Teenager dies after being shot, possibly by accident, at party

PORTER - A late-night house party where numerous teenagers had been drinking ended with the shooting of a 16-year-old boy who died early Tuesday at a local hospital, police said.

Derrek Delk, of Porter, died from a single gunshot wound to the neck, said Precinct 4 Justice of the Peace James Oren Metts.

The shooting happened about 6:30 a.m. at a house in the 22300 block of Smith in southeast Montgomery County.

Montgomery County sheriff's investigators said teenagers who attended the Monday night party found a gun on the property.

The teenagers began loading and unloading the magazine and racking the slide. The gun went off while in the hands of another 16-year-old, striking Delk in the neck, said Sgt. Carey Mace.

The boy was taken to a Kingwood hospital by the only adult at the party and a few of the teenagers, Mace said.

Delk was pronounced dead at the hospital.

The shooting is being investigated as a homicide.

Five or six teenagers were taken to the Sheriff's Office Tuesday morning for questioning.

None of the teenagers has been arrested and none, including Delk, lived at the house where the shooting occurred, Mace said.

The investigation is ongoing but will be referred to a grand jury to determine whether the shooting was intentional or accidental, Mace said.

Now, if I were a teenager, and still at a party at 6.30 in the morning, my Dad would have whaled the tar out of me, never mind any other risks involved! :uhoh:

I would have counted myself as lucky to have my Dad only whack the tar out of me for something like that!

He would have also kicked the living $#!@ out of me if he ever saw me treating a sidearm like a toy. Horrible accident. Not much else to add to that.

So, the idiots found a gun, and what do we do when we find loaded guns? Why pick them up and start fooling around with them while a bullet is chambered, of COURSE!!!!!

Also, there's that evil, malicious "the gun went off" wording again. If only guns didn't possess that murderous intent.

Well I guess there's only one thing left to do now: sue the gun manufacturer.

It's sad that someone so young had to die because of foolish decsions.

these kinds of things will become much more prevalent as our culture pushes anti gun sentiement through the media, school and homes of America.
Even my 3 year old knows and understands if he finds a gun or cartridge he runs away and calls for a grownup. He also knows if he ever touches/handles a firearm never put finger on trigger. Of course the difference here is guns are in the family, they are seen by the kids, the kids see us handling the firearms properly and we talk to them about what they can do if handled improperly. I just had a chat last week with my 5 1/2 year old as she has started visiting friends houses. I want her to do the right thing if one of her school chums happens to come out with daddys gun.
If we don't ever talk to kids about responsible firearms handling how the heck will they learn?? :banghead:

Noooo....the person HOLDING it and playing with it like a toy either pulled the trigger, let the hammer go down on a chambered round, or otherwise took an action that caused the mechanical operation of a device as it was designed to do.

That's the thing that causes most of the fear in the populace, I think. Via the media, many people have the idea that a loaded gun is on something like a barely-held jack-in-the-box spring, shake it or look at it wrong and it can "go off". :rolleyes:

If you are at someone else's home and someone brings a gun out --

[*] Leave if there is no adult present. Don't argue, don't lecture. Just get out.

[*] Follow the Four Rules yourself. If anyone (including the adult) breaks the Four Rules, leave immediately. Don't lecture. Just leave.

Hell, my Dad wouldn't let my brother and I point toy guns at each other, much less BB guns or anything bigger.

Ditto on the "getting tar beat out of you" comment. :)

Anyone wanna bet the "adult" was about 21?

A sad day for everyone except the Brady Bunch! :(
 
The tragedy appals me - the irresponsibility of (someone) enrages me and finally - the ''ammunition'' for Brady followers sickens me.

All so darned avoidable - but then as we know these days - young folks get way too little education on firearms and so are vulnerable - oh for the old days when every kid was schooled in gun handling and safety.
 
I can't help but think that due to our current "Guns are Bad" general public and media mind set and media penchant for violence with little consequence, ie martial arts movies etc., that many of our young folk are:
1. Practically totally ignorant of the facts of firearms and their function and operation, they are NOT toys.
2. Unaware that when someone is shot, it is a significant event.
3. Violence is UNACCEPTABLE as a form of personal entertainment, we do NOT commit violence on anyone or anything for fun.
4. Being naturally curious and immortal, likely to fondle/experiment with a gun when they encounter one as in this instance, after all - it is done in the movies all the time.
This being said, it seems to me that the onus is on the homeowner that assumed the responsibility for those young folk in his/her home in this instance. Fellow gun owners there is a lesson here.
 
This incident is a logical result of the Brady Bunch's paranoia regarding firearms. Instead of teaching kids what guns are, how they work, and how to handle them safely, we demonize them. The result is that probably 95% or more of kids growing up today haven't a clue how a gun works, and everything they THINK they know about guns is what they've seen in movies.

