I have never been denied a purchase or challenged for a FOID renewal. Because

I love the shooting sports and have a sizable gun collection I do not do anything that

would jeopardize my ability traverse the laws regulating gun ownership in Illinois.

I have just applied for a Carry permit from Florida and Utah. SS #/ finger prints and FBI

background checks hopefully go well. Never arrested or prosecuted for anything.

It's whats required, it's the law. You can bitch about bumping up against the restriction

but that's a problem with you, not the system. You choose to do something illegal and

got caught and now have to deal with that fact. Reality's a bitch.
 
A misdemeanor punishable by more than one year of jail or probation is cause for a denial. Have your records expunged if you can, that may not be possible if you have multiple convictions.
No matter what you think about marijuana prohibition it is best to not use it at all until the laws can be changed.

Scrubyourrecord.com or whatever is sham. They are just as bad as some of credit repair places. You either paid your bills on time or you didnt. They can't scrub your record.

Unless you have been pardoned or had the record expunged they can't help.
Again many folks forget to also contact the FBI when they have had a record expunged.

If folks with drug related arrests can't legally own guns then individuals with more than one alcohol related conviction (DUI, domestic violence(ETOH), or A&B under the influence etc) should face the same prohibition. Potheads rarely go out and shoot everyone and get violent. I fear a drunk who has had a few too many more than a stoner.

I had no idea there was such a beast as a misdemeanor punishable by more than one year in jail, always thought those were felonies.
 
To OP. I have been arrested 2 times for Pos. of MJ 20g or less misdemeanor (plead guilty) and have NEVER been halted from obtaining a CCP or firearm purchase. By a couple do you mean more than 4? Like someone else mentioned perhaps you reached the amount of times to be considered habitual. I'm not a lawyer so it's just a uneducated guess.

Two convictions???? You didn't learn the 1st time?

While I agree that multiple P.I. or DWI convictions should count as well.. and I personally have never seen violent crimes committed by persons on Marijuana (unless you want to count ravenous on assaults on junk food)

If the FBI is telling you they are still working on it... that is LE Speak for we haven't touched it yet....
 
True lilguy but, we as citizens should not have to be subjected to any type of background search. This is why many people buy from individuals. They stay off the governments books and also protect their own privacy.

I agree, maybe we SHOULDN'T be subject to background investigations, but that's the law enacted by our representatives we sent to Congress. Maybe instead of griping so much on forums, we should all work a little bit harder trying to get folks in Congress who better represent our views. Until that happens, the law is the law, as much as we may dislike it.
 
Well thanks guys for all your input. First off, I dont agree with some of you that say because I got caught with less than a joint of marijuana (twice it wasnt mine..seriously) ten years ago should hardly disqualify me from owning or purchasing a gun, but my opinion on the useless war on drugs will be saved for another time. Also, I was indeed being completely up front with everything. What would be the point of asking opinions on here if I wasnt going to be up front and honest? Its not yall I needed to impress or convince, and its not like we see each other at Christmas, so come on guys, have a little more faith in the posters, Jesus! Anyways, I finally sent a letter off to my gun grabbing senator to see if he would help, and completely by chance, the next day I had the results of my appeal in my mailbox. There hadnt been enough time for my senator to do anything yet, but it was a ironic coincidence. According to the FBI, they had indeed made an incorrect decision, and I am now able to legally purchase firearms. Shame on you all for thinking a drug charge when I was in my early 20's should now disqualify me from purchasing firearms! Would you also agree that the government should extend disqualifications to people who have been caught speeding, driving reckless, or DUI's? Some of you might, but as it see it, the government is simply thinning the herd of eligible owners by picking one aspect of some of our background, and making it a disqualifying factor, thus making the overall numbers smaller and smaller until they have a group to small to be of any formidable opposition to their gun grabbing plot. Until then, I guess I ll be a black sheep but at least Im still in the herd.
 
In Virginia, they charge you with either over or under a 1/2 oz, so even though it was only a joints worth, it goes as being less than a 1/2 oz.

To my knowledge they do, at least in some/many municipalities. Michigan CPL requirements:
12. Have not been convicted of one of the following misdemeanors in the 8 years immediately preceding the date of application:
Operating while intoxicated, second offense, MCL 257.625(9)(b)

Now, i guess you could split hairs that firearms ownership is separate from CPL/CCW but i'd say it's a pretty fine line. I don't fault the government's decision for making such a law.

I did have a DUI (young and stupid)... and as the lawyer I retained very wisely said, lightning can strike anywhere once. If it strikes twice, that's the sign of a problem.

Congratulations on getting your situation worked out. I'd consider you lucky. Hopefully all that stuff is behind you.
 
Congratulations, Cpuckett. Not everyone shares the viewpoint that the current arbitrary standards are worthwhile. It is true that there are some people I'd rather have guns than others, but from what little I know, it doesn't seem to have much correlation with whether they occasionally, regularly, or (as in your case) *formerly* smoke certain plant materials. Some people have bad relationships with drugs (dependence, of some sort or another), and sometimes it makes them unsafe. But that's true of so many things, isn't it? I don't want to share the range with someone currently high, it's true, but neither do I want to have a gun-cleaning party with half-wits or anyone who hasn't slept in 48 hours.
