About Virginia gun laws 2023 (large capacity magazines)

I just want to make sure that Virginia has no law restricting large capacity ammunition magazines ( last update Jan 5,2023) since the HB 2240 was passed by indefinitely. I am going to sale a S&W 915 9mm ( 15 rounds) in Virginia soon , to FFl or private sale. Thanks.

You are good to go in VA regarding magazine size, but all firearm sales must go through an FFL.
 
I found it from federal law, "anyone who does not have a federal gun dealer license, or other Federal Firearms License (FFL), is generally prohibited from acquiring a handgun directly from a seller or transferor who resides in a different state."
 
All private sales in Virginia now have to go through a FFL like buying a new firearm . No magazine restrictions though .

Correct, but you should also be aware that that applies to all firearms, not just handguns.
 
If two of residents from different states transfer a gun though a FFL, is it still belongs considered a "private sale" and violated Federal gun law.?

It is not a violation. A FFL must be used in the receiving state and he/she will ensure that laws in the receiving state are followed. There are significant restrictions on firearms from shippers (there is a sticky for this I think) so it’s likely that you’ll have to use a FFL in your state to ship it to the receiving FFL.

There is no "official" definition of the term "private sale" but, based on the definitions of those words that term is normally used to mean a sale between individuals without a dealer or government official or agent being involved. Transferring through an FFL makes it legal but also not what is normally considered a "private" sale.

If a sale through FFL is no longer be considered " private sale", it should not difficult to do it. In fact in Maryland , the handgun sale must fill out form and check the background , there is no way to finish it between only two people, it must though the FFL..

Correct. Private sales are illegal in Maryland.
 
No, private sales are legal in Maryland, but seller only can sale to a Maryland resident not other states, I just sold another pistol on June, 2023.
Perhaps we need to further clarify our terms. How are you defining "private sale"?
