A friend of mine tried to buy his first handgun today in Massachusetts. He had a valid handgun license however he was not allowed to take the gun home with him today. I was unaware of this new law that the gun dealer states that the State Police can “Hold” the gun for up to five days. The State Police doesn’t actually posses the gun, it is still at the gun store where he bought it. They said he will be notified by phone to pick it up. I thought getting your LTC in Massachusetts was the waiting period? When did this happen? :banghead:

There is no waiting period. If there was, it would apply to everyone who buys a gun in Massachusetts.

I am guessing that he was blocked by the NICS check, or by the Massachusetts online system that one completes after passing NICS. I don't think you are getting the whole story.

There is no waiting period and no such authority has been granted to the State Police or any other MA law enforcement agency.

By federal law, the dealer must withhold the sale/transfer for 3 business days if there is no response from the NICs.

If after the 3 days have passed, the dealer at his/her discretion can proceed with the sale.

As an example, Wal-Marts policy is not to allow the sale to continue until they receive a response back from the NICS, regardless of how many days have passed.

In all the firearms purchases I've made never had to wait, onces the NICS check cleared I left with my gun. If your friend bought his pistol/revolver from a shop in Woburn,Ma the owner Carl would have explained this to him.
