I have an Argentina FM 9mm long-barrel Hi-Power which is still registered in my ex-husband's name, but he's perfectly willing to sign it over. However, the department of justice tells me the list of certified guns for sale in california lists an Argentina FN, but no FM.

Are these completely different manufacturers, or did some company take over production, or is there ANY info that could help me find out if this gun is or isn't on the list?

Thanks!

Welcome to THR.

You may want to check again using the specific model (Fabricaciones Militares of Argentina (FM) M90 or M95), but a quick look at the list at the state AG's website doesn't show it.

The history is that FN originally made Hi Powers for Argentina and then they sold equipment to Fabricaciones Militares of Argentina to make the pistol under license. I'm not sure if the current M90 and M95 are actually licensed production since there are external differences from the FN pistols.

Hi moderator, and thanks! just to be sure: my Argentina is more than 16 years old. My ex bought it used around 1993. He also thinks that it is (or then was) the only one approved for import/export by the federal governement and therefore federal should override state (and I do give him a bit of credit, being a gun afficionado and SF soldier).

Does the age make any difference (referring to the external differences you mentioned)

Due to the fact that it was made in 1993 and is a private gifting check if the list even applies. If I remember correctly it only applies to those handguns sold by dealers and private party transfers are not subject to the list. You still have to go through an FFL, but the handgun may not need to be on the roster.

Calguns.net has a wealth of information specific to California.

Thanks! Obviously, I didn't dream of mentioning how old it is when I called the DoJ. If all else fails, my ex will get a nice, never-used gun back. lol!

Since it's a private transaction there shouldn't be any problem. Check with your/his favorite gun shop and tell them that you need to conduct a private transfer of a handgun, they'll probably take care of it for you without any muss or fuss.

petradav, does your ex still live in california and is local for you. If he does you both need to go to a firearms dealer and do a transfer. Now if he is out of state I think you are out of luck. The FM pistol isn't on the safe gun roster and can't be imported to be transferred under normal circumstances. Mark
