Plainly put, SB 1241, sponsored by Senator LeAnna Washington (D-4), would allow the City of Philadelphia to usurp preemption statutes by limiting handgun purchases to one handgun a month.

AN ACT

1 Amending Title 18 (Crimes and Offenses) of the Pennsylvania
2 Consolidated Statutes, providing for a limit on handgun
3 purchases and sales in cities of the first class; and
4 establishing the Violence Prevention Fund.

5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Title 18 of the Pennsylvania Consolidated
8 Statutes is amended by adding a section to read:
9 § 6111.6. Limit on handgun purchases in cities of the first
10 class.
11 (a) Purchase of handgun.--No person may purchase more than
12 one handgun in a city of the first class in this Commonwealth
13 within any 30-day period.
14 (b) Sale of handgun.--No person may sell or cause to be sold
15 to a person in a city of the first class in this Commonwealth
16 more than one handgun within any 30-day period.
17 (c) Exceptions.--This section shall not apply to the
18 following:

1 (1) A licensed firearm dealer.
2 (2) A licensed firearm collector.
3 (3) A law enforcement agency or an agency authorized to
4 perform law enforcement duties.
5 (4) State and local correctional facilities.
6 (5) A private security company licensed to do business
7 within this Commonwealth.
8 (6) The purchase or sale of antique firearms.
9 (7) A person whose handgun is stolen or irretrievably
10 lost if:
11 (i) the person provides the seller with an official
12 copy of the police report of the lost or stolen handgun
13 or a summary of the report on a form provided by the
14 Pennsylvania State Police;
15 (ii) the police report or summary contains the name
16 and address of the handgun owner, the description of the
17 handgun, the location of the loss or theft, the date of
18 the loss or theft and the date the loss or theft was
19 reported to the law enforcement agency;
20 (iii) the date of the loss or theft as reflected on
21 the police report or summary occurred within 30 days of
22 the person's attempt to replace the handgun; and
23 (iv) the seller attaches an official copy of the
24 police report or summary of the report to the original
25 sales receipt or other document evidencing the original
26 sale and retains it for the period prescribed by
27 regulation of the Pennsylvania State Police.
28 (d) Grading.--
29 (1) Except as set forth in paragraph (2), a person that
30 is convicted of violating subsection (a) or (b) commits a

1 misdemeanor of the third degree.
2 (2) A person that, after being sentenced under paragraph
3 (1), is convicted of violating subsection (a) or (b) commits
4 a felony of the third degree.
5 (e) Disposition of fines collected.--The court imposing and
6 collecting a fine under subsection (d) shall transfer the fines
7 thus collected to the State Treasurer for deposit in the
8 Violence Prevention Fund under subsection (f).
9 (f) Violence Prevention Fund.--There is established in the
10 General Fund a nonlapsing, restricted receipt account to be
11 known as the Violence Prevention Fund. Money in the fund is
12 hereby appropriated to the Pennsylvania Commission on Crime and
13 Delinquency solely for purposes of violence prevention and youth
14 violence prevention, including youth education and activities
15 designed to prevent violence and grants to law enforcement
16 agencies for equipment and training designed to prevent gun-
17 related injuries.
18 (g) Notice.--A seller shall notify each prospective
19 purchaser that the purchase of more than one handgun in a 30-day
20 period is prohibited under this section and of the applicable
21 penalties.
22 (h) Handgun purchase history check.--In addition to any
23 other duty prescribed by this section, a seller of a handgun
24 shall request the Pennsylvania State Police to conduct a handgun
25 purchase history check to investigate whether the prospective
26 handgun purchaser is in compliance with this section. A handgun
27 purchase history check shall be conducted in accordance with the
28 procedures governing other background checks under this
29 subchapter. A handgun purchase history shall be conducted at the
30 same time any criminal history, juvenile delinquency or mental

1 health records check is required for a firearm purchase under
2 this subchapter. Information related to a handgun purchase
3 provided to the Pennsylvania State Police by a seller may be
4 retained by the Pennsylvania State Police as necessary to
5 monitor compliance with this section.
6 (i) Expiration.--This section shall expire seven years after
7 it takes effect unless extended by statute.
8 (j) Definitions.--As used in this section, the following
9 words and phrases shall have the meanings given to them in this
10 subsection:
11 "Handgun." Either of the following:
12 (1) A firearm which has a short stock and is designed to
13 be held and fired by the use of a single hand.
14 (2) Any combination of parts from which a firearm
15 described under paragraph (1) can be assembled.
16 "Licensed firearm collector." A person who collects firearms
17 and is licensed as a collector under 18 U.S.C. § 923 (relating
18 to licensing).
19 "Licensed firearm dealer." A person who is licensed as a
20 firearm dealer under 18 U.S.C. § 923 (relating to licensing).
21 "Purchase." Does not include the exchange or replacement of
22 a handgun by a seller for a handgun purchased from the seller by
23 the same person seeking the exchange or replacement within the
24 30-day period immediately preceding the date of exchange or
25 replacement.
26 Section 2. This act shall take effect in 60 days.

