I see parallels with this shooting and the George Zimmerman/Trayvon Martin shooting.
I didn't see the Zimmerman shooting as justified, that's my take on this one also.
It's possible the prosecutor was wanting to avoid a circus similar to what the Zimmerman/Martin trial became, to ultimately end in aquittal.

Zimmerman is an idiot, he got off because the charge was not appropriate. He would almost certainly have been convicted of a lesser crime like involuntary manslaughter. Like Doloff, he took actions that turned an encounter deadly when he really shouldn't have got involved at all. But he was also actively being attacked and losing the fight. If he had been standing several feet away from an unarmed Trayvon Martin when he fired, he'd be rotting in prison right now.

Doloff killed in retaliation to a slap, one that he earned by grabbing at something the victim possessed. He initiated the physical conflict and used a deadly force when it was not remotely justified. That makes it murder prima facie, and it's for a jury to weigh the evidence and decide, not Beth McCann.
 
The 'political motivation' being what?

I strongly suggest you read the article and follow the writers reasoning as he works through the photos. Once I did this, I had a much different view of the incident than I had before.
 
"Imminent danger of great bodily harm..." You mean like having a much larger person beat them for an unspecified length of time? The bruiser that was shot looked like a physical threat to me.

You do not think so. Well, good, that means I'm not the final authority. So you're going to have to take it up with the DA's office, about who knows what that all means.
The situation didn't rise to the level of justifying deadly force. No matter how big a guy is, you can't shoot him when he slaps you and backs away.
