THE NEW CENSUS:
An All-Out Assault On Your Privacy

– 08-31-05 –

The federal government has quietly begun using an incredibly intrusive new census form called "The American Community Survey." Up to 1 million households a year will receive this form.

This new "census" form is 24-pages long, and demands that you lay bare every detail of your life, including how much you earn, what your home is worth, details of your health, when you leave for work, previous addresses, pregnancies, monies received from government, and on and on.

I say demand because you can be fined up to $1,000 for each of the 72 questions you don’t answer or which you answer "incorrectly." However, so far no one has been fined for not answering, nor are they likely to be if public resistance is strong.

The ways the government could use this information to harm you are mind-boggling. For instance, any financial discrepancy with IRS or Social Security records could result in your criminal prosecution. Knowing when you leave for work could enable police, acting under the Patriot Act, to secretly enter your home.

The American Community Survey also demands that you to report on the activities of relatives, employers and roommates. Joseph Stalin could hardly ask for more surveillance powers. You can download the survey at www.census.gov/acs/www/

Article I of the Constitution allows the government to conduct a count of the American people once every ten years to determine voting districts. Nothing in the Constitution gives government the power to continuously spy on the people or probe every intimate detail of their lives.

As Congressman Ron Paul observes, questions on the American Community Survey are "both ludicrous and insulting," and this information is simply none of the government's business. I fervently hope that millions of Americans will burn their forms or accidentally lose them.

Yeah we got one.
After putting it off for about 6 months we filled it out at the advice of our attorney. Seems that they really can cornhole you over it because of a clause slipped into some legislation a few years back.
Pick your battles. This is one I chose not to fight:barf:

If the Feds tried to pull this on everyone at once, they might well start a backlash that they wouldn't be able to control, and they obviously knew it. A lot of people are getting angry over the ever increasing regulation and intrusiveness of the government into our lives and businesses, and I can see a day coming when people are going to start simply saying "no." This will most likely start with some minor state board or something and work it's way up as people find out it can be done. It WON'T work with a small percentage of people against the feds, though, and I don't expect it to start with gun control laws.

Again, it was at the advice of our attorney that we complied.
You are right ,if it was sent to everyone in the country at once, instead of select individuals, there would be enough backlash to quash it. We {us specifically } do not have the funds or time to spend years in federal court to get it dedclared unconstitutional.

It's a trial balloon. The government simply wants to see what the compliance rate will be.

And that's the only reason. They don't care about the data, as it represents such a small percentage of households, and is thus meaningless from a statistical perspective. But if the compliance rate is high enough, the government will send it to 50,000,000 households, and then the data will become meaningful.

My advice? Be a warrior, not a sheep. Don't fill it out. Screw 'em.

better yet, fill it out with false data. If they get 50 million responses filled out with horse manure, it wont do the fascists much good.

"My advice? Be a warrior, not a sheep. Don't fill it out. Screw em"

Go ahead, while you are at it, walk into your local PD while carrying a concealed handgun without a permit.{yes I do have a Texas CHL, again a fight I chose not to enter, I am well aware that a Permit to Carry is an infringement}
You see genius, we had our lawyer investigate this for us and his conclusion was that if we did not fill it out they just might make an example out of us. While he said that it would probably not end up in the civil penalties or criminal charges they threaten, it would disrupt our live to a degree that would be unacceptable.{See Civil Asset Forfeiture Laws}
So Braveheart, until you get one of these census forms, have a lawyer investigate it for you, and have to decide if having your home and all other assets seized { we keep a lot of animals, and would not be able to care for them in an urban setting} is worth the aggrevation, ****:banghead:

Hoji

Can you find out which legislation this is? Maybe it's time for the sheep to get some teeth. If we start an petition to rescind this legislation and the legislatures who signed onto it maybe we can start a trend. It is perfectly acceptable for the CITIZENS to petition for a referendum to be placed on the next ballot. Any one want to give it a try?