No sense in me contacting my senator about this...

... because she's one of the ones sponsoring the bill. :banghead: But I've talked to my state representative recently about the attempts to gut preemption for Philadelphia. He says there isn't anything to worry about; conservative legislators in the rest of the state aren't going to let it happen anytime soon.
 
An interesting proposition, but does it answer your question to him re how he feels about this thing, and or how he would vote on it? I assume you so questioned your rep.
 
Some good conservative reps have failed in the primary bids due to the backlash from the voted pay raise last year. This is also a good time to tell potential replacements about how we feel.

Two points on his reply.

1. As I understand it, some of the conservative legislators who lost primary elections OPPOSED the payjacking episode.
2. Regarding contact with "potential replacements", ABSOLUTELY.
 
I sent an email to my State Senator (who is on the Judiciary Comm.) asking him to oppose this legislation... got this email response back today:

Thank you for contacting Senator Gordner regarding SB 1241. The bill was not considered this morning in the Judiciary Committee, but was held pending a series of hearings the committee plans this summer on the causes of violence and possible preventative measures. Those hearings will include discussions on this bill and perhaps others that deal with gun restrictions.

Senator Gordner does not support proposals such as one gun per month or any other proposed legislation that would negate the right to own firearms by law abiding citizens. Additionally, he supports pre-emption of municipal ordinances so that firearms laws are uniform throughout the Commonwealth.

On an unrelated but interesting point, Senator Orie also seems to have led the charge in the state senate re their dumping the "Pennsylvania middle man" requirement from the slots law yesterday. It is now up to the state house to do the same. Last ygime this came up in the statde house, under loyyiest pressure, thre house voted to retain the "pennsylvania middle man/slots distributor requirement, which is plainly a give away to the politically connected. To claim that this requirement is a "jobs bill" is ridiculous.
 
technically this doesn't usurp preemption... what it does is amend state law to restrict handguns sales in cities of the first class... This will only affect residents of cities of the first class (which I think philly is the only one...).

What drew was pointing out is that if you amend STATE law to place the limit, it's not violating state preemtion of the law. IE Philly wouldn't be the one passing the law, which would violate preemption.

It APPEARS that no action is scheduled, however having been warned, keep your eyes and ears open.
 
PA gunlaws have been bottled up in committee.

The Dems have held the state budget hostage to them.

A one day "committee of the whole" has been scheduled for Sept 16th especially for gunlaw, and I presume this and other bills are involved:

Philadelphia Anti-Gun Caucus FORCES Consideration Of Gun Control in PA House Senate
Throughout the last two months and especially since the primary the Philadelphia caucus which is made up almost exclusively (there are notable exceptions) of anti-gun House and Senate members, has been holding the legislature hostage by threatening to amend every Title 18 crimes code bill with some form of gun control. In a showdown between Leadership and this Philadelphia caucus a compromise reached that would allow them to have a full day to discuss gun control issues on the floor of the House. This event will take place on September 26th and will be called a Committee of the Whole, which will allow consideration of issues and votes to be taken although the vote’s will not be recorded against a legislators name and will be considered nothing more than a sense of the House of Representatives.

IF YOU VALUE YOUR RIGHT TO BEAR ARMS THEN IT IS IMPERATIVE THAT YOU JOIN US IN HARRISBURG ON THIS DAY.

In a companion move in the Senate, Senator Leanna Washington attempted to move Senate bill 1241 in the Judiciary Committee. Senator Greenleaf are arranged a compromise with Senator Washington to hold hearings on gun violence all across the state so that her concerns with the violence in Philadelphia could be brought to the public's attention. These hearings are forecast to be held in Pittsburgh, Harrisburg, and Philadelphia on dates that are as of yet undetermined. The Allegheny County Sportsmen's League’ is working with Senator Greenleaf’s office to bring in experts in the field of sociology, a criminology and Criminal Justice for these hearings.

'Crime Guns' In Perspective

RALEIGH - Voters' consistent rejection of gun control forces gun opponents to periodically repackage their agenda. Having failed to pass off gang murders as "children killed by guns," anti-gun organizations now tell tales about "rogue gun dealers" feeding "iron pipelines" of illegal gun trafficking. Despite the new gift-wrap, their unwavering goal is restricting your access to firearms. Orchestrated by the Brady Center (formerly Handgun Control, Inc.), this national campaign would ration how many guns you may buy and, via mandatory gun tracing, would force the federal Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) to gather bogus statistics promoting gun control. A recent piece on this page alleged that "The primary source of illegal guns is corrupt (or rogue) gun dealers." In truth, a Department of Justice report entitled "Firearms Use by Offenders" found the largest sources of crime guns are family or friends (39.6 percent), followed by theft and black market sales (39.2 percent). Gun and pawn shops ("rogue" or otherwise) accounted for just 8.3 percent and 3.8 percent, respectively.

