(KMOX-St. Louis) The case of state Senator Jon Dolan is not closed, says Missouri Congressman William Lacy Clay.

Clay wants a further investigation of Dolan for leaving his National Guard assignment in Cuba to vote in jefferson city.

"He knew he was violating Army regulations," Clay says. "He should not have cast that vote."

Dolan returned to Jefferson City in time to cast the deciding vote to over-turn Governor Holden's veto of concealed-carry legislation.

Congressman clay is also calling for an investigation of the Army Judge Advocate General's office for not following the recommendation of the U.S. Southern Command to find Senator Dolan in violation of Army regulations.

Wednesday, the Army ruled that Senator Dolan did not knowingly engage in wrongdoing but did violate some rules against performing a political function while serving a tour of duty. The Army went on to say those rules are not clearly spelled out.

Dolan's punishment was a letter of admonition.

Anyone know if they could invalidate his vote? What does Missouri law say about this? Any chance or are they just trying to punish Dolan?

Sounds like they are trying to do whatever they can. Disallowing his vote would be ideal for them, but if they can only get him punished, I'm sure they'd be happy with that too. The worms.
 
That's just payback. The vote is valid, even if he broke the law to get there. If he was speeding or ran over someone on the way to vote, the vote would still be valid. The vote would be invalid only if he was no longer actually a member of the legislature.
 
The appropriate punishment has been doled out. Not much the legislature can do about it. They can't invalidate their own votes, one supposes, because a member broke a law, much less a regulation, as Dolan apparently did. Are they going to allege that the Army has some vested interest in getting Missouri CCW passed? :rolleyes:

It's the same thing as Florida 2000. The object in modern politics is not necessarily to win the argument but to make the other guy look bad while he wins it.
 
What about the rule/law about not interfering with a legislator in the performance of his duties? Could the military stop him? That may be why it`s not spelled out in the regs.

What would stop a President or Gov. from activating a unit a legislator belonged to for the sole purpose of stopping him from voting? Sounds far fetched but it seems like something Clay would endorse if it suited him.
 
I don't think Clay expects this to actually go anywhere, like Don said, it's all about making sure your opponet gets punished with bad PR. My guess is The Honorable Mr. Clay has broken a few laws while enroute to vote also, maybe its time to check his record a little more closely :evil:

I think it's been pretty well established that these people don't give a damn about what Missouri law says. They just want to keep guns out of the hands of honest citizens.
