1st Sceanario.
Lets say that some one jumped you, but do to your excellent traing and self defense skills you were able to fight him off. But the he came at you with a knife/bat/rock whatever and you put a big hole or two threw him.

2nd Sceanario
Lets say that some one jumped you, but do to your excellent traing and self defense skills you were able to fight him off. He then comes at you again and you give him a good beating. Lets say he is uncontious but breathing.

What do you do now to cover your a$$ leagly?

1st with witnesses, both sceanarios.
2nd without witnesses both sceanarios.

If there are any LE or lawyers that frequent this site, please post up.

Thanx blackburn, I didn't see that. :banghead: :banghead: Been out of town.

This is close to the other thread but I think the extra twists you put in justify a reply.

With or without witnesses is irrelevent. What's important is to know the law in your state and follow it. That way it won't matter if anyone is looking. If you need more, remember if you are using an auto, you are leaving evidence at the scene with every shot. You'd be amazed what your shell casings can tell a good investigator.

Most states require you to be in "fear for your life." Some require a "reasonable man" approach, some require a "personal impression." The difference is what a reasonable person would be expected to fear as opposed to what you personally feared. If you are in fear for your life then lethal force is justified. You may use adequate force to "stop the threat." That's important legalese! If you shoot you want to "shoot to stop", not "shoot to kill." Remember these words if you are ever in this situation, "I was in fear for my life and I fired to stop the attack."

When the attack has been stopped, your justification for force stops. If the guy is disabled, dead or unconscious, he is no longer a threat.

Hope this helps.
