What started as a call about a possible home invasion in the east mountains turned deadly Thursday night.The Bernalillo County Sheriff's Office said it received several calls about a person trying to enter a home on La Madera Road in the Sandia Park neighborhood at about 8 p.m. Thursday night. But by the time deputies arrived one person, now identified as 23-year old Christopher Mack, was dead in the home.

Investigators believe the homeowner armed himself with a gun before deputies could get there and fired at Mack. Deputies said they spoke with the homeowner and have since released him.

The Bernalillo County Sheriff's Office said they are trying to figure out what led Mack to the home in the first place.

The case will now be turned over to the District Attorney's office for further investigation

This happened in Albuquerque, NM last night.

Hope it turns out justifiable, and the homeowner suffers no undue negative consequences.
 
The way the article reads I expected them to say "We wanted to charge him with murder, but self defense is legal in this state."
 
At least they didn't refer to the guy who got popped as the 'shooting victim'.

I don't like that part AT ALL!!

I'm relieved that in my state the fact that someone has broken into your home is reason enough to "stop them" unlike some other states which require you to flee from your own home and shoot only if you have no egress. That is totally insane. You NEVER turn your back on a BG because you are just asking to be killed. Please don't get me wrong, I would NEVER want to shoot a person but it's good to know if it happens in my state they won't treat me as the BG. If they break into your home you must stop them because you can't take the chance of being hurt or killed leaving the rest of your family at their mercy. It has nothing to do with wanting to kill someone who breaks into your home, it is only the necessity of stopping them before they can harm your family. Stopping them does not mean killing them. Unfortunately for the BG it usually turns out that way because people that are serious about home and family protection practice a lot and are proficient at what they do.

I truly hope that man isn't put through hell because he protected his home and family. I'm sure he is already sick over having to shoot someone, he doesn't need to be treated like a BG on top of it!

Homeowner Kills Intruder

Christopher Mack couldn't stop crying Thursday, fearing for his life.
Mack, a diagnosed schizophrenic, left his parents' home in the East Mountains for a walk sometime before 6 p.m.
Hours later he was shot to death after he used a cinder block to break through the front door of a home three miles away.
Police said the homeowner feared Mack was armed with a gun.
"It is tragic in all regards," said Bernalillo County Sheriff's Lt. Matt Thomas.
Mack's mother said Friday that she believes her son was having a psychotic episode and might have thought he was at his own home.
Police said they don't know why Mack, 23, broke through the door. Mack doesn't have a history of violence, according to court records in Bernalillo County.
"We may never know what his true intentions were," Thomas said.
Shortly before 8 p.m., police were called to the 300 block of La Madera near Sandia Park after residents called 911 reporting a suspicious man in the neighborhood.
Sheriff's deputies arrived, searched the area and found nothing.
A short time later, another resident called reporting that a man was outside his home and threatening him, police said. The caller said the man might have a gun.
The caller stayed on the phone with 911 operators as the man, whom police later identified as Mack, used a cinder block to "ram" open the front door.
The homeowner, who was with his fiancée, fired one shot at Mack, killing him, police said.
Investigators didn't find any evidence to indicate Mack was armed.
Mack was a Manzano High School graduate and a former football player.
"He wouldn't hurt anybody," said Mack's mother, Patti Scherer. "He was one of the kindest, loving individuals ... His mind was just not there."
Scherer said Mack was diagnosed with schizophrenia after his brother, Patrick, 23, died unexpectedly 4 1/2 years ago.
Scherer said her younger son had his ups and downs with the his mental illness. The day leading up to his death had been "tough," she said. He was grieving over his brother, crying and listening to Eric Clapton's "Tears in Heaven" over and over, she said.
"He just kept saying that there is no hope for his life," Scherer said. "When he is in one of his psychotic episodes, he will get scared. He would run and hide and (be) afraid people were after him."
Eventually, Mack took a nap, and shortly before 6 p.m., his parents discovered he was gone.
About a month ago, Scherer said her son tried to kill himself with a razor blade and needed 117 stitches to close one of the wounds.
And before that, Mack had left home and tried to walk to Santa Fe, she said. He was later found lying in a ditch in the rain.
Scherer said she was going to call police if her son hadn't returned by the next morning. Instead, police showed up at her door that night.
"I just had a sick feeling," she said.
The homeowner, whom police declined to identify, has not been charged in the shooting.
Investigators said the case will be submitted to the Bernalillo County District Attorney's Office for review.
At the home Friday, a man, who identified himself as the homeowner's father, said his son was upset about what happened and didn't feel comfortable discussing the events

Sounds like the intruder had mental issues instead of bad intentions. But how do you know? If someone violently breaks your door down don't you have to assume the intruder has bad intentions?


Anyway, a bad situation for all involved.
 
117 stitches to close a "self inflicted wound"?????????????????????