How did this "census" get delivered to you? Was it hand deliverd by a process server? If it came in the mail, "I never got it" is the only answer the government will get out of me. It seems our local Post Office loves to misdeliver my mail to my neighbors. It's not my fault if they misdeliver this "census" document each and every time it is sent. :neener:

As to "I never got it" go right ahead if you think it will keep people from showing up at your door.
This would be a great thing for someone who rents, and does not have a lot to lose to Civil Asset Forfeiture laws. If this is you,and you get one , by all means give em the finger.

It's sad that the government resorts to intimidating and threatening its citizens with criminalization to squeeze info out of them.

The people who draw out the approach for these things have long forgotten who pays the taxes that contributes to their salaries.

hoji:

I hope we get the form. And it will promptly go in the circular file.

I am not afraid of the government. Screw 'em.

Big talk til you actually get one, toss it, get a couple more, toss them, then get a certified letter, a lawyer{ lucky to have one in the family}, and the threat of losing all of your assets to civil forfeiture, and then proving you are not guilty of anything to get it back...... so as I said, if you get one ,go for it. More power to you. But til then don't regail us with tales of your bravery and what you WOULD do IF you get one.

Dunno, I think the last census had the same dire warnings. I filled in our names/ages/places of birth/relationships and not a whole lot else. Haven't heard any big complaints in 6 years that I didn't inform the .gov about the number of toilets in our house.

Nope, never got one of those. I also did not receive the 2000 census form. Even though I'm in a suburban area, mail delivery is problematic at best. I routinely get mail for other residents, and they get mine. When the live census taker showed up one day as I was coming home from work, she started to interrogate me about all sorts of stuff, starting with my SS#. The only information I gave was the fact that ONE person lives here, which is all they are entitled to. Further inquires from her were met with a closed door and loud stereo.

As for this bit of intrusive nonsense, should one show up in my mailbox it will get to ride the magical shredder. Loss of my assets via asset forfeiture means I'll have no more reason to behave and mind my own buisness.

This article claims it's only a $100 fine:
http://query.nytimes.com/gst/fullpa...ce/Times Topics/Organizations/C/Census Bureau

Here's another link saying the same thing:
Do I have to fill out the whole form?

The most frequent question we get from member families is, “Am I required by law to answer every single question on the long form?”

The U.S. Census is mandatory by federal law for both the long and short forms. There is clear federal warning in the code about refusal to give the required information to the Census Bureau. U.S. Code, Title 13 states that citizens must comply with the census or face a $100 fine. There is a $500 penalty for giving false information. You can attempt to request a short form from the Census Bureau or call the regional office to discuss options, but it is unlikely that your request will be granted.

Not the same."The American Community Survey" is seperate from the census.

Thanks for the clarification Hoji. (I should have read the initial article more carefully).

Well, I'll try again... According to this link the max fine is $5,000. http://www.census.gov/acs/www/SBasics/What/What1.htm

Full implementation of the American Community Survey is planned in every county of the United States. The survey would include approximately three million households. Data are collected by mail and Census Bureau staff follow up with those who do not respond.

During the last regular census I filled out the bare minimum on the form, i.e. the number of people in household and the ages. The remaining 95% was left blank. The census lady stopped by our house three times and demanded we completely fill out the form. She even quoted the law. In a polite but firm manner I told her we would not divulge any more information. She eventually got the message and left us alone.

If we received this "American Community Survey" I will just throw it in the garbage.

Freedom isn't free.

Someone's got to have a backbone and stick up to this crap. Might as well be me.

All the regular census requires is the number of people who live in your household. This is the law as set forth in the Constitution.
The American Community Survey is not the census. I truly wish you the best should you get one, but until you do,and are threatened with asset forfeiture, you really do not know what you will do. You can only fight on so many fronts and as I stated earlier, this is one front I chose not to fight on, just as everyone who has gotten permission from their state to carry a handgun has chosen the path of least resistance on the obvious infringement of their Second Amendment right.
