There are some circumstances in which a firearm would not be regulated by ATF and not subject to a (compliance) inspection. Such as an: unserviceable firearm. An unserviceable firearm is defined as one which is incapable of discharging a shot by means of an explosion and which is incapable of being readily restored to a firing a condition. An acceptable method of rendering most firearms unserviceable is to fusion weld the chamber closed and fusion weld the barrel solidly to the frame. Certain unusual firearms require other methods to render the firearm unserviceable. An unserviceable NFA firearm is still subject to the controls of the NFA, but may be transferred tax free as curio or ornament. Permanently inoperable firearm- A firearm which is incapable of discharging a shot by means of an explosion and which is incapable of being readily restored to a firing a condition. An acceptable method of rendering most firearms unserviceable is to fusion weld the chamber closed and fusion weld the barrel solidly to the frame. Certain unusual firearms require other methods to render the firearm permanently inoperable. Antique firearm- Any firearm (including any firearm with a matchlock, flintlock, percussion cap, or similar type of ignition system) manufacturing in or before 1898; and any replica of any firearm described above of this definition if such replica is not designed or redesigned for using rim fire or conventional centerfire fixed ammunition which is no longer manufactured in the United States and which is not readily available in the ordinary channels of commercial trade. If the firearm in question falls into one of the above categories, you failed to bring that to my attention at the time of the inspection. (If my memory serves me correctly it doesn’t). We at the (Bureau ATF) will work diligently to provide you with most update, correct, and accurate information. To my knowledge all other firearms with rare exception are subject to inspection and thus regulated by ATF. I will be in touch!
