Flare Launcher Chalk rounds a DD?

I just picked up A Czech RV-85 flare launcher and looking at some rounds for it. Other then the surplus Czech flare loads, i found some rounds that use a 9mm case and you load yourself. I thought about loading some chalk rounds for it. However when researching loading chalk round, there seems to be discussion on whether this make it a DD or not.

Has there been ruling from the ATF, if launching chalk rounds from a flare gun make it a DD or not?

I believe it depends on what caliber/diameter the launcher is.
37mm flare guns aren't DD's, but 40mm flare guns are (because you can get 40mm grenades.) - - going purely from memory there.

For a rifle yes.

37/38mm gas/flare guns possessed with cartridges containing wood pellets, rubber pellets or balls, or bean bags are classified as destructive devices for purposes of gun control act 18 U.S.C. Chapter 44

Chalk would be considered a marking or training round not anti-personnel. As long as you don't have anti-personnel munitions for your weapon you are good to go

Correct. You can buy the training rounds for the M203 or M79 without a bunch of additional paperwork. The same should be true for 37mm.

The 37mm launchers are not even considered 'firearms' since they do not chamber any commercially produced 'anti-personnel' munitions. "Rolling your own" opens you up to possible prosecution.
 
I looked into this. Wanted an NFA DD, shot the M79 in the army, guy brought one out to the range for giggles. Lots of fun. To be honest, unless you've got something to blow up, the chalk rounds are more fun at the range. They make a bigger "puff" (but no boom). Was told the chalk markers were not DD's, but they ain't cheap either.
 
Thats good to hear. Probably order the components after Christmas and make some up soon.

However went to order some 26.5mm flares from sportsman guide and for some reason they will not sell to Michigan residents. :cuss::cuss:

Have never heard of any reason or law in Mi prohibiting them.

I know they sell 12ga flares all over.
