Dear Mr. Kletty,

Thank you for contacting me to express your opposition to the nomination of Eric H. Holder Jr. for attorney general. I appreciate hearing from you on this important issue.

As you may know, it is the constitutional role of the United States Senate to offer advice and consent on the President's cabinet nominees. As such, Senators have the right to debate and oppose these nominees based on their merits and qualifications. While I believe President Barack Obama's nominee for attorney general, Mr. Holder, has demonstrated great intelligence and legal acumen throughout his career, he has also exhibited inferior judgment on several occasions, calling into question his ability to serve and advise in a constitutionally responsible manner.

Like you, I have concerns about Mr. Holder's role as deputy attorney general under Janet Reno in the controversial Clinton Administration pardons of fugitive financier Marc Rich and members of the FALN and Los Macheteros terrorist organizations. We are a nation at war, and the Department of Justice (DOJ) is essential to upholding the rule of law at such a critical point in our history. Mr. Holder's decision to move forward with recommending these politically-motivated pardons, despite widespread and significant opposition within the DOJ, is an unfortunate lack of discernment and not consistent with President Obama's desire to bring a new level of openness and transparency to the federal government.

It is imperative our country's next attorney general strictly interpret the Constitution and enforce the law, without allowing his personal opinion to influence his decision-making process. Unfortunately, Mr. Holder continues to demonstrate his inability to do so on the issue of Second Amendment rights. During last year's challenge to the District of Columbia gun ban, Mr. Holder displayed his disregard for American citizens' Second Amendment rights by signing an amicus brief arguing against an individual's right to keep and bear arms, a right the Supreme Court subsequently upheld.

Mr. Holder's seeming hostility towards American gun owners includes support for a three-day waiting period for handgun purchases, outlawing gun shows, limiting handgun purchases, and licensing and registering all gun owners. While serving under former President Clinton, Holder stated before the House Judiciary Committee that 13 kids on average die every day because guns are too easily accessible. He went on to propose measures, such as raising the minimum age a person can possess a handgun from 18 to 21, to "reduce inappropriate youth access to firearms." It is evident Mr. Holder views strict gun control measures and obstructing the freedom of law-abiding citizens as a necessary solution to crime.

I believe the right to self-defense is a cherished Constitutional right, and while we must grant law enforcement the tools to protect lives, we must protect with equal vigor the fundamental liberties that define our American way of life. Having an Attorney General who is so opposed to the Second Amendment rights of American citizens would undermine the very system of justice he is nominated to uphold. Rest assured, I am strongly opposed to President Obama's nomination of Eric Holder to serve as Attorney General.

Thanks again for sharing your concerns with me. Please feel free to contact me in the future about any issue important to you or your family. It is an honor to serve you and the people of South Carolina.

Sincerely,

Jim DeMint
United States Senator

I dont even want to talk about Graham. He's a RINO for sure and votes the popular vote. I cannot support him.

I wish MY senators "got it" the way Senator DeMint "gets it"...

Mine are Sherrod Brown & George Voinovich...a (D) and a (RINO)

I'm surprised you got a response at all. I don't know how many times I've written my senators and congressmen and never heard a peep out of them.

As of Thursday, Jan 29th, Eric Holder has been endorsed by the Senate Judiciary Committee, 17 to 2, and will go to the Senate at large for confirmation within the next few days.

Final opportunity! Contact your senators by phone, letter, and EMAIL at once to demand that they fight Holder's confirmation! We do NOT want this strongly anti-gun man setting policy and directing the Bureau of Alcohol, Tax, and Firearms! He will be the point man for putting Obama's four anti-gun agenda items into effect!:banghead:

Did you send your message to him as an email or just a regular letter? Also, did you draft your letter completely yourself or did you use a template of some type?

I do both email and phone calls. Fortunately one of my Senators (Mr DeMint) actually has someone answer the phone and they take the info and your opinion down to pass along to the Senator. On occasion, if he is in you can even talk to the Senator.

The other Senator sends you to a voice mail to leave your opinion. He also does not answer your letters back.

I send all my emails to the Senators and Reps using the Link on the NRA-ILA website. Its easy and one email goes to each Legislator.

I dont use a form per se. I write an actual email each time and for each issue. In the last month I have written my legislators on several issues and Sen. De Mint has answered each one.

So, I send the email and then follow up with a phone call to each office.

I do have a standard way I write the emails so Ill post that form here:

Dear Senator,
I am writing to you asking that you vote to block the nomination of Eric Holder as Attorney General as nominated by Barak Obama.

Mr Holder's judgement on (insert Rich case, Elian Gonzalez case etc...) has been less than...

Mr Holder is a strong voice against the 2nd Ammendment (insert amicus brief filed in Heller by Holder etc...)

I thank you for your attention in this matter. As a member of Grass Roots Gun Rights in South Carolina as well as other 2A support groups, I will be watching how you vote with regards to this matter.

You've been a supporter of 2A rights in the past and the people appreciate your stance. I hope that you'll continue in the good work you've set out to do,

Respectfully,
Richard F. Kletty III

I write all my emails this way and handle my phone conversations the same way. Tell em what you want and then tell them you've appreciated what they have done in the past.

you guys are lucky. I'm still a resident of Illinois technically due to taxes. Dick Durbin basically blew me off and threw rhetoric at me and polical line. Lockstep behind BHO

Senatorial responses

At least you got a reply. Comrade Karl Levin and Stabem now Stabenow don't even respond to their constitutents. Michigan is in the dumps now and getting worse while these two fiddle and follow party lines.

Levin didn't bother to reply to my letter and Stabenow sent a reply in the form of a boiler plate blah blah waste a lot of ink, say nothing letter...