I'd say the homeowner had some serious reasons to be a bit scared. The most stitches I've had at one time was 6 and that was to close a 1 1/2" - 2" gash in my leg . ..how big of a self inflicted injury do you have to require 117 stitches?

I don't know anyone who's going to take the time to try to psycho-analyze an intruder before taking defensive action.
 
The only way to stop the growing home invasion trend is to kill enough of the intruders that other thugs start thinking twice about it. Reinforce your doors and windows and always have a loaded gun within quick reach.
 
Parents should have had a better plan in place to keep an eye on Mack. Easy to say, tough to do. Every puppy gets lost eventually.
 
In my state the law says that i cannot shoot anyone who isnt armed with a deadly weapon!!!! Im sure the home owner was scared when the nutcase busted down the door,but when i took my CWP,They said if the intruder dosent have a weapon,that you should cal 911 and try to calm the intruder by talking to them!!!! I bet the parents press charges on the home owner,and files suit on him.

The writer gives the impression that the defender got impatient and just shot for no reason.

Took out the front door with a cinder block? Damn!

You know, it might cost a dollar or two, but I think it might well be worth getting some door frame work estimates.

Think about it.

New (solid, heavy) door with reinforced frame + labor = what, maybe $1,500?

Very possibly the least expensive break-in insurance you can buy.

If the perp then insists on coming through a window or sliding glass door, there's little need for discussion about whether they were there on "legitimate" business.

Even the "yeah, I always smash my front door in with a cinder block" (I thought it was my house) defense doesn't work when the door won't give.

They'd have to escalate to the "yeah, I always drive my truck through my front door" defense instead.

But unfortunately you just made that statement in a public forum which is available for anyone in the world to see. So if you ever do shoot someone in self-defense, this statement could well come back to haunt you in court (criminal or civil). Trust me, prosecuters and lawyers do search the internet for everything they can find on people they're going after.

Watch what you say in cyberspace. Big brother may well be watching.
 
Very true!!!! But i know there is 99.9% chance of someone entering my home is out of the question. I live in the sticks, And have 3 dobermans..chances are I'll just say "sic em boys!"

Except for the cinder block he just smashed a door open with right? That sounds pretty armed to me. I don't know about anyone else but if he just threatened me and then smashed my door open with a cinder block I think I am going to be forced to believe his threats. Are you supposed to wait and see if he hurls the cinder block at you or your fiance or tries to smash one of you with it?

Unless major holes in their story appear it looks like a good shoot to me. Threats from outside the house and then forced entry with a weapon that he clearly can use quite effectively if he got through the door with it. If he takes a step towards me I believe that demonstrates intent to follow through with the threats. Although I think smashing down the door pretty much demonstrated intent in an of itself.

I agree, the baseball bat part wasn't brilliant, but opinions and cynical comments aren't illegal, and if they are, sc*** the lawmakers. Being a victim starts in the mind, they are just men, they still crap like me, they got momma's, and they probably haven't enjoyed life as much anyway. . .

"Here sir, try some of this new medication I got...yes..now breathe deeply. Good. Oh don't worry about the door. Would you mind stopping the screaming, and please, do put down that cinder block."

Honestly, I would have waited on pulling the trigger, but that's just my personality. i don't fault the guy, I would have just assessed the situation a little more, and maybe I'm over confident but even the cinder block wouldn't have struck me down in terror. Keeping him in the sights, or even maintaining 'safe' distance and talking MAY have been appropriate until cops arrived. We will never know if the GG thought the screwball was carrying...
 
A while back in Houston, woman shot a man who was trying to beat down her door. Seems he came home drunk and stopped at the wrong house and tried to force his way in. The woman wasn't charged as she was in reasonable fear of life/injury. Deadly force is allowed in Texas to prevent serious bodily injury. The Texas Supreme Court has upheld that serious bodily injury can be done with bare hands.

Anyway, this case sounds similar. I wouldn't be surprised in New Mexico is similar.

It seems to me that if a cinder block was used to break through a door - that
would be a deadly weapon. A cinder block to the head would be rather deadly I would think.
 
I guess a cinder block could be looked at as a weapon but when your 6'4 280 lbs. like myself.......a cinderblock....eeehh.....not too scarry. May leave a bruse or scrape. In my situation i would definately go to jail if i shot the nutjob...and yes, I WOULD have tried to talk him out of what he was doing...
But nobody here was there facing the situation. So we can spectulate all we want.....but I would like to find out the rest of the story.;)

Unless he successfully flings it at your head or your fiance's head.
He just smashed a door with it, that demonstrates to me that he can use it quite effectively.

I would hope that I would not have to end someones life, but I would definetly get screwed if I did it here in the DPRK. The place where "CRIMINALS HAVE RIGHTS and CITIZENS DON'T"