And contrary to a claim that "On May 22, Charlotte's Hyatt Coin and Gun Shop was named by [BATFE] as the fifth worst store in supplying guns used in crimes nationwide," the bureau said nothing of the sort. Agency spokesman Earl Woodham says it doesn't even keep such lists. Pursuant to litigation, it actually released raw data on gun serial numbers traced by police.

Therein lies the scam. Although gun control advocates call gun tracing a measure of crime, traced guns are not necessarily "crime guns." Says the Congressional Research Service: "Trace requests are not accurate indicators of specified crimes...traces may be requested for a variety of reasons not necessarily related to criminal incidents." Indeed, the BATFE encourages police to trace all guns encountered. Mine was once traced during a traffic stop.

Other inherent biases include variation in tracing policies between police departments (Charlotte traces all guns, skewing results against merchants like Hyatt) and the fact that statistics aren't adjusted for total number of guns sold by a dealer. After 47 years in business, Hyatt is one of the largest dealers in the country. Were it a similarly successful auto dealer, wouldn't more cars it sold be involved in accidents?

Claims that the BATFE fails to pursue non-compliant gun dealers are false: Not only do dealers overwhelmingly follow the law, the bureau conducts audits and prosecutes rare scofflaws via a strict "zero tolerance" policy. The bureau's Woodham said that if allegations about Hyatt were true, it would be "an empty storefront."

Despite assertions that traffickers obtain firearms from gun shows, the Department of Justice found an infinitesimal 0.7 percent of crime guns come from such shows. Moreover, North Carolina has no real "gun show loophole": all handgun transfers -- including gun show sales -- require background checks, and rifles are used in only 1.3 percent of gun crimes.

Anti-gun advocates say trafficking is fed by "straw" sales in which unqualified buyers (e.g., those with criminal backgrounds) use qualified applicants for purchases. These guns are smuggled to strict gun control states such as New York. But straw sales carry a 10-year federal penalty. Under threat of prosecution -- enforced by "sting" operations -- gun dealers refuse identifiable straw sales. Indeed, the National Shooting Sports Foundation, representing dealers, has partnered with BATFE to train every dealer via a program called "Don't Lie for the Other Guy." Beyond the irony that smuggled guns cause more problems in strictly regulated states to which they are transported than in less regulated states where they were originally sold, consider that dealers can't control secondary transfers of guns which have left their stores. Expecting them to track firearms they no longer possess is like expecting car dealers to conduct drunken driving checkpoints.

While Virginia's "one-gun-a-month" law is hailed as a model for reducing straw sales, Virginia remains the largest source of crime guns in New York and elsewhere. Proponents avoid mentioning cases like that of Shawn Pettaway, who was arrested for using 17 straw buyers to sell 107 Virginia guns to undercover New York police.

Not coincidentally, gun rationing would make it harder for you to buy guns and would require registering guns purchased.

Mandatory gun tracing would inflate North Carolina numbers of what gun opponents misleadingly label "crime guns" relative to states without such laws, the "solution" for which would be (you guessed it) more gun control.

While no lawful person wants criminal access to firearms, public policy should be driven by accurate information. Any bill mandating tracing of "crime guns" should equally prohibit tracing guns not used in crimes. If the goal is reducing gun trafficking rather than simply fueling more restrictions, that should satisfy both sides in the debate. Gun Free DC Crime Skyrockets

Pity the residents of Washington, D.C. Police Chief Charles Ramsey has declared a “crime emergency” in the District, in part because of the 14 homicides that have been reported during the past 12 days. In addition, armed robbery is up 14% over this time last year. No portion of the city is safe. A British man had his throat slit in upscale Georgetown. A family of four was robbed at gunpoint in the shadow of the Washington Monument.

Of course, none of these victims have been able to defend themselves. While 40 states now have “Shall Issue” concealed carry laws, Washington D.C. residents and visitors can’t even own a gun for their own protection, much less carry a concealed pistol in order to protect themselves or their loved ones.

Blogger Jeff Soyer from www.alphecca.com reported that at a recent community meeting in Georgetown a resident asked a City Council member when the District would recognize the 2nd amendment. The response was to tell people to carry a whistle that they could blow when they’re attacked.

Last year, you’ll remember, Florida enacted the “Castle Doctrine”. That law states you have a right to stand your ground and defend yourself against an attack anywhere you have a legal right to be. After passage of the law, anti-gun groups like the Brady Campaign went on the offensive. They ran newspaper ads and handed out flyers to tourists in the Sunshine State, warning tourists to “avoid disputes” and “use special caution in arguing with motorists”. So what’s the Brady Campaign’s response to Florida’s continued drop in crime?