I shouldn't be surprised... I reckon Carl Levin was as giddy as a school boy about to get to 2nd base with the nomination of Holder...

That's what I got, zip from Levin and a form letter from Stabenow. Levin doesn't care, he's basically got a job for life. Michigan seems to think he's some sort of institution or something.

I dont even want to talk about Graham. He's a RINO for sure and votes the popular vote. I cannot support him.

Since I have been here in SC I -always- get a reply from DeMint ... and it's usually clear from the reply that -somebody actually read- what I send.

I hear squat back from Graham.

It is unfortunate about L. Graham, but that is also my experience. At least we have one good one.

Here is a Response from MT Sen. on same Subject;

Dear MT GUNNY:

Thank you for contacting me with your opinions on Eric Holder, the current Attorney General nominee. I appreciate your advocacy on this issue.

Service is the most honorable thing a person can do. Whether it's service to one's community, state or country, service is the most noble of all human endeavors. While evaluating nominees to any post, I look for certain essential qualities. The nominee must, at minimum, be well-qualified, and have a record of honesty, integrity and a background free of ethical concerns.

Many Montanans are concerned that Mr. Holder will not uphold the 2nd Amendment. The Supreme Court ruled the District of Columbia gun ban unconstitutional in District of Columbia v. Heller and I expect the next Attorney General to follow and respect the Supreme Court's decision. Mr. Holder addressed this issue during his confirmation hearing, stating he understood the Supreme Court has spoken, and that the Court's decision is now law of the land.

As a gun owner, I know this is especially important in states such as Montana where hunting and shooting sports are an integral part of our life. I cannot support efforts that will infringe upon the rights of individual gun owners, and rest assured I will fight against any legislation that comes before me to limit our right to bear arms. Please know that I am working hard to ensure all nominees are appointed only after serious consideration.

I will continue to keep Montana's interests and principles in mind as I evaluate the nominees. Thanks again for taking the time to get in touch. Please don't hesitate to let me know if I can be of further assistance.

With best personal regards, I am

Senator Max Baucus

I recently Discovered that Max Had a hand in the Clinton AWB, and Immediately Sent him a Email expressing my disgust about all the Pro Emails he sent back to me.
This last Email from him Proves that he will vote For him, and Continues to say he Supports 2 Amendment.

I have always like Demint, but I can honestly say he just went up a notch in my book. Thank you for sharing.

Holder Nomination Confirmed In Committee

As of today, 1/29/09, Eric Holder was confirmed by the Judiciary Committee by a 17-2 vote. :fire: The 2 "nay" votes were Sen. Tom Coburn of Oklahoma and John Cornyn of Texas (my guy!! Hurrah!!! :D). Apparently, following a bout of testicular cancer, Arlen Specter now has silicon rubber prostheses in place of the affected organs. They probably just used the nuticles Vets put into Chihuahua Dogs. He never struck me as having an especially large set to begin with.

Let's see. Seventeen "yea" votes but only 10 Democrats on the committee. IIR my elementary school arithmetic that leaves 7 RINOS voting against the RKBA. :cuss: I have already sent Sen. Cornyn a big thank-you.

Both my senators are on record as saying they will vote against Holder's confirmation.

Not sure exactly how DeMint will vote. Note that his letter stopped just short of saying he will vote against Holder's confirmation.

Don't think it will matter much, even Coburn says he thinks Holder will be confirmed.

Ah, Hello?

Folks, is anybody listening?

Do you still like Demint? Did he drop back a notch (or several) when you found out he voted FOR Holder today?

Seven, I say again SEVEN, out of 9 GOP Senators on the Judiciary Committee voted with the DEMS to pass Holder to the full senate. I guarantee that were the shoe on the other foot, the DEMs would not hesitate to vote as a group against a nominee. IIRC the did that before they took back the congress.

Does anybody know what's happening on the hill? Does anybody really care?

I wish I could see the Emails Sent to the Senetors on Eric Holder, Too determin how many of them were aginst his Nomination.?

Who thinks the Party Line Voting on the Stimulus Package is a Preveiw of what it will look like on a AWB Vote?

Dear Mr. XXXXX:

Thank you for contacting me regarding the President’s nomination of Eric Holder to serve as Attorney General of the United States. I appreciate hearing from you and would like to respond to your concerns.

According to the Constitution, the Senate is charged with providing advice and consent to the president regarding selection of Cabinet Secretaries, as well as over 1,000 executive branch appointments. Prior to the president submitting names to the Senate, the Federal Bureau of Investigation conducts an extensive background check on each of the nominees.

The Senate committee with jurisdiction over the office that the nominee is seeking holds hearings on the nominee's appointment, usually with the nominee presenting testimony. Following a simple majority vote to discharge the nominee from the committee, the nomination may be considered by the full Senate, which must approve the nomination by a simple majority vote for the nomination to be confirmed.

As you may know, Mr. Holder served as a former judge of the Superior Court of the District of Columbia and Deputy Attorney General of the United States. If confirmed, he will be the first African-American Attorney General of the United States.

I adhere to the principle that, assuming qualifications, a President gets to choose the members of his Cabinet. I have met with Attorney General-designee Eric Holder and he answered a number of questions to my satisfaction. Eric Holder understands the unique role of Attorney General and further, I think he is qualified to serve in that role. Therefore, I intend to support Mr. Holder's confirmation.

Again, thank you for contacting my office. If you have any additional questions or comments, please do not hesitate to contact me. In addition, for more information about issues and activities important to Florida, please sign up for my weekly newsletter at http://martinez.senate.gov.
