Traveling through New Jersey

So can someone point out some links to the HP ammo thing? I travel thru NJ 3 times a year (6 times total).
I always keep ammo and pistol in a separate locked case. I always traveled with jhp's.

I see its legal to travel with such ammo going to the range and such, why would it be illegal for me traveling thru the state with it locked in its own locked box in with the spare tire?

I am not talking about FOPA, I am talking about N.J.S.A 2C:39 (1) Does anyone have links to that exact law? I tried duck duck going, but it only brought up a bunch of bickering about the law. Nothing solid. Even there state website does show it. There are exceptions to the HP ban, and i want to see them.

If the sportsman's club member plans to hunt with a rifle and use hollow nose ammunition in a state where this is permitted, he must comply with the provisions of U.S.C.A. 926A and N.J.S.A 2C:39-6(f) and (6)(g), which is consistent with the federal law, in transporting the firearm and ammunition. The firearm should be unloaded and neither the firearm nor the ammunition should be readily accessible from the passenger compartment. If the vehicle does not have a trunk, the firearm and the ammunition should be contained in a locked container other than the glove compartment or the console. 18 U.S.C.A. 926A.

That's not actually the law. It's commentary on the law by the New Jersey State Police. The actual statute may be read here.

But the real point here is that nothing in the applicable statute excuses a non-resident passing through New Jersey from complying with the prohibition on possession of hollow-point ammunition. The limited exemptions under the statute are narrow and specific, and those exemptions would not apply to a non-resident passing through New Jersey.

The FOPA is not much more than a "Paper Tiger." Please refer to the consolidated cases of Torraco, Winstanley v Port Authority of New York and New Jersey and Weasner v Passalaqua. In those case the Second Circuit held that there was no right to sue for a violation of the FOPA. If my memory is correct, and I'll invite Frank to correct me if not, at least one of those plaintiffs appealed to the Supreme Court and was denied a review.

The text of the Second Circuit's decision infers that Torraco and Weasner successfully used the FOPA to defeat their criminal charges (Winstanley was delayed in travel but not arrested). But all three were left unable to recover damages.

In that case it's even less than a piper tiger. It's actually harmful, such that folks believe they are somewhat protected, but even if they sue it's not upheld in federal court.

So I guess the short answer to the OP's question is, don't go through NJ. Same advice would be for NY. Just not worth the hassle.