Paul Helmke, the new President of the Brady Campaign, issued a press release statement yesterday stating, “According to FBI figures, in 2004 Florida had the second highest violent crime rate of any state in the Nation. Only South Carolina, also with weak gun laws, was more violent. The Governor’s own figures show that the raw number of violent crimes in Florida actually increased in 2005, while its violent crime rate (crimes per 100,000 people) dropped only slightly last year. Florida has a higher violent crime rate than New York, New Jersey and Massachusetts, all of which have strong gun laws.”

He’s right, but it’s what Helmke doesn’t say that’s really interesting. It is true that in 2004 Florida’s crime rate was the second highest among all states, at 711.3 per 100,000 residents. It is true that South Carolina was higher, with a violent crime rate of 784.2 per 100,000 residents. What Helmke doesn’t say is that Washington, D.C. is also counted in the FBI’s Uniform Crime Statistics. Washington, D.C.’s violent crime rate in 2004 was nearly double that of Florida’s, at 1371.2 violent crimes per 100,000 people. I wonder why the Brady Campaign thought that was irrelevant.

Helmke says Florida’s violent crime rate is higher than New York, Massachusetts, and New Jersey. What he doesn’t say is that California and Illinois (home to a lot of gun control laws) also have higher crime rates than New York, Massachusetts, and New Jersey. What he doesn’t say is that states like Ohio, Virginia, Minnesota, and Kentucky (places with good or great gun laws) all have lower violent crime rates than New York, Massachusetts, and New Jersey. Again, I wonder why that’s irrelevant.
Helmke went on to say, “Explaining and understanding increases or decreases in crime is always difficult. To argue that putting guns into our communities leads to a reduction in crime makes no sense.” Actually, it makes a lot more sense than looking at Washington, D.C.’s crime rate and insisting that gun control works.

Police Tie Jump In Crime To Juveniles

In Washington and Boston, police say there have been alarming increases in robberies by juveniles. This year, 42% of all robbery suspects in Washington have been juveniles, up from 25% in 2004, the police department says. A series of homicides — 14 in July — has led D.C. Police Chief Charles Ramsey to declare an emergency that allows him to put more cops in troubled areas. Four suspects have been arrested in the slaying of a British man in the upscale Georgetown area Sunday; they include a 15-year-old.

In Boston, juvenile arrests for robbery rose 54% in 2005; weapons arrests involving youths rose 103%. "Kids are jumping into this violence," police Superintendent Paul Joyce says. "We're very concerned."

•A changing social climate. In Boston and other cities, gang leaders imprisoned a decade or longer ago are being released and are reclaiming their turf. Joyce says they're recruiting — or forcing — youths to carry guns or deliver drugs to shield older gang members from additional charges. The weapons can turn disputes among teens into violent confrontations, he says.

Cities Grapple With Crime By Kids

Many officials, including Boston police Superintendent Paul Joyce, say the release of thousands of felons who were imprisoned during drug crackdowns in the 1990s also has become a significant factor in boosting juvenile crime.

Joyce says just-released gang members, seeking to stake out turf without getting arrested again, have recruited juveniles to carry weapons for them or make drug deliveries. Earlier this year, Joyce says, Boston police found a 13-year-old boy with a handgun, standing with a 23-year-old gang member.

"The young kids don't think about the consequences of their actions," Joyce says.

U.S. House of Representatives Votes to Overturn Trigger Lock Sales Mandate
The U.S. House of Representatives voted on Wednesday (June 28th) to overturn a controversial, recently enacted law requiring safety trigger locks on ALL hand guns sold in the United States.

Recognizing the unpopularity of this measure throughout America, legislators handed a victory to opponents of gun control by a vote of 230-191.

Rep. Marilyn Musgrave, a Colorado Republican, argued that the added cost of the trigger locks is passed on to gun owners and that they "do not stop accidental shootings." Gun owners have long warned that trigger locks provide a false sense of security -- and that no one should trust them to prevent a gun from firing. Self Defense experts, academicians and gun owners also say trigger locks are an impediment to quick self-defense when it's needed.

Last fall, President George W. Bush signed legislation giving gun makers broad protections from civil lawsuits, but that law contained the mandatory trigger lock provision.

The amendment overturning the requirement for trigger locks was attached to a larger law enforcement spending bill for next year that has not yet been considered by the Senate.

"They obviously got your message loud and clear. It was the most lopsided gun vote I have ever seen." -- As told by a Senate office to GOA after the overwhelming vote yesterday



Good news! The Senate voted yesterday 84-16 to pass the pro-gun Vitter amendment.



The language, offered by Sen. David Vitter (R-LA) as an amendment to the Homeland Security appropriations bill (HR 5441), will make it illegal for federal agents to confiscate firearms during an emergency or major disaster. The provision must now survive a conference committee -- where House and Senate negotiators will iron out differences between the spending bills passed in both chambers.

