What's With Ohio's 90 days Rule?

Hey all, I'm newly an Ohio resident planning on moving out within 1.5 years. Hopefully less. Anyway, I've been shopping around for a new handgun and now I find out that there's a 90 day rule. To buy, I have to bring in something like utility bills for at least 90 days and be a resident (of course). What's with the 90 days thing? I've actually been living two lives for a little while being a resident of another state (and was intending to keep it that way/intent on moving everything back asap) while working out of Ohio some of the time. Now I'm an Ohioan and I can bring in 90 days worth of bills to prove I've been here but I don't know if that works for them. Any ideas? Thanks.

Who told you there is a 90 day residency rule? Some gun stores make up there own more restrictive rules. Are you sure it's not just a Cleveland thing? Is there some other reason that the store doesn't want to sell to you? Have you tried another gun shop? No Ohio gun store has ever asked how long I've been an Ohio resident before selling me a gun. Of course, I had an Ohio driver's license to show as ID. Do you? If not, they may question whether you are an Ohio resident at all (which the feds think is especially important for a handgun). That may be your issue. That is, whether you are an Ohio resident at all, not whether you have been for 90 days.

I am an Ohio resident. I called two places that I believe are within Cuyahoga County limits but are outside of Cleveland. They both said they needed the 90 days proof. I do have a driver's license here too.

That is strange. :scrutiny: Never heard of that down here. Anybody know if its a county thing up there?

Well, at least you have the rock and roll hall of fame.

What do they want as proof?

Utility bills or the such, which I have but didn't get my Ohio license till recently so I just don't want to create havoc for myself if I have to sign somewhere that I've been a resident for 90 days. I don't even know what is legally a "resident" here.

I looked and cannot find any state law requiring a period of residency. Must be a local thing (either law or custom).

You can:

1. Wait until your DL is 90 days old;

2. Travel further south in OH to buy; or

3. Show them your evidence of residency and don't answer questions about why you didn't get an OH DL until recently (what difference does it make anyway).

Good luck. If it is a local law, engage in some political activism.

Concur. Must be a local thing, if it is in fact a law at all. Shop outside of the city limits?

Mike

Residency requirements are baloney. They're just one more obstacle the leftist extremists have erected on the road toward exercising our Second Amendment civil rights.

How about a 90-day requirement before buying books or setting up an internet connection? How about a 90-day requirement before registering to vote?

If they don’t want your business, screw them. They don’t deserve your hard-earned money. Go outside Comuhoga County and buy from a worthy dealer...

Most of my guns were bought in the Cleveland area. I've never heard of a 90 day rule, but I've been an Ohio resident for 25 years so it's never been an issue.

I say 90 days of residency before being allowed to breathe within state limits, for all leftists. Take that, I'm sure you could do it for Marx and Engels.

Same for me here in Indiana, 90 days proof of residence. Utility bills good, insurance statements not, paper must show residential address not billing address, blah, blah, blah. I am a Resident Alien and obviously have to fill in that part of the 4473, that's when the 90 day deal comes into play.

When my citizenship goes through it will be business as usual.

The 90 day rule applies only to US Resident Aliens. If no gun shop in your area within a reasonable drive is willing to face that fact, tell them to call the local BATFE office and confirm it.

Just got back from the Painesville gunshow in Lake County, adjacent to Cuyahoga County (Kleveland). A dealer out of Lake County also said he needed 90 days. What's the deal up here? Any FFL's here know about any of this? Somebody throw me a bone.

In Michigan, I believe the 90 days rule is also only for resident aliens. That being said, since I'm a citizen now. I'll find out shortly if it still applies or not.

What exactly is a "resident alien?" I've heard the term many times before. Thanks.

Me.

Someone legally allowed to reside in the US. There was some kind of movement amongst the Mexican illegal population recently to abolish the term "illegal alien" and replace it with a more PC term. Boo frickin' hoo, if you can't do it legally, don't try to make it sound like you are being victimized, turn around and start walking back the way you came, whoever you are.

There are ways to go about it properly, it is a long drawn out process but if you are willing to commit yourself and embrace all that we have here then it is well worth the effort and expense.

I am from New Zealand, (anti gun). I have lived in England, Australia, (say no more), and South Africa, (fast losing their rights). Now I am home, citizenship pending.

The 90 day rule does indeed apply to me. I am almost certain that here in Indiana it also applies to those from other states, might be wrong but it would seem to fit the law about not selling to out of staters.
