? about pre - post ban handguns in NYS

I am looking to buy a NIB Beretta 92FS. My question is in NYS is it legal for me to buy a post-ban gun, and then buy pre-ban 15 round mags? Or do I need to buy a pre-ban gun? Also it looks like $500 is the going rate for older NIB guns, is this a fair price?:confused:

My understanding is that you can buy any age 92FS but that you would be limited to 10-round or pre-ban magazines. However, I am not a lawyer and would be interesting in what other interpretations of the law are.

You may want to contact your County Clerk's office for more information. This, of course, depends on which county you are in.

As far as the state is concerned, the magazine and weapon are separate entities. Preban magazines are perfectly legal as long as there is no date printed on them identifying them as being made post 93. There is no law stating that a preban mag cannot be used in a post ban weapon.

But as said, your county laws could override this.
 
We shot IDPA w/ a guy who just graduated from the Sherrif's academy here in upstate NY(near Albany)They're telling him ANY magazine w/ more than 10 rounds is ILLEGAL in NY state...no matter when it was made.Depending on who you ask,you get different info.Sucks......BTW Prof. were practically neighbors...if you're interested in IDPA send me a PM.We have a league in Rotterdam......:cool:

He has no idea what he's talking about.

The NYS ban is a mirror of the nation-wide ban that used to exist. If the magazine is preban, you're good to go. Same for rifle magazines. Manufacture date of the pistol itself does not matter.

This is what scares me, how many officers are ignorant to the actual law. What are the chances of getting in deep sh*t over someone not doing their job correctly?