If the Vitter language makes it to the President's desk, it will perfectly complement what has been happening in the states. This year, one of GOA's highest priorities has been to address the problems with so-called "emergency powers" across the country.

GOA-supported bills have made it absolutely certain that no government official could disarm the citizenry during an emergency, and several states -- ten in all -- have already enacted their bills into law.

Sen. Vitter, who less than a month ago was presented with the Legislator of the Year award by Gun Owners of America, made special mention of this groundswell of support that has been rising around the country. It was especially significant that his own state of Louisiana recently enacted a ban on confiscating firearms – an action taken to correct the gun thefts which occurred there in the aftermath of Hurricane Katrina.

GOA spent a lot of time in Louisiana, getting gun owners in the state to lobby their own legislators this spring. The results were astounding.

The sponsor of the Emergency Protection legislation in the state, Rep. Steve Scalise, told GOA that, "I've had a number of [Representatives] come up to me asking to co-author my bill because they heard from members of Gun Owners of America in their districts in support of my bill," Scalise said. In the end, 80% of the House cosponsored his bill.

If you have ever wondered if your activism makes a difference, then wonder no more.

One U.S. Senate office told GOA after yesterday's vote, "They obviously got your message loud and clear. It was the most lopsided gun vote I have ever seen. There was some serious hand wringing on the democratic side."

Why was there "serious hand wringing"? Because your efforts made it VERY difficult for anti-gun Democrats to vote against the Vitter language.

Again, there were only 16 Senators who voted wrong. If you look at GOA's Senate rating -- at http://www.gunowners.org/109srat.htm -- you'll see a lot more than just 16 F's in that chamber.

So who were the Senators who were arrogant enough to stand by their anti-gun convictions and vote against this common-sense legislation?

Basically, these senators said that when your life is in danger, you don't have the right to defend yourself. You are just supposed to pick up the phone and dial 9-1-1. Your guns are part of the problem because they could be stolen by bad guys. And you don't need guns anyway because the police are there to protect you.

These are actually the talking points from the anti-gun side of the aisle yesterday. They told the Senate -- and the country – that YOUR guns were the problem. Your duty is simply to call the police when you're in danger.

Of course, calling 9-1-1 doesn't work very well when the neighborhood is flooded, the phones aren't working and chaos is in full bloom. Sen. Vitter made this point very eloquently, and he should be commended for his efforts in defense of our gun rights.

Again, GOA thanks all of you who took action yesterday. Your activism and your financial support is greatly appreciated and is necessary to allow us to remain here fighting for your rights.

Louisiana Activist Sues Police For Arrest and Gun Seizure

A Louisiana man has filed a federal law*suit against police in Gonzales, LA, for un*lawful arrest and wrongful imprisonment because of his arrest in January for openly carrying a handgun while at the Tanger Out*let Mall in that community.

The lawsuit was filed in US District Court for the Middle District of Louisiana.

Open carry is legal in Louisiana without a permit, but police in Gonzales arrested Mark Edward Marchiafava of Baton Rouge any*way on Jan. 28. He was carrying a Smith & Wesson Model 586 when he entered a store at the mall to make a purchase for a friend while his daughter waited outside in her car. Minutes later, as they were driving away-*as reported in the March 20 issue of Gun Week-the car was surrounded by police, with guns drawn. Marchiafava was disarmed, handcuffed and taken to jail.

At the time of the arrest, one of the offic*ers allegedly asked Marchiafava why he was carrying a handgun, and Marchiafava told him, "Every citizen in Louisiana has that right. . . don't you know that?" The officer apparently didn't.

Earlier this year, Gun Week spoke with Gonzales Police Chief Bill Landry, who was tight-lipped about the incident, in anticipa*tion of future litigation. That wait is now over. At the time, he referred Gun Week to Louisiana's Title 14, Section 95 under which Marchiafava was arrested, but that statute does not appear to address open carry, only the illegal carry of a concealed weapon.

District Attorney Anthony G. Falterman declined to prosecute Marchiafava.

For the past few months, Marchiafava has become something of a cult hero among ac*tivists on the KeepAndBearArms.com fo*rum, which is perhaps the busiest of all Internet chat forums in the nation relating to gun rights. When he announced the lawsuit last month, he got plenty of encouragement. Marchiafava is being represented by fire*brand New Orleans attorney Ashton O'Dwyer, who became famous for his refusal to surrender his firearms to police in the post*Hurricane Katrina gun grab. He told CNN at the time that, "I will leave when I am dead.... Let them be warned. They come to my house, they try to evict me, they try to take my guns, there will be gunfire."

O'Dwyer is also representing New Orleans resident Patricia Konie, who was filmed be*ing gang tackled and physically removed from her home by California Highway Pa*trol officers assigned to help restore order in the storm ravaged city last year.

