did IL just get CCW? (merged threads)

That's good news for the people of Illinois, but knowing Illinois Attorney General Lisa Madigan she will appeal it to the US supreme court. But this is a victory non the less.
but if she does that AND it gets kicked to the curb there would that not make it settled law in all of the US?

Currie, D-Chicago, said that “justices surely do not mean that we would have to have wide-open” laws in Illinois. She said Illinois must now look at what other states are doing, such as disallowing guns in day-care centers and other locations.

“If we need to change the law, let us at least craft a law that is very severely constrained and narrowly tailored so that we don’t invite guns out of control on each of our city’s streets,” Currie said. “I don’t want people out of control wandering the streets with guns that are out of control.”

It's good to see someone so transparent about their desire to control.

That's the gamble. It would be wonderful to have Constitutional Carry as the law of the land!

Oh no! Just think of all the murders there are going to be in Chicago if people will be able to conceal guns there! Oh wait... nevermind.

Wow.

Just....wow.

I'm not saying "wow" because of the ruling. I'm saying "wow" because of the signs of bamaboozlement that evidence the presence of brainwashing. (even here in a supposed pro 2A forum.)

Some of it even shows itself here in comments such as, "I hope the law they pass is "shall issue", and "I'll bet the legislation they pass is super restrictive", or "I'm hoping the legislation allows this or that"........

...You do know that this ruling STRIKES DOWN LAWS BANNING CARRY and takes effect in 180 days, right? If no legislation is passed, ILLINOIS WILL HAVE CONSTITUTIONAL CARRY.

Why are you HOPING for legislation concerning CCW this, or CCW that?

Oh, LAWDY! We're free! We're free! I sure hope the new shackles we get are comfortable!

No, No. I want brass shackles!

What? Brass shackles? I think chrome shackles would look better.

Um......yeah. Your chains have been struck off....and people are arguing on how the new ones are to fit.

I hope the people of Illinois sue that state government for oh.. eleventy trillion dollars for damages done to them. I wonder how many otherwise good folk were thrown in prison or just plain old murdered while the constitution was being used to adorn the privy wall.. on a nice roller dispensor.

Only problem is that the state is about eleventy trillion dollars in dept. But this should be good. I'm expecting something with a lot of restrictions, just because it is Illinois I I know not to get my hopes up :(

The Fat Lady ain't even close to singing here folks.

The state will appeal this down to the last taxpayer dollar... and beyond.

My guess, realistically, is that it will be may issue with no preemption laws so Chicago can still effectively keep their ban, just like NYC. The rest if the state might be better off. I expect a long appeal and a hard battle to get even that far. The Chicagoland thugs will never allow Constitutional Carry.

Keep fighting the good fight. It's only going to get harder from this point.

Chicago exempt?

"no preemption laws so Chicago can still effectively keep their ban"

If the judge's order is directed at the state, wouldn't that be preemptive in and of itself since Chicago is in the state? Unlike a law created outside of a judicial ruling which could mimic what they have in NY State vs. NY City. Kind of like SCOTUS saying something applies to all the country and some knuckle headed place saying, "except us". I don't think Chicago can dodge a ruling aimed at the state, or am I missing something?

ALL LAWS FORBIDDING CARRY ARE STRUCK DOWN.

....and yet, the debate continues on what kind of new laws Illinois should adopt concerning CCW.

Crime will go down for sure
Wannabe,

While I don't have a dog in the fight per se, I commend those who have stuck to their guns (pun intended) and pressed this issue. I can't help but think that we are indeed at a turning point on several fronts, many of which are taking a political slant one way or another.

I'm trying to keep my eyes open and be watchful as these events continue to churn around us. Should this go through in a positive note for concealed carry, we would do well to keep our eyes open to the outcome this will have on violent crime. It could serve as a testimony to the effectiveness of self-defense and also as a salve for the worries of a "blood in the streets" mentality.

Also, wasn't there a well-known Chicagoan arrested for CCW at the airport? -ironic?

I think we you made your point the first time, Superlite27. The point is, just because laws that ban carry are stuck down does not mean that they can't and/ or won't be replaced by new laws that are heavily restrictive of carry. You seem to have trouble understanding the scope of this issue. Yes, carry ban laws are unconstitutional. The new laws that replace them that are insanely restrictive that effectively ban carry will be perfectly constitutional. Chicago will never allow unlicensed carry. So Illinois as a state will never get unlicensed carry. They will be licensed, and those licenses will be 'may-issue' and prohibitively expensive. I imagine Illinois will be much like England in how restrictive it is to carry a hand gun. That is, unless people really get down and dirty and get involved in grass roots organizations and force the issues.

You act as if just because old laws are struck down, new laws won't replace them.

By the way, calling people 'slaves' for looking at an issue realistically is not very High Road.

Superlite, I agree with what you're saying, but in most states, especially Illinois when guns are involved, the states have to put their own spin on anything forced upon them, that's just political reality. The ideas put forth by people on this thread are their realistic hopes since Illinois will try to subvert the courts ruling.

This ruling does pose an interesting thought as far as people that are in prison over CCW issues. Are they all to be released since the ban was ruled unconstitutional and thus retroactively had no effect of law when they were arrested? This also brings into question compensation for their time in prison. And what about people who committed crimes and are serving consecutive sentences that include a CCW violation, will their sentences be amended to reflect taking off the ccw violations time? This is a great step but nowhere near the top of the stairs.

Someone pinch me.

No really, I think I'm dreaming. :)

All I've heard on the news today is "concealed carry."

So.. if we still hold a majority in the house and senate in favor of concealed carry..

Doesn't that mean Madigan's agenda is pretty screwed?

If nothing else, maybe for the first time in my life as a lifelong Illinoisan, this puts anti's on the defensive for a change.

Do the current state laws stay in effect for the next 180 days (or until replaced)?

I mean, we can't just up and drive to work with a loaded weapon tomorrow, can we?

"May Issue" will likely be the format when CCW comes to Illinois & they will likely find some way to restrict out of staters from CCW here.
Not going to allow a tax base from Tourism and out of state money fill the coffers of a broken state No Sir!
That would be too much like common sense.
