Bill Would Split Ninth Circuit Court of Appeals

(CNSNews.com) - Two U.S. senators Monday introduced a measure to split the Ninth Circuit Court of Appeals, the same court that ruled the Pledge of Allegiance unconstitutional.

Sens. Lisa Murkowski (R-Alaska) and John Ensign (R-Nev.) have introduced the Court of Appeals Restructuring and Modernization Act or CARMA (S. 1845), which is designed to improve the effectiveness and efficiency of the court by reducing its size and creating a new Twelfth Circuit. CARMA was also co-sponsored by Sen. Ted Stevens (R-Alaska).

"It's always been both Senator Ensign's and my strong belief that there are many ways to divide the Circuit effectively and, that it's equally important for the Senate to speak with one voice on this important issue. The new Murkowski/Ensign bill represents that unified voice," Murkowski said in a statement.

Murkowski introduced a similar measure, S. 1296, earlier this year, which would have split the court in two. Meanwhile, Ensign introduced a bill around the same that would have split it three ways, creating new Twelfth and Thirteenth Circuit Courts.

CARMA borrows from Ensign's version of the bill by increasing the number of judges in the new Twelfth Circuit from 19 to 20. It would also add to the judicial rotation of the court the following cities: Las Vegas, Seattle, Phoenix, Portland, Missoula, Pasadena, San Francisco and Honolulu.

The Ninth Circuit, which covers nine states, is considered the largest of all U.S. Circuit Courts. It is larger than the 1st, 2nd, 3rd, 4th , 5th , 6th , 7th , and 11th Circuits combined. The Ninth Circuit contains the fastest growing states in the U.S.

According to the Census Bureau, by 2010, the population of the states the Ninth Circuit covers will grow to over 63 million.

The court's increasing caseload negatively impacts the judges' ability to stay on top of legal developments, Murkowski said. It handles more cases than any other Circuit. Last year alone, 14,272 cases were filed.

The Ninth Circuit is the only circuit in which all judges do not review panel decisions, and it allows the court to be comprised of 11 members compared to the full 28 members. Every other Circuit requires a review by its full panel, thus resulting in the need for only six members of the 28 to have a majority opinion, Murkowski added.

As it stands now, the average time to get a final disposition of an appellate case in the Ninth Circuit is about five months longer than the national average.
 
Circuit Court of Appeals are federal appointments. So you'll basically be allowing the Bush Administration to divvy up the current 9th circuit's area of influence and replace it with either one or two courts composed entirely of Bush appointees (with the advice and consent of the Senate).

Given the huge blow that would be to liberal power, I cannot imagine that the bill would ever pass since they would throw themselves under a bus before allowing that.
 
OTOH, Republicans control Congress, and if thery're smart, they WILL replace the 9th with 2 more conservative courts.

I think we have ample evidence whch demonstrates they are NOT smart.

that the 9th is the Circuit most overturned (by the Supreme Court)?

Well over 50% most any year, and IIRC, 23 out of 24 last year?
 
I'd restrict the 9th Circuit to cover Los Angeles only (after all, there are enough people in and around the metroplex to make enough work for them!), and establish two or more circuits to cover the rest of the area currently supervised by the 9th. That way, all the idiot liberal judges could be concentrated in an already-lost-to-the-Left city, and we could hopefully get some sane judges in the rest of the area.

Of course, THR members in LA would be SOL... but maybe it would be an incentive for them to move! :D
 
Instead, Congress could put the Ninth's district out in the Mojave Desert overseeing a donkey and a tumbleweed. Divide the rest of the area into two or three circuits and then hopefully Bush would run out of Miers type buddies in the appointments. He's got a lot of friends, though.

Actually, let's leave the donkey out and make it five or six tumbleweeds: no telling what that bunch of leftist extremist nut cases might do to a perfectly innocent donkey.

Don't worry, I can drive a stick so-so, but it's easy to "grind it til you find it" on a bus. Just don't start on a hill.

GAAA, you noobs, leave the bus driving to me. I still can't believe that there are people out there who can't drive a stick shift. I sure hope that this bill gets passed.

/Are we all going to start arguing over who gets to drive the bus. :p
 
Well, I didn't bring it up, but as we have more or less covered the adaquate weapons for "Zombies" and "Mutant Bears", I will just go ahead and propose the suitable equipment for "Masses of Liberals". Busses just don't cut it! For medium sized groups, I nominate the 916 Cat bucket loader, and for large groups, the 88 Mine Roller. Of course, for the "More personal" level, a Bobcat skid-loader would seem to fit the bill.:neener:
 
This really needs to happen. The people of NM, AZ and other states are just just not being represented fairly by this circuit. The 9CC case load is double of any other circuits. The 9th Circuit is too big, not fairly representing the population. GOA did a good write up on this big problem.
