I'm thinking along the lines of enumerated powers...

I think Blackstone is entirely correct. If such a toothless bill were to pass, when the next crisis happened, there would be whining about how the current laws need to be updated.

Why should we worry more about preventing innocent people from breaking the law than about finding and punishing people who actually do break the law? At what point in our history did we begin to believe that the primary role of law enforcement is to prevent crime by whatever means necessary, rather than apprehend and punish those who break the law, if and when they do?

The basic assumption of our justice system is "innocent until proven guilty", but it seems the basic assumption of our law makers and law enforcers is "guilty unless prevented."
