Hey, all.

Am thinking about visiting FL, and had a coupla quick queries about FL carry.

1. In terms of areas that are off limits, what the heck is a "place of nuisance?" Have read the FL statute and can't make heads nor tails of this one.

2. Looks to me like amusements parks are not officially off limits, at least if I understood the state's web info correctly. Do Disneyworld, SeaWorld, etc. post signs prohibiting CCWers from entering?

Thanks in advance,
frayluisfan

Umm. . . Disneyworld, SeaWorld, Busch Gardens, etc.?

Seriously, I've always understood that to be something like a crackhouse or other criminal establishment. Hmmm. . . so maybe it does mean Disneyworld, etc.

Amusement parks are not listed in the statute as off-limits. You may, therefore, CCW there, even if there are signs prohibiting weapons. Of course, if they catch you they can ask you to leave, which you will have to do if you want to avoid trespassing charges. I've carried in most of the major Florida amusement parks. Just keep it concealed and you will have no problems.

frayluisfan, be advised that they do check bags, fanny packs, purses, backpacks, etc. at the gates of theme parks in Florida. If you do carry, carry on your body and make sure you carry very concealed otherwise you are going to VERY unpopular with your family. :uhoh:

Places of nuisance would be comprised of illegal gambling betting/operations, flop houses, drug houses, meth labs/stills, it's a catch all for an additional charge when you are caught participating in these types of activities.

Hey, guys, thanks for your replies. Your comments brought up another question. Here in NC, if you carry into someplace like a store that has put up its own sign, that right there is a misdemeanor (I forget which class). Is that different in FL?

Thanks again

No but refusual to leave is an ARMED trepass which I *think* is a felony charge.

Hi :
Florida Statue chapter 823 section 823.05 defines places of nuisances.
Mostly places where I would have hung out when I joined the Navy in 1959.

beachjumper,

Wow! I just looked it up and that is exactly the wording. haha That's funny.

Only if you were brandishing the weapon, which would be altogether a different charge. Likely you would be charged with trespassing and the gun would be discovered if they bothered to search you while issuing you a citation for simple trespass. Essentially, you have no duty to inform either the police or the business as long as you are in compliance with Florida law.

We have it a lot better here in Florida than in NC, stay out of the prohibited places and you'll be fine. Restaurants that serve alcohol are fine as long as you don't sit in the "bar area". No weapons signs on the front of businesses are directed to criminals who of course obey them , not citizens who have never been convicted of a serious crime, or been adjudicated mentally ill nor are wife beaters. Why would you try to keep that type of client from coming into your business?
