Under US Code, Title 18 Part I, Chapter 13, Sec. 242 it looks to my untrained eyes that the officer who arrested him and the Sheriff himself are now both felons.

I bet they get off the hook and this guy looses his gun because us serfs should just shut up and know our place, but if this guy gets a good enough lawyer we may get to see some honest to God justice down there.


At any rate, Sheriff is usually an elected position, so the good folk down there need to fire this jerk.
 
Can you say "civil suit"? I'm sure there are plenty of lawyers in LA who would drool over a case like this.
 
Somehow this whole affair angers me! I can't hold with any LEO not being familiar with the basic laws of his state or territory. No I don't dislike LEO/s
and have had a stint of employment as one. There is no excuse for the behavior for these officers.

I certainly agree that this needs to be taken to the top eschelons of our justice system. Just to show these ignorants that they aren't the Cheesey cops portrayed so well by Jackie Gleason in "Smokey and the Bandit." Though you will have to admit. It brings that movie to mind....
 
Wouldn't this be a Civil Rights violation?

State laws say open carry is legal.

2nd Amendment says "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

Looks to me like the Feds could be called in.
 
Maybe they're confused and think they're in Europe, since they've got so much French civil law code left on the books.

I hope the guy and all the others who were illegally deprived of their property hire vicious lawyers with sharp pointed teeth who will non-consensually screw the heck out of those cops.
 
This is Very Upsetting. But what can we do?
Posting our opinions here won't do any good.
Emailling the Police Department won't do any good.
WHAT CAN WE DO?
Because I am angry and we need to do something!

to think that this is what our country has come to... Too, it makes me scared of LEO's, instead of proud of them, and makes me wonder if I ever OUGHT to tell a LEO id I am cc... Actions like this should be FIRING offenses, as well as criminally prosecuted. Then...let those Ole' boys down in "Loosiana" do a stint in "stir", and see how they do in an environment where they ain't makin' their own laws any longer, and Big Bubba in their cell-block is their new best friend...
 
You've also got to remember that this is Louisiana. You know, where the FBI has come into precincts and arrested the entire shift and where there have been political problems because of too many cops taking part in bank robberies in uniform. This is the state where, some years back, the governor was out exercising his droit de seignure regularly. It wasn't a scandal, just a matter of lively speculation as to which house the Executive car would be parked outside in the morning[*]. It's also the state with campaign slogans like "The Wizard or the Lizard" and "Vote for the Crook. It's Important."

The normal rules of First World behavior just don't apply the same way down there.

[*] This was during the streaking fad. When a college newspaper reporter asked if the governor would streak he allowed as how it would be bad for the dignity of the office if people recognized the governor running around nude. She suggested if he'd wear a bag over his head. The guv paused and said "Wouldn't make no difference."

I wonder how the chief feels about other issues the law and supreme court dictate?

Does it also bother him that all those "uppity black folks and women" want to vote in an election in his parish?

This guys needs a lawsuit to get his attention and a recall election followed by the threat of criminal prosecution for ignoring the law and harassment.
 
This is an older story. The guy eventually did get his gun back, still wears it. Last I heard, he was trying to bring civil charges against the sheriff and the department, however, being that this is louisiana and all, getting a grand jury to even listen is near impossible because of the 'good ole boy' network. Feds won't bother stepping in either.
 
You only need a grand jury for criminal charges. For a civil case you just need to bring a locked and loaded attorney. Has he considered a civil suit?
 
Isn't Louisiana where that "civilian" came to the rescue of that cop? I thought I read a story about it a while back. LEOs make me so mad sometimes, especially when they act like it's their sole right to protect people, when they KNOW they cannot, and in fact do not have a duty to, protect individuals. They "protect" society at large by their existence, but their primary role is to investigate and arrest AFTER a crime has been committed. Sorry, but I don't want to wait until I am a victim to get some police help.
