I was thinking about getting one of those aluminum 26.5mm---->12 gauge flare inserts to allow use of easier to find 12 gauge marine flares and possibly OC. Since it is still only for flare (and possibly gas) use, the flare gun itself would not need registration as an AOW, right?

I would think that firing anything but a flare in a flare gun is a horrible idea. BTW, 26.5mm flares are cheap and a whole lot better than 12ga flares. Try ammunitiontogo.com- cheapest I've seen on the net and they don't rip you off with bs hazmat charges.
 
Having a flare gun and non-flare ammo that fits it is usually considered "constructive" possession of a firearm and is a poor way to get around firearms laws. My understanding is that the target demographic for these things is people with boats who can't or don't want to have a shotgun on board yet still want to protect themselves. If you've got a big boat and the law's not against you, something like a marine-coat shotgun would be a much better choice. I'm also pretty sure that these inserts are only meant to work for one or at most a handful of shots.

I am familiar with what you are describing, those were for pistol cartridges, and I recall the truling that declared them any other weapons. In ATF testing, the flare guns suffered catastrophic failure after 1 shot:what: That's why I was trying to ascertain if anyone was familiar with a similar ruling for these, which were designed for marine flare use -only-. According to a response that I recieved on another board, these are designed to only fit a marine flare, not conventional ammunition.