I find it pathetically ironic that schools are required to teach kids how to have sex, but prohibited from even mentioning the G word.
 
Don't you just love the way most of these idiot reporters write an article? The teenagers found the gun on the property, and began "loading and unloading the magazine, and racking the slide". It sounds like the gun was just lying around (of course NOone was digging around closets or drawers etc.). Then they "found" ammo just lying around. They must have been practicing loading and unloading the magazine. (lets see here, bullets put into the mag, then taken out?) Then they must have practiced "racking" the slide..
(Wonder who helped with that little gem,"racking". Perhaps the same expert that said, call it a magazine not a clip!) As far as what I read there they don't know for sure if it was the home owners or if someone braught it there..
No wonder the sheeple run scared..
Tragic none the less!

PORTER - The mother of a 16-year-old boy who died in an apparent accidental shooting said her son should have been at his best friend's house. Instead, he was at a house where teenagers are known to hang out and drink alcohol, she said.


''I don't want to sue anybody because that's not going to bring him back," said Denise Ebert. "I just want something done so they won't do it again."

Ebert is referring to the adults who live at the Porter house where the shooting occurred at about 6:30 a.m. Tuesday. She said they should have been supervising the teenagers.

Her son, Derrek Delk, and his friends were at the house in the 23300 block of Smith Road when they found a loaded gun in a truck parked at the house. They began horsing around with the weapon and it discharged, hitting Derrek in the neck, police said.

Six teenagers, including Derrek, were at the house with a 21-year-old man, who owned the gun, according to Montgomery County sheriff's officials.

The man lives in a house behind the main house on the property owned by a relative.

A woman who answered the phone at the Smith Road house said she did not know what happened the day of the shooting and declined to comment further.

Ebert said she talked to the boys who were with her son when the shooting happened. She said they told her they took the clip out of the gun before they started playing with it. Derrek later reloaded the clip and put the weapon back in the truck. Sometime later, another 16-year-old, Derrek's best friend, took the gun out, pointed it at Derrek and pulled the trigger, not realizing it was loaded, she said.

''It was a very tragic accident," Ebert said.

Sgt. Carey Mace with the sheriff's office said the teenagers told investigators a similar story.

Mace said the 21-year-old, whose name was not released, was asleep when the shooting occurred.

"He was somehow awakened shortly afterwards and drove Delk to the hospital," Mace said.

Ebert said the boys called 911, but then decided they needed to get Derrek to the hospital right away and woke up the 21-year-old man. Derrek was pronounced dead at Kingwood Medical Center.

According to the autopsy report, the bullet pierced Derrek's neck where carotid arteries convey blood from the aorta to the head, Mace said.

He said the teenagers liked to hang out at the Smith Road house. That's what they were doing Monday night into early Tuesday morning, while drinking beer, he said.

"The property has a pond and sometimes they would build a bonfire," Mace said.

He said the 21-year-old man did not invite the teenagers to the house for a party. Investigators have not determined how the teenagers got the beer or how much they had consumed before the shooting.

Although the investigation is ongoing, authorities do not believe the shooting was intentional. "All indications are it was an accident, but the facts will be referred to a grand jury for review," Mace said.

Ebert said her son was a junior at New Caney High School.

She described her son as a sweet boy who liked to be with his friends and ride his four-wheeler.

''He loved the outdoors," Ebert said.

The 16 year olds shouldn't of been loading and unloading the pistol in the first place they shouldn't of even had it with them then none of this would happen. The boy that got shot would have been alive.:fire:

AND... IT'S AGAINST THE LAW FOR THOUGHS KIDS TO OWN A GUN. OR CARRY ONE AROUND UNLESS THEY ARE GOING TO A RANGE OR SHOOTING AREA WITH THERE PARENTS!!!!!!!!!!!!
Thoughs kids should of waited to have a gun around until there 21 and have a CCW. AND not play around with it. :fire:

This sort of thing should not happen.

I doubt it's possible to make everyone too smart to do what those kids did, so what went wrong? What can be changed about the world so that this kind of incident never occurs again?

I am not sure if it's the whole reason, but this makes a lot of sense. Since I was young, I have always had an understanding of firearms because of being taught how to shoot and respect for their power.

It was always those kids and teenagers who never had this who were dangerous. Once they got their hands on one they were trouble, or in trouble. It should be obvious to anyone that education and experience beats keeping people, especially younger people, naive and ignorant. Fear benefits no one in this situation.

I think this has always been the case. We will just hear about it more, and the anti-firearm rights groups will keep trying to capitalize on ignorance more and more.

some good people out there but some real losers also.