Marchiafava's lawsuit names as defen*dants the Gonzales Police Department, the Ascension Parish Sheriff's Office, and three individual Gonzales officers. Marchiafava alleges unlawful arrest, excessive use of force, and wrongful imprisonment, plus the unlawful seizure of his handgun.

The handgun was returned Feb. 3, but by then, Marchiafava was incensed and by then the wheels were in motion that led to the lawsuit.

O'Dwyer told Gun Week that the lawsuit will seek damages for false arrest and im*prisonment, intentional infliction of emo*tional distress, assault and battery and em*barrassment and humiliation Marchiafava suffered. It will be up to the jury to award punitive damages.

The case has been assigned to Judge Ralph E. Tyson.

In an unusual move, Marchiafava actually filed the lawsuit papers personally, O'Dwyer said. The attorney estimated it may take be*tween 8 and 14 months for the case to go to trial. However, because it is a civil rights case, he said it may wind up on a "fast track" depending upon the court docket. The New GUN WEEK, June 10, 2006



Gun-Trained Florida Teen Shoots Intruder as Dad on Phone Advises

Javaris Granger of Hollywood, FL, wished his father was there instead of him, The South Florida Sun-Sentinel reported.

His father was on the phone, urging Granger, 15, to get the gun they used for shooting practice. "Do what you have to do," his father said.

Granger did. He aimed the gun and fired at the violent intruder.

Family and friends are awed by Granger's bravery. "Anyone who takes charge like that is definitely a hero," said Maxine Chandler, his mother, according to the newspaper.

Before the McArthur High School fresh*man fired the gun, he kept a cool head and remembered his father's shooting and safety lessons during the chaos early in the morn*ing of May 20.

His father, Lyndon Chandler, had left the house to visit a friend at the hospital. His wife heard a knock at the door and, thinking it was her husband, opened it. A stranger grabbed at her; she pulled free and slammed the door.

It was 3:30 a.m.

Granger woke with a start, hearing his mother's frantic voice and something slam*ming against the front window.

He ran out to the dark living room and saw his mother screaming as a man, cursing and muttering, threw a bicycle at the window.

Granger yelled at the intruder to leave, while his mother called his father on the phone and handed it to her son. The stranger began turning the doorknob, intent on get*ting in the home.

Within seconds, Granger ran into his par*ents' bedroom, found the safety box, un*locked it and loaded two guns for him and his mother. He ran back to the living room as the intruder threw a bicycle at the door and started kicking it in.

His mother was too shaken to take a gun, so she ran to another bedroom where her daughters and visiting family members were hiding.

"I was real scared and nervous, but I knew I had to stay focused on what I had to do because my mom and the kids were there," Granger said.

The next moment the man kicked down the door and jumped into the living room, yards from Granger.

"I didn't want to hurt anybody, so I fired off a warning shot," the ninth-grader said. The intruder didn't leave until four shots later.

Since the incident, friends and family members have called to congratulate the modest teenager who didn't tell his story until news reports made it hard to hide. His three sisters call him brave, his dad is very proud of "the man of the house" and his mom says her family would have died if the man po*lice later identified as Keil Jumper had laid hands on them.

Jumper, 22, was in Memorial Regional Medical Center with two gunshot wounds. He has a string of arrests dating to 2001, in*cluding one for attacking a Seminole Reser*vation Police Officer the day before he al*legedly broke into Granger's home.

Granger does not face charges. The sec*ond oldest child in the family, he often goes to the range at Markham Park to practice shoot with his father. He was never a victim of crime before, but calmly went through all the gun safety steps his father taught him, even after one gun jammed after the first shot during the attack.

He even locked up the guns after Jumper left, before he checked on his mother. "My husband tried to get everyone to learn the safety of a gun," Chandler said. "It paid off." The New GUN WEEK, June 10, 2006

Wanted Cash, Got Lead

Police in Lexington, KY, looked at the security video from the Sub*City Market and determined that local resident Charles Harmon, 26, was trying to rob the place, alright.

But Harmon didn't get the cash he must have expected from his enterprise. Instead, he got a bullet from the unidentified store clerk, and a little while later, Harmon died at the University of Kentucky Medical Center, according to WFIE in Evansville, IN.

The caper went down at about 9:30 a.m. on June 11. The report said Harmon entered the market, demanded money and indicated that he was armed.

The clerk, who really was armed, drew a gun and fired. Harmon made it only a short distance before hitting the ground. The New GUN WEEK, June 10, 2006



Antics Get a `Charge'

Further proof that truth is stranger than fiction is the bizarre tale out of Midwest City, OK, regarding a drunk, naked man who put up such a fight with two local cops that they had to zap him with a Taser.

A man identified as Mark Alan Oliver by The Daily Oklahoman evidently skipped the lesson on alcohol consumption that revealed copious amounts of liquor are known to make a feller's clothes fall off. On the night of June 5, Oliver was spotted running down a street in Midwest City, absent his garments.

