the Miami County Sheriff's Office following a 1995 conviction in Miami County for felony gross sexual imposition and disseminating matter harmful to juveniles.

Even criminals hate child molestors just like our "honest" burglar who saw the need to protect his sister than himself. After the molestor is convicted, the burglar can probably plea guilty and get probation.

What would I do?

I'd buy the burglar a beer and help him find a real job.

If I were the DA, I'd suggest a deferral or perhaps probation, encourage the guy to get a real job, and buy him a beer.

What would I do?

I'd make sure the child molester lived a very, very long life, filled with hourly rounds of excruciating pain and misery. Not too terrible, not enough to overload the pain sensors. Just enough to push him to the threshold where his body would shut down if it went further, but not over that line.

Then I'd give the burglar immunity and a beer.

They didn't say he had burglarized at all before. Perhaps he got some kind of hunch the guy was a pervert? I would probably believe him if it was his first "burglary".

He is still a criminal, but in this case cut the guy some slack. i like pax's thoughts. as for the perve, send him to high security prison where he can be bubba's girlfriend for the rest of his days.

As for the burglar: I'd cut him some slack, but make it abundantly clear he'd better find an honest line of work P.D.Q.

I have a similar view, but for a different reason.

I'd cut him some slack because: he COULD have walked away, and gotten away with whatever valuables. He instead put himself at the mercy of the fates and turned himself in, for a greater goal. I'm not saying the guy's a peach, but it's admirable that he did that.

I'd say force him to do some community service, maybe at one of those battered women's shelters. I have a friend who volunteered at one of those, and said that helping them turned his entire life around.

Sounds like he broke in looking for evidence.

If so, even though he was wrong for taking the law into his own hands, maybe he could get off with a warning, a ride home and a MEDAL!


And I must admit that if I had a 4 year old sister/niece/whatever and I found some guy with naked photos of her, burglary would be the least of my charges.

How well will this type of evidence hold up in court?

If a burglar breaks into a house, then goes to the police with something illegal and tells them he found it there, how believable is that?

Even if the police go to the house after the tip, and find something illegal, the house was supposedly just broken into, how can you be sure stuff wasnt planted?

Lastly, what kind of burglar breaks into a house supposedly to rob it, and then breaks into a tackle box for crying out loud?

This story is just a little fishy. Makes me wonder if the burglar didnt already know something was going on, and decided to take investigation into his own hands, and then didnt know what to do with what he found...

Or, maybe he was involved even, and got mad at the other guy.

Its all just a little weird sounding to me.

I wonder what this guy would have done had his little sister not been among the victims? I have an incling that he would have gone about his way without a wisper to anyone. That makes his actions a little less selfless than they appear on the surface. Even with his sisters picture there he had to think about it.

I too wonder about how this would hold up in court.

What if a corrupt cop decides to find his way around the 4th amendment by hiring professional burglars to break into residences and then turn themselves in for immunity if they find drugs or other illegal contraband in the residence?

If the resident's fingerprints are on the kiddieporn, that would pretty much prove the stuff wasn't a plant. If they're not, well, that raises some questions. At the very least, there should be some additional investigation.

I have a hunch we don't have ALL the facts. But assuming there are no surprises, the sex offender should be sent to prison . . . and introduced to the rest of the prison population as a child molester. And the guards should go on coffee break for a while . . .

I don't know that I would say the burglar was "honest," but I would say he did have particular ethics and no doubt a very specific anger directed at the pervert because the burglar's sister was involved. I have to wonder if he would have been so quick to admit to the burglary if he had NOT found pictures of his sister. His motivations were not because he didn't like child molestors, but because he didn't like the fact that his sister was molested.

Double Naught- Thats just a side effect of being human; caring more about some people than others. If I knew someone was molesting children, I would dime them out, but I would definitely take more personal risk (such as admitting to a burglary to the cops) if it were family involved. Using imagery (white= good, black=bad), child molesters fall in a "dark black" area. I'd be enraged if I discovered one, but in most cases I'd be perfectly ok letting the authorities handle it if I could without compromising myself.

On the other hand, if someone was molesting a close family member, that's more like a complete black hole... I would be willing to take MUCH greater risks (i.e. admitting my crime in order to give my claim more credibility than an anonymous one in this case; or maybe comitting one if the system fails ) in order to be sure that justice is done.

I'd imagine he turned himself in rather than report annonymously out of concern for his sister. By turning himself in I imagine he was hoping to add credibility.

I bet he still would have reported it anon even if his sister were not involved, he did bring it up to a third party face to face.

Of course, as mentioned, a lot of facts are missing.

but as an additional FWIW...

this subject was just on the radio as I was coming home from work tonite (thing about sex offenders)

they said you can go to your State Police site and get a list by zip code of registered offenders

also, as a side note.......one guy called in and said he was a registered offender. Got caught relieving himself along a remote county road (obviously not remote enough). Got convicted of indecent exposure.

Now, if they convicted every guy of this board that's done his duty outside, it'd be a LONG list.

Better be careful where your go "do your business".

One guy said to me once, "I know I was stupid- the girl said she was 17 when she was really 14 and I believed her. I served my time for it. Now, though, no one will rent me a place to live or give me a job because of the registration, and how am I supposed to get my life back on track and be a good citizen?"

Of course, SOs always feel sorry for themselves and have some reason it wasn't their fault, so you have to take it with a grain of salt. Even so, how many of us have taken advantage of an opportunity at some party in our younger days without checking the other party's ID? Don't just be careful about where you relieve yourself.

FWIW, we have a "2 strikes" rule in Washington State- the second sex offense gets you life without possibility of parole. Makes sense to me.
