30+ Round Mags in OH?

I recently moved to OH, so not very familiar with local practice.

Local gun store is openly selling 33 round Glock mags. I ask the salesperson if it's legal to sell and possess, as I thought I'd read mags over 30 rounds were illegal in OH. The answer was "technically it's not legal, but nobody really cares. If you're at a range, nobody is going to bother you".

So my question to those with experience in OH, is this true? Do local authorities turn a blind eye and not care, or is this one of those things where the LGS is just trying to make a sale regardless.

I'm sure if the law is on the books, and you were involved in a shooting, someone would sure care at that point. Anybody know of any prosecutions for these mags otherwise? I'm inclined not to be the test case.
 
Ohio Revised Code 2923.11(E) "Automatic firearm" means any firearm designed or specially adapted to fire a succession of cartridges with a single function of the trigger. "Automatic firearm" also means any semi-automatic firearm designed or specially adapted to fire more than thirty-one cartridges without reloading, other than a firearm chambering only .22 caliber short, long, or long-rifle cartridges.

Further: (K) "Dangerous ordnance" means any of the following, except as provided in division (L) of this section
(1) Any automatic or sawed-off firearm, zip-gun, or ballistic knife;

ORC 2923.17 says that unlawful possession of ordnance is a 5th degree felony.

There is nothing in Ohio law prohibiting the sale or possession of magazines holding over 30 rounds, but as stated above, the instant you put a loaded one into a firearm, you have committed a felony.

Under ORC 2923.18, there is a mechanism to get a license or temporary permit to possess dangerous ordnance from the sheriff or police chief where you live (different from the process to get the Federal tax stamp for full auto, etc). I don't know of anyone who has one or how open to the idea LE is.

I know a lot of people have the Glock 33 round magazines and a lot of them probably use them being unaware of what state law actually is. Hell, a lot of cops probably don't know what the law is. But if you were approached by one that DOES know, a defense of "I didn't think anyone enforced it" isn't going to work.
 
JN01 pretty much said it. They are allowed to be possessed but not inserted into a firearm. But technically the guy was right they do not enforce it. Last time I did some looking I believe no one had ever been prosecuted for this law.
 
Just a matter of time then before some lucky fellow becomes the first.

Expecting to get away with violating a law because "no one cares" is a lot different from staying legal. No one might care today, but that doesn't mean that someone, like an Attorney General, won't care tomorrow.

Some posts have disappeared because posters were being too cavalier about following the law. That's not appropriate on this board.

And since the OP seems to have his answer, this one is shut down before we get more useless posts I'll have to delete.