Enter Officers Archie Huston and Joe Cruz, who, if Gun Week might be so bold, probably don't get paid enough to handle this kind of caper on a regular basis. The newspaper said Cruz and Huston arrived at the Village Oaks mobile home park in time to find Oliver taking cover underneath one of the mobile homes, and he wasn't going to budge.

Oliver reportedly told the cops that he had taken off all of his clothes to urinate, after which he forgot where he put those clothes. If Cruz and Huston started laughing at that point and who wouldn't?-the mirth didn't last long.

The cops pulled the naked man from under the mobile home and he put up a fight. It got so bad, the newspaper reported, that finally one of the officers zapped him with the Taser to subdue him. The New GUN WEEK, June 10, 2006



Arm Illegals as Guards

From the "Only Cops Should Have Guns" file comes the story out of Houston, TX, about a veteran cop and his father who have been charged with hiring illegal aliens, and then giving them guns so they could work as private security guards.

According to Associated Press, Officer David Rodriguez and his father, Manuel, were indicted for conspiring to hire and arm the ille*gal aliens, providing false information on firearms purchase forms and dealing in firearms without a license.

The report said all of the illegally-armed illegal aliens were hired as security guards for Bayou City Patrol Division, a private security firm owned by Rodriguez senior and his son. This company provides secu*rity for nightclubs and other businesses, including apartment build*ings, in the Houston area.

While David Rodriguez worked for 14 years on the police depart*ment, his father is a retired Postal Service employee. The New GUN WEEK, June 10, 2006



Guess Who GOP `Can't stomach'

In a recent fund raising letter, New York Sen. Hillary Rodham Clinton-thought by many to be posturing for a White House run in 2008 even though she is currently running for Senate re-election*said Republicans "can't stomach" her.

In what detractors jokingly called one of Clinton's "Well, DUH!" moments, the former First Lady noted in her appeal, "The Republicans can't stomach the fact that I'm leading the fight against their misplaced priorities."

According to NewsMax.com and Associated Press, a "Friends of Hillary" letter sent to likely campaign contributors alleged that "My name is at the top of their list." It's not as if Clinton needs the money. Earlier this year, her campaign war chest was reported to hold about $20 million.

A consistent anti-gunner, Clinton has been traveling the coun*try making speeches, going well beyond the normal campaign ac*tivities of an incumbent seeking re-election in a specific state. Clinton has also been working to position herself as a supporter of the military and the Iraq conflict, to the chagrin of her party's left-liberal core voters.

Clinton's campaign denies she is planning to run for the White House, but Republican strategists are convinced she is laying the groundwork for a presidential bid, probably to kick off sometime next year. The New GUN WEEK, June 10, 2006

