Any insight on restraining orders?

I know if one is issued against me, they take my guns. Is there anything I should know if I am the issuer, or listed as a "do not contact" on a RO by the issuer?

My sister issued one against her ex (who is in jail for his actions on her), and included my name on it as a "Do not contact", since he threatened me over the phone, and through her before he got sent to the clink.

I guess I have two questions:

1) Would there be an "asterisk" of sorts placed next to my name for being included on the restraining order in official records?

2) Could this help/hinder my efforts to get a CCW in MD (which as we all know is NOT shall-issue) ?

There is a difference between a restraining order and a personal protection order (or whatever they're called in your state) and in Michigan, if someone requests a PPO against you, they can ask that you be prohibited from possessing guns but it's not automatic.

Whichever this one is, it shouldn't affect your RKBA.

I can't speak for Maryland, but here in Illinois you're an additional protected party on the Order of Protection (as they are called here). As such there will be a note placed into the computer system that you are a protected party in an OOP. This will come up everytime the police run your name.

This isn't necessarily a bad thing, it just lets the officers know that there is someone who isn't supposed to be around you.

I have no idea if it would affect your ability to get a CCW. A rational person would use that as a reason to give you a CCW because you have a proven need to defend yourself. However we all know that rational people don't always make those decisions.

I would assume that it would further your reason to be able to carry concealed, as the addition of your name to the Order shows that you have allready been threatened, and could continue to be threatened.

Add two more well documented threats of violence against you and the state police will let you pay the $100+ to tell you they'll consider letting you have a ccw permit.

+1
But I think you need several more before the board considers you to have a "real" threat.

how about "they're not worth the paper they're written on"?
Spot on.

There's an old saying that "Locks are made to keep honest people out," and the same applies to restraining orders. They do nothing to restrain anyone, they just allow the authorities to add on one more charge after they pick up the bodies and track down the restrainee.
