No, they don't have to be transferred through your FFL. They are simply flarelaunchers. Big brother versions of the cheap 12 gauge launchers you can buy at Walmart. A 40mm grenade launcher (yes, that's right, a freakin' M203) can also be purchased, but it's a destructive device. You have to pay the $200 NFA tax and transfer it through an FFL.
I've also been looking into getting a 37mm launcher from Spike's tactical, along with the adapters. But I want the stand alone version vs. the rail mount.

Just remember if you get the 12 gauge adapters, be sure to only use flares. Using a regular 12 gauge round will open a can of worms regarding a short barreled shotgun. And those "beehive" inserts are also just as problematic with the feds.

The funny thing is that it is illegal to have antipersonnel rounds for them, but fireworks can be legally launched. Antipersonnel or not, a starburst shell through your bedroom window will ruin your day.

Why not just get an airsoft 40mm grenade launcher? They are much more realistic looking, and as long as its just for fun, its just as useful. You can launch nerf footballs and other impromptu projectiles out to about 250 yards with a good propane shell ,and even farther with a C02 shell.
If you have rails, its a no brainer, just clamp it on there:

i cant get a DD in delaware so no M203 for me
and arent 12 gauge shotgun shells a different profile than 12 gauge flares anyway to prevent such behavior? the ones they sell at wallmart have a long hull with a stepdown so they wouldnt fit in a shotgun (and assume a shotgun shell wont fit in the flaregun)

Just for informational purposes, you can infact fit a shortened 12 gauge shell(home made, or the anguila mini shells fit also) in a modern Orion-style flare gun, though it would be a hand grenade if you ever touched it off. You can also fire a 12 gauge flare in any old cylinder bore shotgun, usually with no ill effects. You would have to cut the necked down portion of the flare (unnecessary) off to get it to fit in a repeater though.

I had a friend that was Master of a large sail boat on the Gulf coast. He kept several 37mm flare guns scattered around the boat for defense. They are totally legal and in fact required by the Coast Guard for emergency use. And, they will mess up your day if you're on the receiving end. I don't know if they are still available, or even now legal, but I also had a 12 gauge adapter for the flare pistol I had on my boat a few years back.
Are we talking a hang form an AR 37mm or a break action single shot 37mm? No experience with the hang form an AR kind but my department tested 37mm break actions vs. 40mm break actions for less lethal use in our jail and I was very surprised to find out the 37mm recoil was much more stout than the 40mm. The sales rep said it had to do with case length. Something about the 37 mm cases being considerably longer than the 40 cases to make up for the lost width. Basically the ammo designers overcompensated and the 37's are brutal to shoot from the shoulder, similar to a 10 gauge 3.5 magnum slug from a 20" barrel. The 40's are easy though, similar to high brass 12 gauge bird shot.
As far as Spike's Tactical, they make both a stand alone 37mm launcher and one that mounts to the rail of an AR (or anything with sufficient rail).
Now, these civvie ones are flare guns or you can fire chalk rounds from them, and maybe OC. Less lethal is a no go for civvie use IIRC, same as firing buckshot or whatnot from it. You can't even fire the "bird bomb" rounds from them.
Borch im looking at the Spikes Tactical HAVOK so its kind of either an AR under barrel or a shoulder fired stand alone if i get the optional stock
recoil doesnt effect me too much so thats not an issue
i really have no use for it other than decoration when i want it under the gun and in an unforseen god only knows why reason when i need a flare in the sky and i have my ar with me
no plans to use LTL or gas anyway (i mean comeon if im pointing an AR its gotta be serious)
i guess its kind of like the judge 2.0 lol

I just want one for the novelty factor and for the fun of it on the 4th of July...nothing lights up the sky like some white parachute flares! And I'd be firing mine off a lake dock, so no fire risk, either.
Chalk rounds would also be a lot of fun...