U.S. STANDS FIRM, REJECTS FUTURE MEETINGS . . . Over the past five years, the world has spent well over $100 million on numerous United Nations Small Arms and Light Weapons Programme of Action-related meetings. Though some view these international meetings as a route toward backdoor global gun control, no one can argue there has been little bang for the buck. The United States clearly said enough is enough, and objected to wasting hundreds of millions more dollars on an ongoing bureaucratic debate. The U.N. Small Arms Review Conference concluded Friday with nations failing to agree, a major setback for anti-gun organizations and welcome news for supporters of the Second Amendment. The U.S. rejected any future meetings and clearly showed that, while it supports worthwhile efforts at curbing illicit small arms trade, it will not support ineffective regulations negatively affecting its freedoms. "There are tragedies around the world on scales that demand international action," said Rick Patterson, managing director of the Sporting Arms and Ammunition Manufacturers Institute (SAAMI), which represented the firearms industry at the conference. "Had the conference maintained a focus on fully automatic military weapons they may have been able to implement an effective global strategy. Issues related to sporting firearms and private ownership are too complex for global strategies." HOUSE VOTES TO OVERTURN SAFETY LOCK MEASURE . . . The U.S. House of Representatives voted to overturn a recently enacted law requiring safety locks to be distributed with all handguns sold in the U.S., Reuters reports. The provision was included in the Protection of Lawful Commerce in Arms Act, signed last year by President Bush. The amendment to overturn the requirement was attached to a law enforcement spending bill, which has yet to be considered by the Senate.
GUN CONTROL: A POLITICAL LOSER . . . A Sunday U.S. News and World Report story discussed how politicians are beginning to see that restricting the Second Amendment rights of law-abiding Americans is a political loser. A spokesman for the Johns Hopkins Center for Gun Policy and Research suggested that gun-control activists turn their sites on targeting corrupt firearms dealers. While sportsmen, firearms enthusiasts and the industry itself have long supported a zero-tolerance policy and aggressive prosecution of dealers engaged in illegal activity, NSSF will remain vigilant in ensuring that any and all investigations are conducted through the appropriate agency (Bureau of Alcohol, Tobacco, Firearms and Explosives) and not political pawns of the gun-ban lobby, such as New York City Mayor Michael Bloomberg.
FLORIDA DEMS DISAGREE ON GUNS . . . When it comes to guns, the two Democratic contenders for governor in Florida are at opposite ends of the spectrum, reports the Miami Herald. State Sen. Rod Smith of Alachua, a co-sponsor of the state's "shoot-first" law and supporter of measures to stop local governments from suing gun makers, is squaring off in a primary against U.S. Rep. Jim Davis of Tampa, who has consistently cast anti-gun votes in the U.S. House.
COURT: OWNERS MAY BE LIABLE FOR SHOOTINGS WITH STOLEN GUNS . . . Massachusetts' highest court has ruled that gun owners may be negligent for shootings with their stolen firearms in certain situations, reports the Boston Globe. The Supreme Judicial Court's ruling applies to gun owners who fail to properly store their firearms when they know someone with a history of violence can access them. The ruling stems from a 1999 fatal shooting of a police officer by a man with a violent history and mental illness.
LIFETIME GUN PERMITS PROVING POPULAR . . . A new Indiana state law that allows handgun owners to acquire lifetime permits is proving popular, reports The Times. The law went into effect July 1 and gives residents the option of purchasing a four-year permit for $40 or a lifetime permit for $100 ($125 if they're not a current holder of a gun permit).
IN RURAL AMERICA, GUN OWNERSHIP NOT PARTISAN ISSUE . . . While urban-area lawmakers -- both Democrat and Republican -- debate over whether to toughen gun laws, political leaders of both parties in more rural states aren't necessarily on the same page. Knight Ridder Newspapers takes a look at the urban-rural divide over gun rights and the role it will play in this year's elections.
RANGE OWNER SUES NEW YORK POLICE COMMISSIONER . . . A shooting range owner in New York City who was arrested last month as part of the city's anit-gun initiative sued the city's police commissioner, reports the New York Post. The lawsuit, filed by Michael Spallone, co-owner of the Woodhaven Rifle & Pistol Range, demands the return of clients' gun licenses and says the "sting" was nothing but a mayoral publicity stunt. Spallone was charged with a misdemeanor on May 24 for allegedly "delivering" a handgun to a civilian undercover investigator.
SCOUT WAS PREPARED . . . Seven-year-old Cub Scout Kevin Dave, Pahrump, Nev., knew just what to do when he discovered a 9mm handgun hidden in a bag of jerky stuffed under a shed near the bleachers of an athletic stadium. He immediately reported his discovery, which came when he and a friend were chasing a lizard. Sheriff Tony DeMeo presented a certificate of appreciation and good citizenship for Kevin’s clear thinking, congratulating the youth for his forethought and good sense in knowing better than to handle the weapon and then telling an adult, steps recommended in much of NSSF's safety literature and videos.
KANSANS ELIGIBLE TO APPLY FOR CONCEALED CARRY . . . Though no concealed carry permits will be issued in Kansas until January 1, 2007, applications for the permits, authorized by a law recently passed in the Sunflower State, legally could be filed as of July 1. The Wichita Eagle quotes Sedgwick County sheriff Gary Steed as estimating that 25,000 permits will be filed statewide. Information on the law, as well as application forms, is posted on the attorney general’s Web site. Don Holman, owner of the Bullet Stop, anticipates in a spike in sales, similar to the 30 percent rise he saw when the legislature passed the law by overriding Gov. Kathleen Sebelius’s veto.
GUN TRACES AND 'CRIME GUNS' . . . In a recent News Observer op-ed, Grass Roots North Carolina president Paul Valone puts "crime guns" in perspective. "Having failed to pass off gang murders as 'children killed by guns,' anti-gun organizations now tell tales about 'rogue gun dealers' feeding 'iron pipelines' of illegal gun trafficking. Despite the new gift-wrap, their unwavering goal is restricting your access to firearms," Valone writes.
HOUSE GOP TO FOCUS ON GUNS, CONSERVATIVE-BACKED MEASURES . . . Republicans in the U.S. House of Representatives are planning to vote on bills this summer and fall involving guns, abortion, religion and other issues that are aimed at improving the party's chances in midterm elections, FOX News reports. Pro-gun bills include a measure that would prohibit confiscation of legal firearms during emergencies.
SOME 3,000 SIGHTLESS PEOPLE GIVEN CHANCE TO GO ON SAFARI . . . When 3,000 members of the National Federation of the Blind from all 50 states and Puerto Rico convened for their annual convention in Dallas on July 2 and 3, Safari Club International officers and volunteers were on hand to present its familiar Sensory Safari event. There, more than 50 wildlife taxidermy specimen species from around the world were displayed so that visitors could learn about wildlife using all of their available senses, including touch. Through 50 temporary and 12 permanent exhibits, the Sensory Safari experience gives hundreds of thousands of children and adults a better understanding of wildlife, particularly through touch.
